NINTH JUSTICE HIDAYATULLAH MEMORIAL NATIONAL MOOT COURT COMPETITION (HNMCC), 2017 General Rules for HNMCC 2017: i. Organizers means the Hidayatullah National Law University, Naya Raipur. ii. Participating Team means the team which has registered itself for the competition as per the Rules given below. iii. Participating College/University/Institution shall be presumed to be the parent institution of the Participating Team. iv. All the rules are only inclusive and not exhaustive for the competition. v. Rules should be strictly adhered to. Any deviation there from would attract disqualification or other penalties mentioned subsequently. vi. All decisions by the Organizers in case of any disputes/ doubts etc. will be final. The Organizers may make such rules and procedures at any point of time, as they deem fit. vii. Imposition of penalties including disqualification rests solely with the Organizers in case of failure to comply with the rule(s) and deadline(s). I. Date and Venue: The 9 th Justice Hidayatullah Memorial National Moot Court Competition 2017 shall be held from 24 th 26 th March, 2017 at Hidayatullah National Law University, Uparwara, Abhanpur, Naya Raipur (C.G.). II. Dress Code: Inside the Court Room the participants shall be in formal wear only. i. Male participants are required to wear a full suit - comprising of a black formal jacket and trousers, full sleeved shirts, ties and formal footwear. ii. Female participants are required to wear Western or Indian formals with appropriate formal footwear.

III. Language: The official working language of the Moot Court Competition is English. IV. Eligibility: The competition is open only for bonafide students of recognized Institutions /Universities /Organizations who are currently pursuing their Bachelors Degree in Law i.e. 3-Year LL.B. or 5- Year LL.B. Integrated Programme. V. Team composition: i. Each team shall consist of a minimum of 2 and maximum of 3 members. This number cannot be modified under any circumstances. ii. There shall be 2 speakers and 1 researcher designated in a 3 member team while in case of a 2 member team, both the members shall be considered to be speakers. Teams shall identify the speakers and researcher during registration. No extra member or observer shall be allowed. iii. Any additional member of any Participating Team shall not be entitled for hospitality or for any award. Such member or observer shall not be allowed to watch any of the rounds of the competition iv. Each team will have a team code and each participant shall be given an individual code. v. Teams shall not disclose their identity or that of their institution or city, etc. except in the registration form. Any such disclosure shall invite strict penalty including disqualification. The decision for the same shall be at the discretion of the Organizers. VI. Registration: i. Teams must confirm their participation by sending a scanned copy of the Registration Form (annexed herewith) - completely filled and duly signed by the Head of the Participating Institution to hnmcc@hnlu.ac.in latest by 11:59 pm on 20 th February, 2017. ii. No forms received after the deadline shall be considered for registration. iii. In case of any changes in the team composition, in terms of the members, the same must be officially conveyed to the Organizers at the time of the formal registration.

iv. Formal Registration of the Participating Team (s) shall take place on 24 th March, 2017, 16:00 hours onwards at Hidayatullah National Law University, Uparwara, Abhanpur, Naya Raipur (C.G.). v. Every Participating Team will be allotted a team code which will be communicated in due time via email. VII. Demand Draft: The teams shall be required to send the nominal registration fee of Rs. 2500 (Rupees Two Thousand Five Hundred Only) through Demand Draft, drawn in favour of The Registrar, HNLU Raipur payable at Raipur, to be received latest by 20 th February, 2017 at the address given below for correspondence. Along with the Demand Draft, the teams shall also be required to send the hard copy of the duly filled Registration Form Note: Demand Draft and Registration Form should be sent through speed post only as the courier services are very poor at the address for correspondence. IX. Rounds: There shall be two Preliminary Rounds, a quarter-final round, a semi-final round and a final round. Lots picked by the teams will decide the side of the arguments in Preliminary, Quarter-Finals, Semi-Finals & Final Rounds. i. Orientation & draw of lots shall take place on Friday, 24 th March, 2017. ii. There shall be two preliminary rounds wherein every Participating Team shall be required to argue once from each side. iii. Preliminary round(s) and Quarter-Finals will be held on Saturday, 25 th March, 2017. iv. Top eight teams will qualify for the Quarter- Finals at the end of the Preliminary Rounds. The first eight teams will be selected on the basis of their oral scores in the Preliminary Rounds plus the scores in the memorials. v. Scores in the researchers test will be used in order to resolve a tie. vi. The Semi Finals and the Finals will be held on Sunday, 26 th March, 2017.

X. Researcher Test: A Researcher Test shall also be conducted for adjudicating the Best Researcher on Saturday, 25 th March, 2017. The Speakers shall not be eligible to participate in the test. However, in case of a 2 member team, one of the speakers shall be eligible to appear for the Researcher Test and that shall be notified to the Organizers at the time of Formal Registration. XI. Memorials: The following requirements for memorials must be strictly followed and any noncompliance of the same shall attract penalties. i. Each team must prepare memorials for both the sides to the dispute (Appellant and Respondent). ii. The Memorials shall be consistent with the Supreme Court Rules, 1966. iii. Once the Memorials have been submitted, no revisions, supplements or additions will be allowed. iv. The last date for submitting the Memorials (for both Appellant and Respondent sides) in soft copy is 26 th February, 2017 latest by 11:59 pm (23:59 Hours). The Memorials so submitted shall be judged for the Best Memorial Award. No amendments/ improvements shall be made subsequent to the referred submission. v. The Memorials shall be sent via e-mail to hnmcc@hnlu.ac.in. The Soft Copy should be sent in Microsoft Office Word Format [.doc or.docx] and PDF format [.pdf]. Attachments should be titled as <Team code ><A> for Appellant side and as <Team code><r> for Respondent side. e.g. 45A and 45R. vi. Six (6) copies each of the memorials for Appellant & Respondent (excluding copies for use by the team) should be carried by the teams at the time of Registration for the Oral rounds. vii. Late submissions beyond the stipulated date will attract a 2 points penalty for each day of delay. No submissions shall be accepted in any case after 28 th February, 2017 (23:59 Hours).

viii. It shall be the sole responsibility of the respective Participating Teams to ensure that the correct number of copies of the Memorials is submitted to the Organizers within the prescribed deadline. ix. In case there are more than 30 teams registering for HNMCC 2017, there shall be a Memorial Round to select the best 30 teams for the competition. In case any team fails to qualify in the memorial round their registration will be cancelled and the DD sent for the registration fees will be returned at the earliest. x. Format of Memorials. a) Cover Page: The cover page of the memorial must state the following: Team Code on upper Left-hand side corner. The case title Color of the cover page must be: Blue in case of Petitioner/Appellant Red in case of Defendant/Respondent. The Party for which the Memorial has been prepared. b) The table of contents. c) The index of authorities. d) The statement of jurisdiction. e) The statement of facts. f) The statement of issues. g) The summary of arguments. h) The arguments advanced/ body of arguments. i) The prayer xi. Memorial general format: Spacing: 1.5 Line Spacing

Margins: One inch margin on all sides of each page. Font: The font for the body of the memorial shall be Times New Roman, size 12. The font for the footnotes shall be Times New Roman, size 10, line spacing 1.0. xii. Memorials must be spiral bound only. xiii. Page numbering should be at the bottom middle of each page. xiv. The memorials must not contain any annexure / photographs / sketches / exhibits / affidavits, etc. xv. Teams shall cite authorities in their Memorials by way of a uniform style of citation. xvi. The maximum number of pages in each Memorial should not exceed 35 pages including 20 maximum pages for Written Submissions/Arguments Advanced. xvii. The Memorials shall not, in any way, disclose any fact pertaining to the identity of the Participating Team, its Members, or the Institution/College/University so represented. xviii. Marking of Memorials Every Memorial shall be marked on a total of 100 marks and the team memorial marks will be the average of the total of both sides. The following shall be the marking scheme: S. XII. Oral Rounds In each oral round, a team shall be represented by two speakers to present the arguments. The researcher shall not participate in the arguments but has to be present during the Oral Rounds. i. Preliminary Rounds: Each team will be given a total of 30 minutes to present their case. The time includes questioning by judges. The division of time is left on the discretion of the team members, subject to a maximum of 18 minutes per speaker. Division of time should be informed to the Court Assistants/Clerks at the beginning of the round. The oral arguments need to be confined to the issues presented in the memorials. Passing of notes to the speakers by the researcher during the rounds is allowed. A maximum of 5 minutes may be reserved for rebuttal or sur-rebuttal. Judges may at their discretion, extend the time allotted for the oral arguments up to a maximum of 10 minutes. In the Preliminary Rounds, each Team shall argue once as an Appellant and once as a Respondent. All teams are expected to carry with themselves any case law and authorities which they intend to refer to. ii. Quarterfinal, Semifinal & Final Rounds: The time limit in the Quarterfinals and the Semifinals is the same as preliminaries. In the Finals each team will get a total 45 minutes to present their case. The division of time is left on the discretion of the team members, subject to a maximum of 25 minutes per speaker. Division of time should be informed to the Court Assistants/Clerks before the beginning of the rounds. The oral arguments need not be confined to the issues presented in the memorials. The side the Participating Team will be arguing for will be decided by a draw of lots, with the Participating Teams picking the lots. XIII. Scouting: Teams will not be allowed to observe the Oral Rounds of any other teams. Scouting is strictly prohibited. Scouting by any of the teams will result in instant disqualification. Any team can file a written complaint with the Organizers, regarding a case of scouting. In case of any default the Organizers decision will be final. XIV. Scoring:

The Marking Scheme for the evaluation of the oral arguments shall be the following: S. No. Marking Scheme Marks Allotted 1. Knowledge of Facts and Law 20 2. Persuasiveness 10 Grand Total: 100 XV. Awards: i. Winning Team Award a. Winner s Trophy; b. Cash Prize of Rs. 25,000. ii. Runner up Team Award a. Runner s up Trophy; b. Cash Prize of Rs. 15,000. iii. Best Speaker Award a. Cash Prize of Rs. 7,500. iv. Best Memorial Award a. Cash Prize of Rs. 7,500. v. Best Researcher Award a. Cash Prize of Rs. 7,500. In addition to the above awards, Certificate of Participation shall be awarded to all the participants. XVI. Announcements of Results:

i. The results of the Preliminary rounds shall be announced shortly after the completion of both the rounds. ii. The results of the Quarter-final and Semi-final Round(s) shall be announced shortly after the completion of each of the rounds. iii. The winners of the competition will be announced during the Awards ceremony on Sunday, 26 th March, 2017. XVII. Anonymity: Participants/ Participating Teams shall not disclose their names and the identity of their respective institution/ college/university at any time before the award ceremony. Each team shall be issued individual codes, at the time of the registration and the same shall be the sole source of identity of the respective teams throughout the competition. Note: All Participants shall refrain from wearing, using or carrying in any form, any identifying items, such as badges, blazers, pins or any other identifying material(s) such as a books/bags with a college/university/library logo or seal. XVIII. Copyright: i. The copyright over the memorials submitted for participation in the competition is assigned by participants and shall vest completely and fully on Hidayatullah National Law University, Uparwara, Abhanpur, Naya Raipur (C.G.) The Participants shall certify in writing the originality of materials contained therein and shall be responsible for any claim or dispute arising out of the further use and exhibition of these materials. ii. Further use and exhibition of these materials, electronically or otherwise, shall be the exclusive right of Hidayatullah National Law University, Uparwara, Abhanpur, Naya Raipur (C.G.) India and they shall not be responsible for any liability to any person for any loss caused by errors or omissions in the collection of information, or for the accuracy, completeness, or adequacy of the information contained in these materials. XIX. Disclaimer:

The Moot Court Competition is based on a purely fictitious compromis, whereby the characters & the incidents or the course of events in the compromis are completely imaginary and the same has no relation to any person living or dead or any past/present real life incident. The Moot Court Competition is made solely for the purpose of training law students of India in developing an analytical bent of mind and serving the Bar and the Bench to the best of their abilities. XX. Accommodation and food: Accommodation and food shall be provided by the Organizers from the morning of 24 th March, 2017 to the morning of 27 th March, 2017. Teams wishing to stay back after 27 th March, 2017 shall have to make arrangements for accommodation, food and transport on their own. XXI. Transport: Transportation shall be provided by the Organizers to the Participating teams only at the time of their arrival and departure as per their previously intimated Travel Plan. However, regular bus trips from the Campus would be scheduled by the University during the Moot Court Competition. Note: Intake/use/even mere possession of any prohibited substances (e.g. cigarettes/alcoholic/narcotic substances) is strictly banned during their stay throughout the competition. XXII. Clarifications: i. Last date for requesting clarifications on Moot Problem is 24 th January, 2017. Teams may submit their clarifications via Email to hnmcc@hnlu.ac.in. Teams are requested to use the email as the mode for seeking clarifications. ii. All the clarifications will be posted on the University website: www.hnlu.ac.in on 30 th January, 2017. XXIII. Correspondence on the address given should only be through speed post as the courier services are very poor in this locality.
