No.Adm-II/Union's Election/2013-14/(463) Date:- 11.11.2013 C I R C U L A R The Commission in its 597th meeting held on 31.01.2012 has decided to assess the total number of members of both the Unions i.e. Khadi Commission Karmachari Union (KCKU) and Khadi Gramodyog Karmachari Sena (KGKS) by adopting Secret Ballot method through internal mechanism across all offices of KVIC. 2. In compliance with the above decision of the Commission, the modalities as well as tentative time schedule for conducting the election through Secret Ballot for verification of majority union in KVIC for the period from 01.01.2014 to 31.12.2016 has been prepared and annexed herewith as Annexure-A and B, for which, both the Unions have given their written consent. 3. All concerned are therefore, requested to comply with the above decision of the Commission and conduct election in their respective offices in accordance with the aforesaid modalities as well as time schedule. 4. Annexure-A MODALITIES FOR CONDUCTING ELECTION THROUGH SECRET BALLOT FOR VERIFICATION OF MAJORITY UNION IN KVIC FOR THE PERIOD FROM 01.01.2014 TO 31.12.2016. The following modalities are to be completed for conducting election for recognition of unions in KVIC. 1. Jt. CEO will be the overall Chief Controller for the entire election process of the Unions. 2. The Zonal Dy.CEOs in the Zone will be the Observer in the field and the Zonal Dy. CEOs will monitor the entire election process in their respective Zone through Video Conferencing. 3. State/Divisional Directors /Incharge /Principals /Project Managers/Managers KGBs will be Chief Presiding Officer in the Field for the Election process. 4. Similarly, in Central Office, the Director (Administration) will act as Chief Presiding Officer. 5. The Chief Presiding Officer will nominate suitable Presiding Officers including Polling Officers in order to conduct smooth/impartial/transparent election process and taken necessary precaution necessary precautions of security to maintain law and order wherever essential for Central Office as well as Field Offices. 6. All Non-Gazetted Staff except those who are on Contract/Daily Wages will be eligible to cast their votes in favour of any one of the Union contesting the election. 7. The election will be conducted through secret ballot in all the offices of KVIC across the country on same day between 10.00 a.m. to 3.00 p.m. 8. The employees whose name appears in the Attendance Register are eligible to cast their votes. In the event of staff who are on tour will be eligible to cast their votes at their respective near by KVIC Office/Centre/Units/Bhavans by producing their Identity Card and approved tour programme. 9. Similarly, the employees who remains absent/on leave including on LTC/Medical on that particular day will also be eligible to cast their votes at their headquarter or near by KVIC Office/Centre/Units/ Bhavans as the case may be by showing proper identity and leave sanction memo.

The Chief Presiding Officer at Central Office/Field Offices will allow such employees mentioned at Sr.No.8 and 9 above to cast his/her vote by adding names, designation, and place of headquarter at the last number of the list of the employee. 11. No State /Divisional Directors /Incharges /Managers/ Project Managers will be on tour on the day of election. 12. Ballot papers duly numbered will be printed at Central Office level and distributed to all field office in time in a sealed cover. Draft format of Ballot Paper is attached separately. 13. Ballot Papers should not be issued in a series. 14. The Secret Ballot Box will be sealed and signed in presence of the duly authorized representative of both the unions at the beginning and end of the poll and opened by the Chief Presiding Officer in the presence of representatives of both the unions only one representative of both the unions who are duly authorized in writing by the General Secretary/Secretary of the Central/State Units of the Unions will only be allowed to participate in the process. 15. Secret Ballot will be opened and counted in respective offices on the day of election by the Chief Presiding Officer in presence of authorized representatives of the Unions. The result sheets will be sent on the same day to Chief Controller in Central Office by E-mail/Fax duly signed by the Chief Presiding Officer as well as authorized representative of the Unions. 16. In the event of non-signature on result sheet by authorized representative of the Unions due to any dispute arises, the result of particular centre will be declared only after the dispute is sorted out by the Chief Controller. 17. The final result will be declared by the Chief Controller in Central office on the same day (i.e. on the day of poll). 18. The entire election process will be under surveillance through Video-conferencing from Central Office by the Chief Controller under observance of representative from Regional Labour Commissioner, Sion, Mumbai.
:3: 19. Model Code of conduct will be enforced from the date of issue of notification of election. 20. Canvassing in any form will be strictly prohibited before 48 hrs. from the date of election. 21. All expenses pertaining to election process will be borne by KVIC and met out from the Contingency Head available with respective offices. In case of Central Office, the same will be met out of Central Contingency available with the Directorate of E&S. 22. Tentative and final list of bonafide voters as on 30th September, 2013 will be posted on website of KVIC 23. The election will be conducted once in every three years in order to accord recognition to the Union in KVIC. Dy. Director I/C (Adm.)
