Terms and Conditions of Spend and Redeem Campaign Organisers: Petron Fuel International Sdn Bhd (Company No. 4527-V) ( Petron ) and GCH Retail (Malaysia) Sdn Bhd (Company No. 667035-P)) ( Giant ) are the joint organisers of this Spend and Redeem Campaign. At Giant 1. Spend a minimum purchase of RM80 at any participating Giant outlet (West Malaysia and Sabah only) to receive RM2.50 Petron Fuel Voucher contained in the Raya Packet. 2. Campaign Period: Petron Fuel Vouchers are issued at any participating Giant outlet (West Malaysia and Sabah only) during the Campaign Period from 25 May 2017 21 June 2017. 3. Redemption Period: Petron Fuel Vouchers are redeemable at any participating Petron service station during the Redemption Period from 25 May 2017-19 July 2017. 4. Each Giant customer is limited to receive only three (3) pieces of Petron Fuel Voucher per transaction in a single receipt. 5. Combined value of more than one receipts are not allowed. 6. Petron Fuel Voucher is only redeemable at any participating Petron Service Station nationwide with a minimum spend of RM50 for the following Petron fuel products - Blaze 95, Blaze 97 and Blaze 100 only (excluding Diesel). 7. Only a maximum of two (2) Petron Fuel Vouchers (RM2.50 x 2 vouchers equivalent to RM5.00) are allowed to be redeemed per transaction as long as the combined value of the minimum purchase of RM50 of fuel products as mentioned above is meet. 8. Other terms & conditions applies as per stated in the Petron Fuel Vouchers. Petron Fuel Vouchers are not refundable and cannot be exchanged for cash or any other forms of legal tender. 9. Copied, damaged or defective Petron Fuel Voucher will not be accepted and Petron and Giant shall not be responsible for the loss or damage of the Petron Fuel Voucher. 10. Petron and Giant reserves the right to change or amend the terms and condition without prior notice and to deny the issuance or acceptance (as the case may be) of the Petron Fuel Vouchers to noneligible customers or for any reason whatsoever. Customers are deemed eligible when in compliance with all terms and conditions stated herein. 11. Redemption of Giant Discount Savers is subject to the applicable terms and conditions from the respective third parties. Petron and Giant shall not be held liable for any loss or damage whatsoever suffered due to non-compliance to the applicable terms and conditions imposed by the respective third parties for the redemption of the applicable Giant Discount Savers of these third parties. 11. TERMS AND CONDITIONS OF THE GIANT HYPERMARKET SWEEP CONTEST Organisers: Petron Fuel International Sdn Bhd (Company No. 4527-V) ( Petron ) and GCH Retail (Malaysia) Sdn Bhd (Company No. 667035-P)) ( Giant ) are the joint organisers of the Giant Hypermarket Sweep Contest. Petron and Giant are collectively known as Organisers. Eligibility: 1. This Contest is open to all Malaysians who are Petron Miles Privilege Card members, aged eighteen (18) years old and above ( Contestants ), subject to the following Terms and Conditions. This Contest is not open to Fleet Card and Diesel Discount Card members. All transactions for the purpose of this Contest must be swiped with a validly registered Petron Miles Privilege Card to be considered as a valid entry. 2. The following categories of Contestants are NOT ELIGIBLE to participate in this Contest: a. Permanent/Contract Employees of the Organisers and/or its Affiliates; b. Petron s service station dealers; c. Employees of advertising and promotional agencies for the Organisers and/or its Affiliates (hereinafter collectively referred to as Non-Eligible Participants ); and d. The immediate family members (father, mother, spouses and children) of the Non-Eligible Participants are also not permitted to participate in the Contest. The Giant Hypermarket Sweep Contest: 1. To join the Giant Hypermarket Sweep Contest, Contestants have to purchase minimum RM50 worth of Petron fuel product - Blaze 95, Blaze 97 and Blaze 100 only (excluding Diesel) in a single receipt via cash or credit card purchases, at any participating Petron service stations. All purchases must be swiped with a validly registered Petron Miles Privilege Card in order for Contestants to be entitled for lucky draw entries. 2. Contestants are entitle to one (1) entry for every purchase of Petron fuel products Blaze 95, Blaze 97 and Blaze 100 (excluding Diesel) worth at least RM50 in a single receipt. 3. Contestants are entitled to two (2) entries for every purchase on Petron fuel products Blaze 95, Blaze 97 and Blaze 100 (excluding Diesel) worth at least RM100 in a single receipt. 4. No contest forms or transaction receipts are required. Contestants are deemed eligible automatically to participate in the Contest when in compliance with all Terms and Conditions stated herein. By being eligible and hence participating in the Contest, each Contestant is deemed to have agreed to adhere to the Terms and Conditions herein. 5. Based on all lucky draw entries received, the Organisers will then begin to select the required number of Contestants ( Shortlisted Contestants ). The Organisers decision on all matters relating to this Contest (including the selection of Shortlisted Contestants) shall be final and binding. No correspondence relating to the selection of winners will be entertained. 6. Each winner can only win one (1) prize for this Contest. If Petron Miles Privilege Card is not swiped to earn loyalty points, and/or purchase does not meet the required criteria, the entry will be deemed invalid. 7. The Shortlisted Contestant(s) will be contacted either by the Organisers or its appointed representative via phone (the telephone number as available in the Petron Miles database) and is required to answer one (1) Contest question correctly to be qualified as a winner. In the event a Shortlisted Contestant is unreachable via phone, the Organisers hereby reserves the right to select another Shortlisted Contestant. 8. By participating in this Contest, Contestants hereby agree to abide by the Terms and Conditions of the Contest, and to be contacted by promotional partners for their marketing activities. The Contest Prizes (Peninsular Malaysia) 1. Grand Prize Winners (x5) will win a chance to participate in the Giant Hypermarket Sweep for 5 minutes at selected Giant outlet to win up to RM5,000 worth of groceries items. 2. Consolation Prize Winners (x5) will win a chance to participate in the Giant Hypermarket Sweep for 3 minutes at selected Giant outlet to win up to RM3,000 worth of groceries items. Sabah 1. Grand Prize Winners (x5) will win a chance to participate in the Giant Hypermarket Sweep for 4 minutes at selected Giant outlet to win up to RM3,000 worth of groceries items. 2. Consolation Prize Winners (x3) will win a chance to participate in the Giant Hypermarket Sweep for 3 minutes at selected Giant outlet to win up to RM2,000 worth of groceries items.
Other Terms and Conditions: 1. The names of all winners will be published on Petron s website at www.petronmiles.com.my. 2. In the event that any Contest entry or prize will not be awarded to a person who: A. is not eligible for the Contest; and/or, B. has committed or is suspected of committing any fraudulent or wrongful acts in relation to his/her use of the Petron Miles Privilege Card; The Organisers reserves the right to disqualify such person from participating in the Contest and/or from receiving the prize. 3. All winners recorded by the Organisers shall be final and conclusive. 4. Winners shall be notified via phone (the telephone number as available in the Petron Miles database). 5. The Giant Hypermarket Sweep will be held at selected Giant Hypermarket outlets located within Klang Valley, Penang, Kuantan, Johor Bahru and Kota Kinabalu.There will be 10 winners (5 Grand Prize and 5 Consolation Prize) per location. The details on the date, time and actual location of the Giant Hypermarket outlet will be announced by Petron to the winners two (2) weeks in advance before the Giant Hypermarket Sweep day. 6. All cost, fees and/or expenses incurred or to be incurred by the winners in relation to the Contest and/or to claim the Prize(s), which shall include but not limited to the cost for transportations, accommodation, meals, personal costs and/or any other costs, are the sole responsibility of the winners. 7. In the event any of the winners are unable to attend on the Giant Hypermarket Sweep day, he/she will automatically be disqualified and no compensation or arrangement will be made after that. 8. Conditions applicable on the Giant Hypermarket Sweep day: 8.1 Each winner is allowed to bring maximum four (4) family members to participate in the Giant Hypermarket Sweep. 8.2 Each winner and their family members will be given two (2) shopping carts/ trolleys to select as many groceries items in a given time:- Peninsular Malaysia Grand Prize - Five (5) minutes (equivalent to 300 seconds) to select as many groceries items within the designated area in the identified Giant Hypermarket store not exceeding the Prize Amount (maximum RM5,000 for each Grand Prize winner) Consolation Prize - Three (3) minutes (equivalent to 180 seconds) to select as many groceries items within the designated area in the identified Giant Hypermarket store not exceeding the Prize Amount (maximum RM3,000 for each Consolation Prize winner). Sabah Grand Prize Winners (x5) will win a chance to participate in the Giant Hypermarket Sweep for 4 minutes at selected Giant outlet to win up to RM3,000 worth of groceries items. Consolation Prize Winners (x3) will win a chance to participate in the Giant Hypermarket Sweep for 3 minutes at selected Giant outlet to win up to RM2,000 worth of groceries items.
8.3 The winners will begin and end the Giant Hypermarket Sweep at the sound of the horn. Upon hearing the final horn, all the winners must return to the check-out counter. Any item(s) taken after the horn will be removed from the shopping carts/trolleys. 8.4 In the event that the total cost of groceries items selected ( Total Amount ) exceeds the Prize Amount, the winner has an option to either pay the difference between the Total Amount and the Prize Amount or to remove selected item(s) from the shopping carts/ trolleys. The Organisers shall not be liable to pay any difference between the Total Amount and Prize Amount. 8.5 All winners will be expected to practice due diligence and full liability and responsibility when handling the shopping carts/ trolleys during the Giant Hypermarket Sweep. 8.6 The Organisers shall not be held responsible or liable for any loss, damage or injury in any manner whatsoever suffered by the winners as a result of their participation in the Contest and /or use of the groceries item(s). 8.7 Any dispute in relation to quality or warranty of the groceries item(s) or any terms and conditions in respect thereof shall be settled directly by the winner with the authorized dealer/supplier without any further recourse to the Organisers. The Organisers are not responsible or liable for any breach by respective dealer/supplier in relation to the quality or warranty of the groceries item(s) or any terms and conditions in respect thereof. The Organisers makes no other warranties, express or implied, including but not limited to, the implied warranties or conditions of merchantability and that of fitness for a particular purpose of the groceries item(s). 9. The Organisers reserves the right to cancel, shorten, extend, suspend or terminate the Contest Period at any time prior to the expiry of the Contest Period without prior notice. The Organisers also reserves the right to vary, modify, delete or change any of the Terms and Conditions herein contained at any time at its absolute discretion without prior notice. For avoidance of doubt, any cancellation, extension, suspension or termination of the Contest Period at any time prior to the expiry of the Contest Period shall not entitle the Contestants to claim any compensation from the Organisers for any and all losses or damages suffered or incurred by the Contestants as a result of the said cancellation, extension, suspension or termination. 10. The Organisers reserves the right to use the names, addresses, photographs, and testimonies of the Contestants in advertisements and other forms of publicity in conjunction with the Contest. The Contestants' participation in the Contest and agreement to be bound to the terms and conditions herein shall be deemed to indicate their implied consent to such use, without further notice, payment or consideration whatsoever. 11. By entering into the Contest and accepting a prize, all winners must agree that the Organisers has reserved the right to picture, voice record or portray them as contest winners in any manner whatsoever as the Organisers may in its absolute discretion decide, and to exhibit these material for all contest-related advertising, marketing and publicity purposes without any compensation whatsoever, subject to applicable laws and regulations. Participants and eventual winners of the Contest are hereby notified and deemed to consent to the Organisers right to use their name, voice, picture or footage, or the content of their entries solely for the abovementioned purposes. 12. The Organisers reserves the right to substitute the prize(s) with of equal or greater value, if deemed necessary. 13. Contestants hereby agree to release the Organisers, its directors, officers, employees and agents, including without limitation, its parent companies, subsidiaries, affiliates, employees, agencies and branches, as well as all contest partners / sponsors and all others associated with the development and execution of this Contest, from and against any and all liability for injury, loss or damage of any kind (whether direct, indirect or consequential) to or in any way arising from this Contest and the awarding and the use or misuse or possession of any prizes awarded, including liability for personal injury, death or property damage, except where prohibited or limited by law. All winners acknowledge that to the extent permissible by law, the prizes are awarded by the Organisers on an as is basis without any warranty of any kind whether express or implied, including but not limited to the implied warranties of satisfactory quality, and non-infringement.
14. Contestants will fully indemnify and hold harmless the Organisers, its directors, officers, employees, agents and assigns against any and all losses, liabilities, costs, claims, charges, expenses, actions or demands (including legal costs), whether direct or indirect arising out of a breach by him or her of these Terms & Conditions. 15. This Contest is governed by the laws of Malaysia and all disputes are subject to the exclusive jurisdiction of the courts of Malaysia. 16. If for any reason any part of this Contest is incapable of running as planned, the Organisers may in its sole discretion cancel, terminate, modify or suspend the contest, or invalidate any affected entries without any further liability or any obligation to continue the Contest. 19. The invalidity or unenforceability for any reason of any part of these Terms & Conditions shall not prejudice or affect the validity or enforceability of the remaining parts and each part of these Terms & Conditions is distinct and at all times severable from the rest of the Terms & Conditions. 20. The Organisers will not be responsible or liable for any claims, loss or damage whatsoever, resulting from or in connection with this Contest or the prizes given out through this Contest. 21. The Organisers are the final authority to decide on the interpretation of these Terms and Conditions and as to any other matters relating to this Contest. 22.
