INTRODUCTION ERROR! SPECIFIED. SWITCH ARGUMENT NOT USING HUMAN RIGHTS MONITORING FOR SDG IMPLEMENTATION The Danish Institute for Human Rights (DIHR) has made an initial attempt to link human rights monitoring with the 2030 Agenda for Sustainable Development. DIHR produces an annual Status Report, which reviews the status of human rights in Denmark and provides recommendations to further strengthen the implementation of these. Based on the 2014-15 1 Report, this paper concretely maps where DIHR recommendations relate to specific Sustainable Development Goals (SDGs) and targets. Thereby, it identifies priority areas for Denmark in its national implementation of the SDGs. Beyond Denmark, the mapping provides an example of how human rights monitoring and SDG implementation is interlinked, which can hopefully inspire other National Human Rights Institutions, Governments and civil society actors. DIHR 2014-15 Status Report reviews 22 thematic areas, where human rights are at stake. The areas of recommendations in the DIHR Status Report, which resonate with specific SDG targets are: IMPLEMENTATION OF HUMAN RIGHTS (2), ASYLUM (3), CHILDREN (4), ETHNIC ORIGIN (6), FAMILY LIFE (7), DEPRIVATION OF LIBERTY (9), DISABILITY (10), GENDER (11), USE OF FORCE (12), HUMAN TRAFFICKING (13), RELIGION (14), FAIR TRIAL (15), THE RIGHT TO HOUSING (16), CITIZENSHIP (17), EDUCATION (18), FREEDOM OF EXPRESSION (21), THE ELDERLY (22). SWITCH ARGUMENT NOT LINKS BETWEEN SDGS AND DIHR RECOMMENDATIONS GOAL 3: ENSURE HEALTHY LIVES AND PROMOTE WELL-BEING FOR ALL AT ALL AGES 2030 AGENDA FOR SUSTAINABLE DEVELOPMENT Target 3.4 By 2030, reduce by one third premature mortality from noncommunicable diseases through prevention and treatment and promote mental health and well being STATUS REPORT RECOMMENDATIONS The Danish Institute for Human Rights recommends, among other things, that Denmark: ASYLUM 3.4: prior to or in direct connection with detention, introduces a mandatory and more comprehensive medical examination of all asylum seekers whom the police intend to detain, including the involvement of physicians, psychologists and others. (+ 10.7 2 ) DEPRIVATION OF LIBERTY 9.4: ensures that mentally ill persons in remand custody or serving a prison sentence are subjected to conditions that take account of their special needs, including that the plan for having mental health professionals associated with all detention centres be implemented; DISABILITY 10.2: introduces an expiration date for the prolonged use of physical restraints in psychiatric treatment of over 48 hours, so that the use of physical restraints in psychiatric treatment of over 48 hours will be phased out; THE ELDERLY 22.1: amends the Health Act in order to meet the critical medical needs of permanently legally incapacitated patients, regardless of whether they refuse treatment; 2 References in brackets refer to additional linkages to other SDG targets of relevance

Target 3.5. Strengthen the prevention and treatment of substance abuse, including narcotic drug abuse and harmful use of alcohol Target 3.8. Achieve universal health coverage, including financial risk protection, access to quality essential health- care services and access to safe, effective, quality and affordable essential medicines and vaccines for all THE ELDERLY 22.2: amends the Social Services Act s administrative notice on the use of force and related guidelines so that caregivers are not placed in situations where they must choose between not providing necessary care to people with dementia and others with significant and permanent disabilities versus providing care on an unauthorized basis; CHILDREN 4.4: ensures that the healthcare agreements specify who is responsible for and who coordinates support for children whose parents must be, or are being, treated for substance abuse; (+16.2) ETHNIC ORIGIN 6.3: ensures that qualified interpretation services are available when a patient in need of interpretation is in contact with the Danish health system; GOAL 4: ENSURE INCLUSIVE AND EQUITABLE QUALITY EDUCATION AND PROMOTE LIFELONG LEARNING OPPORTUNITIES FOR ALL 2030 AGENDA FOR SUSTAINABLE DEVELOPMENT Target 4.2. By 2030, ensure that all girls and boys have access to quality early childhood development, care and preprimary education so that they are ready for primary education Target 4.5. By 2030, eliminate gender disparities in education and ensure equal access to all levels of education and vocational training for the vulnerable, including persons with disabilities, indigenous peoples and children in vulnerable situations. STATUS REPORT RECOMMENDATIONS The Danish Institute for Human Rights recommends, among other things, that Denmark: FAMILY LIFE 7.2: concerning the Consolidation Act on Social Services, administrative orders and guidelines, clarifies the obligation of the municipal and state authorities to provide support for parents who, because of disability, need help or special support for parenting. (+10.2) EDUCATION 18.2: ensures the access to appeal all municipal decisions on adaptation and support for school pupils, regardless of whether the decision relates to the adaptation and support is for less than nine hours per week. 6

By 2030, ensure that all learners acquire the knowledge and skills needed to promote sustainable development, including, among others, through education for sustainable development and sustainable lifestyles, human rights, gender equality, promotion of a culture of peace and non-violence, global citizenship and appreciation of cultural diversity and of culture s contribution to sustainable development GENDER 11.3: ensures that the institutions carrying out educational counselling for young people present educational opportunities to the youth that are not limited by gender stereotypes in education and can thus challenge the young people in their educational choices; EDUCATION 18.1: establishes a national action plan for human rights education for the entire education sector; GOAL 5: ACHIEVE GENDER EQUALITY AND EMPOWER ALL WOMEN AND GIRLS 2030 AGENDA FOR SUSTAINABLE DEVELOPMENT Target 5.2. Eliminate all forms of violence against all women and girls in the public and private spheres, including trafficking and sexual and other types of exploitation. Target 5.3. Eliminate all harmful practices, such as child, early and forced marriage and female genital mutilation Target 5.4. Recognize and value unpaid care and domestic work through the provision of public services, infrastructure and social protection STATUS REPORT RECOMMENDATIONS The Danish Institute for Human Rights recommends, among other things, that Denmark: GENDER 11.5: ensures a uniform and effective handling of cases of domestic violence in all police districts, so victims receive immediate and adequate protection and further escalation of violence is prevented, including through the use of personal attack alarms. (+16.1) HUMAN TRAFFICKING 13.1: investigates in detail, in the assessment of transfer under the Dublin Regulation, the extent to which the rights of a victim of human trafficking in the receiving country are considered; (+8.7, 10.7, 16.2) CHILDREN 4.2: ensures that the municipality s antiabuse measures are well developed and supported to include the prevention and management of all forms of child abuse, including psychological abuse; (+16.2) GENDER 11.1: launches initiatives that ensures a more gender-balanced distribution of parental leave;

policies and the promotion of shared responsibility within the household and the family as nationally appropriate Target 5.5. Ensure women s full and effective participation and equal opportunities for leadership at all levels of decision-making in political, economic and public life Target 5.a Undertake reforms to give women equal rights to economic resources, as well as access to ownership and control over land and other forms of property, financial services, inheritance and natural resources, in accordance with national laws. Target 5.c Adopt and strengthen sound policies and enforceable legislation for the promotion of gender equality and the empowerment of all women and girls at all levels. GENDER 11.4: specifies the mainstreaming obligations in the Act on Equal Pay to Men and Women and strengthen the Act s 6(a) in order to ensure systematic monitoring of equal pay developments in Denmark, as a follow-up to the Wage Commission s recommendations on equal pay; (+5.a, 5.c, 8.5) GENDER 11.4: specifies the mainstreaming obligations in the Act on Equal Pay to Men and Women and strengthen the Act s 6(a) in order to ensure systematic monitoring of equal pay developments in Denmark, as a follow-up to the Wage Commission s recommendations on equal pay; (+5.5, 5.c, 8.5) GENDER 11.4: specifies the mainstreaming obligations in the Act on Equal Pay to Men and Women and strengthen the Act s 6(a) in order to ensure systematic monitoring of equal pay developments in Denmark, as a follow-up to the Wage Commission s recommendations on equal pay; (+5.5, 5.a, 8.5) GOAL 8: PROMOTE SUSTAINED, INCLUSIVE AND SUSTAINABLE ECONOMIC GROWTH, FULL AND PRODUCTIVE EMPLOYMENT AND DECENT WORK FOR ALL 2030 AGENDA FOR SUSTAINABLE DEVELOPMENT Target 8.5. By 2030, achieve full and productive employment and decent work for all women and men, including for young people and persons with disabilities, and equal pay for work of equal value STATUS REPORT RECOMMENDATIONS The Danish Institute for Human Rights recommends, among other things, that Denmark: ETHNIC ORIGIN 6.4: ensures that a guide is produced describing the Act Prohibiting Discrimination within Employment which clearly describes when and how employers can promote nondiscriminatory measures. (+8.8, 5.c, 10.2, 10.3, 10.4, 16.b) GENDER 11.4: specifies the mainstreaming obligations in the Act on Equal Pay to Men and Women and 8

Take immediate and effective measures to secure the prohibition and elimination of the worst forms of child labour, eradicate forced labour and, by 2025, end child labour in all its forms, including the recruitment and use of child soldiers Target 8.8. (+8.5, 5.c, 10.2, 10.3, 10.4, 16.b) GOAL 10: REDUCE INEQUALITY WITHIN AND AMONG COUNTRIES 2030 AGENDA FOR SUSTAINABLE DEVELOPMENT Target 10.2 By 2030, empower and promote the social, economic and political inclusion of all, irrespective of age, sex, disability, race, ethnicity, origin, religion or economic or other status STATUS REPORT RECOMMENDATIONS The Danish Institute for Human Rights recommends, among other things, that Denmark: ETHNIC ORIGIN 6.1: formulates a national action plan to combat hate crimes; (+16.1, 10.3, 10.4, 16.b, 17.14) ETHNIC ORIGIN 6.4: ensures that a guide is produced describing the Act Prohibiting Discrimination within Employment which clearly describes when and how employers can promote nondiscriminatory measures. ASYLUM 3.1: adopts clear rules regarding with what legal basis, under which circumstances, on what conditions and how long a forced return can be suspended, and in cases of prolonged suspension of forced return, under what conditions the particular asylum applications shall be reopened in order to assess whether the causes of the continued suspension can entail the granting of a residence permit pursuant to the Aliens Act section 7; ASYLUM 3.2: only detains minor asylum seekers, including unaccompanied minors, if the facilities can meet the specific needs of minors; ASYLUM 3.3: further examines the consequences for the development and well-being of unaccompanied minors of being granted temporary residence permits that would normally expire when they reached the age of 18, as well as consider whether, on this background, there is reason to change the rules on the duration of the residence permit granted to unaccompanied minors; ASYLUM 3.4: prior to or in direct connection with detention, introduces a mandatory and more comprehensive medical examination of all asylum seekers whom the police intend to detain, including the involvement of physicians, psychologists and others. GOAL 11: MAKE CITIES AND HUMAN SETTLEMENTS INCLUSIVE, SAFE, RESILIENT AND SUSTAINABLE 2030 AGENDA FOR SUSTAINABLE DEVELOPMENT Target 11.1 By 2030, ensure access for all to adequate, safe and affordable housing and basic services and upgrade slums STATUS REPORT RECOMMENDATIONS The Danish Institute for Human Rights recommends, among other things, that Denmark: THE RIGHT TO HOUSING 16.1: sets a specific goal for and continuously monitor developments in the supply of affordable public housing that people with the lowest incomes can pay; THE RIGHT TO HOUSING 16.2: implements a systematic registration of the use of any of the alternative letting rules (udlejningsredskaber). It should be possible to aggregate the data collection by social and economic status, disability, gender, and immigrants/descendants; (+17.18) THE RIGHT TO HOUSING 16.3: takes initiatives to ensure that landlords in the private sector do not discriminate against ethnic minorities, particularly young men from ethnic minorities; THE RIGHT TO HOUSING 16.4: develops a comprehensive policy for dealing with foreign homeless persons in accordance with human rights standards; 12

Significantly reduce all forms of violence and related death rates everywhere Target 16.2. End abuse, exploitations, trafficking and all forms of violence against and torture of children STATUS REPORT RECOMMENDATIONS The Danish Institute for Human Rights recommends, among other things, that Denmark: ETHNIC ORIGIN 6.1: formulates a national action plan to combat hate crimes; (+5.c, 10.2, 10.3, 10.4, 16.b, 17.14) GENDER 11.5: ensures a uniform and effective handling of cases of domestic violence in all police districts, so victims receive immediate and adequate protection and further escalation of violence is prevented, including through the use of personal attack alarms. (+5.2) USE OF FORCE 12.1: clarifies the scope of the use of pepper spray in prisons and detention centres, including that pepper spray must basically not be used in enclosed spaces or against inmates over which the staff has full control; CHILDREN 4.1: prohibits solitary confinement of children within the criminal justice system; CHILDREN 4.2: ensures that the municipality s antiabuse measures are well developed and supported to include the prevention and management of all forms of child abuse, including psychological abuse; (+5.3) CHILDREN 4.3: ensures that there are enough qualified and specialised placement possibilities for children with special problems, and that the placement institutions are made aware of the children s cultural and religious background and any special needs; CHILDREN 4.4: ensures that the healthcare agreements specify who is responsible for and who coordinates support for children whose parents must be, or are being, treated for substance abuse; (+3.5) CHILDREN 4.5: clarifies in the legislation, administrative regulations and government practices that children have a right to express their views in all matters

affecting them, and that their views must be given due weight in accordance with their age and maturity, also in in connection with the use of force against them (+16.10) HUMAN TRAFFICKING 13.1: investigates in detail, in the assessment of transfer under the Dublin Regulation, the extent to which the rights of a victim of human trafficking in the receiving country are considered; (+5.2, 8.7, 10.7) Target 16.3. Promote the rule of law at the national and international levels and ensure equal access to justice for all Target 16.6. Develop effective, accountable and transparent institutions at all levels Target 16.7. Ensure responsive, inclusive, participatory and representative decision-making at all levels Target 16.9. By 2030, provide legal identity for all, including birth registration DEPRIVATION OF LIBERTY 9.1: significantly reduces the use and length of remand custody USE OF FORCE 12.2: clarifies the boundaries of stopand-search zones in terms of time and geographic extent; FAIR TRIAL 15.1: undertakes a comprehensive and fundamental analysis of the legal aid area, including the financial framework, in order to examine the extent to which the existing legal aid arrangements should be changed in order to ensure that all citizens have effective access to the judicial system; THE ELDERLY 22.4: attaches considerable weight to citizens own assessment of their IT skills and access to the necessary IT equipment when assessing whether to grant an exemption from the obligatory digital communication with public authorities; DISABILITY 10.4: changes the electoral law so that persons who have been appointed a guardian under the Guardianship Act section 6 will retain the right to vote and to stand for election; DISABILITY 10.5: reforms the Danish Guardianship Act in order to promote supported decision-making. CITIZENSHIP 17.4: amends the Nationality Act so that children born in Denmark automatically are granted Danish nationality at birth if they are not entitled to acquire the nationality of any other country by birth; CITIZENSHIP 17.5: changes the nationality legislation so that the acquisition of Danish nationality is eased for persons who have resided in Denmark for more than nine years prior to their 18th birthday 14

Strengthen relevant national institutions, including through international cooperation, for building capacity at all levels, in particular in developing countries, to prevent violence and combat terrorism and crime CHILDREN 4.5: clarifies in the legislation, administrative regulations and government practices that children have a right to express their views in all matters affecting them, and that their views must be given due weight in accordance with their age and maturity, also in in connection with the use of force against them (+16.2) FREEDOM OF EXPRESSION 21.1: abolishes the criminalization of blasphemy from the Criminal Code ( 140); FREEDOM OF EXPRESSION 21.2: in addition to the overview of case law and guideline already published, periodically publishes statistics from police, prosecutors and courts treatment of cases of hate speech under Criminal Code 266(b) as well as periodically publishes information for the use of the Criminal Code s 81, no. 7 on aggravating circumstances for attacks motivated by the victim s legal expressions FREEDOM OF EXPRESSION 21.3: launches initiatives to raise awareness of the rules on the freedom of expression of public employees, particularly as concerns their loyalty obligations. IMPLEMENTATION OF HUMAN RIGHTS 2.3: in cooperation with the self-governance of Faroe Islands establishes a national human rights institution for the Faroe Islands; DEPRIVATION OF LIBERTY 9.5: undertakes a closer examination of the extent and nature of violence and threats within the Prison and Probation Service s institutions.
