OBITER DICTUM 3 The Pennsylvania Supreme Court has adopted a change to its Rules of Professional Conduct governing attorneys to address questions of whether it is ethically permissible to provide legal advice and assistance to clients engaged in the medical marijuana industry. The change adds a new paragraph (e) to Rule of Professional Conduct 1.2 specifically permitting a lawyer to counsel or assist a client regarding conduct expressly permitted by Pennsylvania law. At the same time, however, the rule also states that the lawyer has an obligation to counsel the client about the legal consequences of the client s proposed course of conduct under other applicable laws. The rule change arose out of numerous inquiries received by the Pennsylvania Bar Association s Legal Ethics and Professional Responsibility Committee and the Philadelphia Bar Association s Professional Guidance Committee. With the changing marijuana laws in the United States precipitating a growing need for legal assistance in this area, Pennsylvania lawyers were asking whether it was ethically permissible to provide legal advice and assistance to clients engaged in the marijuana industry. To date, more than 20 states, including Ohio, New York, New Jersey, Maryland and Delaware, and the District of Columbia have enacted laws relating to medical marijuana. Pennsylvania enacted the Medical Marijuana Act on April 17, 2016. Notwithstanding the trend of many states toward some form of legalization of marijuana, marijuana remains illegal under federal law. The Controlled Substances Act provides that marijuana is a Schedule 1 drug, thereby making it unlawful to manufacture, distribute, dispense, or possess a controlled substance. The conflict between federal and state laws created an ethical dilemma for Pennsylvania lawyers because Pennsylvania RPC 1.2(d) states that A lawyer shall not counsel a client to engage, or assist a client, in conduct that the lawyer knows is criminal or fraudulent... Under the former rule, arguably, a Pennsylvania lawyer was prohibited from assisting a client in various activities such as drafting or negotiating contracts that may have related, directly or indirectly, to the purchase, distribution or sale of medical marijuana, even though such activities are now legal under state law. The new rule will permit counsel to provide legal services to clients without being subject to discipline under court rules. From the ABA Journal Daily Newsletter : [1] Pennsylvania s new medical marijuana law puts attorneys in a difficult ethical position in terms of counseling clients, prompting requests for the state s high court to change the appropriate Rules of Professional Conduct. The impetus for the proposed rules change stems from inquiries that were received by the Pennsylvania Bar Association Ethics and Professional Responsibility Committee, along with the Philadelphia Bar Association Guidance Committee. Gov. Tom Wolf signed the law to legalize marijuana for medical use in April. The proposed amendments will provide guidance to Pennsylvania lawyers and remove uncertainty surrounding lawyers duties in representing clients having some business relationship with the marijuana industry, said Amy Coco, chair of the committee. Even though some states and, most recently, Pennsylvania, have adopted laws relative to marijuana, the manufacture, distribution, dispensation and possession of marijuana is still criminal under federal law. Sign No. 1 from the list is duping delight catching a smile or excited fidgeting from someone who believes he or she is getting away with a lie and is getting a rush of pleasure from it. Sign No. 4 is when someone is telling you a (perhaps well-rehearsed) story in strict chronological order. A fun trick? Hendriksen says, if you think you re hearing a tall tale, ask to hear the story backwards: So when you just happened to see the car in the ditch what happened before that again? and watch the liar squirm ; [3] Self-driving cars, equipped with artificial intelligence, can perhaps make ethical decisions in the face of an accident, but the outcome could be strongly influenced by [the] opinions of engineers who wrote the software, Wired reports. Even if a machine makes the exact same decision as a human being, I think we ll see a legal challenge, says Patrick Lin, director of California Polytechnic State University, San Luis Obispo s Ethics + Emerging Sciences Group. Companies that make self-driving cars, including Google, are taking a significant risk, Lin says. They re replacing the human and all the human mistakes a human driver can make and they re absorbing this huge range of responsibility. Also, Lin asks: Who would buy a car that opts to kill you in the event of an accident, even if it s the most ethical decision? No one wants a car that looks after the greater good, he says. They want a car that looks after them. The U.S. National Highway Traffic Safety Administration is expected to release regulation for self-driving cars in July, the Detroit Free Press reports. Mark Rosekind, the agency s administrator, said that self-driving car technology doesn t have to be perfect to be acceptable, and the regulation can t be so rigid that it does not keep up with evolving technology. The article notes that in Nevada and Michigan, lawmakers are considering whether vehicles that navigate and assess safety without human input could change standards regarding who can have drivers licenses. We need new safety metrics. We also are going to have to broaden our view on the data sources for what those metrics might be. We have laboratory work. We have simulations and real-world data, said Rosekind...
