Planning and Zoning Commission Meeting Minutes April 8, 2013 C. PUBLIC HEARING C.1 Consider request from Tesla Motors for a Specific Use Permit allowing general vehicle repair at 13725 Welch Road and take appropriate action. Chairman Patterson opened the public hearing and read the following information into the record. Tesla Motors, a national electric vehicle company, recently purchased the existing building located at 13725 Welch Road to serve as their regional vehicle maintenance center. However, Tesla is now proposing to use the site for more comprehensive vehicle repairs, ranging from minor software and electrical repairs to wheel alignment. Last year the City approved Ordinance No. 3206 requiring all future general vehicle repair businesses located in a Light Industrial (LI) zoning district to obtain a Specific Use Permit before operation. No outdoor storage or display is proposed by Tesla with this SUP application. Tesla has agreed to make landscape improvements along their Welch road frontage. City Staff recommends approval of the Specific Use Permit allowing general vehicle repair at 13725 Welch Road as described on the proposed site plan. Mr. Gillies, Planning Director, gave a brief presentation regarding the request. He stated that all vehicles would remain indoors and no outdoor display would occur. He also stated that all vehicles were electric and no gas products would be located on site allowing for a much cleaner type of vehicle repair. Mr. Gillies stated that the existing building was 8,500 square feet in area, the service area would occupy the main portion of the building with 4 bays and a small portion of the building dedicated to storage of auto parts. Mr. Gillies stated that the landscape plan provides for 3 additional trees to be planed as well as new ground cover and expansion of existing planter beds. Chairman Patterson asked if the applicant was present. The applicant stated that they were available to answer questions. With no comments from the audience, Chairman Patterson closed the public hearing. Commissioner O'Quinn stated that this business would be an asset to Farmers Branch and he was in support of the cleanliness of the operations. Commissioner Beck asked the number of employees and number of customers they would have on site daily. Mr. Jack Benson, Service Manager with Tesla Motors stated that they will have 4 employees at this location and they would have few clients coming in at different times throughout the day. Mr. Gillies stated that the applicant is required to provide 6 spaces for employees and 6 additional spaces for customers. A motion was made by Commissioner O'Quinn, seconded by Commissioner Beck, that this Specific Use Permit be recommended for approval. The applicant is requesting a Specific Use Permit to construct a detached accessory building approximately 224 square feet, located in the rear yard on the southeastern portion of the lot. Article15 of the Comprehensive Zoning Ordinance dictates that a residential property is allowed to have an accessory building if it is less than 120 square feet in floor area by right. Accessory buildings that are larger than 120 square feet, requires a Specific Use Permit. RECOMMENDATION: City staff recommends approval of the Specific Use Permit allowing an accessory building structure located 3646 Janlyn Lane as depicted on the proposed site plan. STAFF REPORT Case Number: Request: Address: Lot Size: Petitioner: 13-SU-03 Specific Use Permit 3646 Janlyn Lane 0.22 acres Linda and Horst Bertl Existing Conditions: The subject property is a 10,023 square foot residential lot located on Janyln Lane, approximately 500 feet from Marsh Lane to the east. To the west and north are other comparable residential lots and existing homes. To the south is the parking lot for Ridgeview Presbyterian Church. There is an existing two story, single family residential home comprised of 3,582 square feet built in 1965. The residence is constructed of brick and frame. There is an existing metal storage shed located on the southwestern portion of the lot which is approximately 86 square feet. The applicant is requesting a Specific Use Permit to construct a detached accessory building approximately 224 square feet, located in the rear yard on the southeastern portion of the lot. Article15 of the Comprehensive Zoning Ordinance dictates that a residential property is allowed to have an accessory building if it is less than 120 square feet in floor area by right. An accessory building that is larger than 120 square feet requires a Specific Use Permit. Site Design: The proposed accessory building is located within the fenced backyard and is anticipated to be used as an outdoor seating area. The pergola-type structure will have an enclosed roof and will be built on a concrete slab. The proposed building will be open on all four sides. The building will be 224 square feet, 16 feet wide and 14 feet long. The structure is proposed to be 12 feet in height with a composition shingle roof and cedar wood columns. There will be no water or sewer connections. However electricity will be installed for lighting. Section 15-104 of the Comprehensive Zoning Ordinance (CZO) defines an accessory building as a separate building or structure from the main building, used for purposes incidental to the main use of the premises. The applicant s intended use of the building is consistent with the CZO. The accessory building will be setback 3 feet from the side yard and eastern property boundary which is consistent with the requirements of the CZO (See Site Plan). Section 15-104 (3) of the Comprehensive Zoning Ordinance states, The eave of a detached accessory building may project no greater than eighteen inches (18 ) into the required side setback. The applicant shall adhere to this requirement.

Comprehensive Plan: The 1989 Farmers Branch Comprehensive Plan recommends Single-Family Detached Residential uses for this area. This request is compatible with the Comprehensive Plan. 2012 Central Area Plan designates this area as Low Density Residential. The vision for this district is traditional single family detached neighborhoods. The SUP request is consistent with the future land use for this area. Thoroughfare Plan: Janyln Lane is a two-lane local residential city street. No expansion or improvements are planned or budgeted for either of these roadways by the city at this time. Public Response: Twenty-One (21) notification letters were mailed to the surrounding property owners on April 11 th, 2013. One zoning notification sign was placed on the site that same day. As of April 18 th, no written opposition to this SUP request has been received by the city.
