FESTUS CITY COUNCIL MEETING MINUTES March 9, 2016 7:00 p.m. The City Council of the City of Festus, Missouri met in regular session on March 9, 2016 at 7:00 p.m. The following council members were present for roll call: Montgomery, Dennis, Underwood, Wehner, Tinnin, Schaffer, Venz, and Cook; Absent none. Also present City Administrator Happy Welch, Police Chief Tim Lewis, Fire Chief Chuck Boyer, Head Librarian Kathy Condon-Boettcher, Building Official Matt Clemens, City Treasurer Lori Eisenbeis, Finance Director Pat Parsons, and Park Supt. Larry Crites and City Attorney Melissa Vighi. Council, staff, etc. then said the Pledge of Allegiance. Minutes Minutes of the February 24, 2016 council meeting were presented for approval. Councilman Cook made a motion to approve the minutes, seconded by Councilman Underwood. Motion carried unanimously. On a call by the chair, minutes of the council meeting were then approved. Warrants Mayor Cage reported warrants in the amount of $399,694.41. Councilman Cook made a motion to approve the warrants, seconded by Councilman Schaffer. On a call by the chair the votes were as follows: Ayes Underwood, Wehner, Dennis, Tinnin, Montgomery, Schaffer, Venz, and Cook; Nays None; Warrants were then approved. Visitors Penny Eggemeyer, 1113 Central, addressed the Council requesting that the City pay her plumbers bill of approx. $180.00. Ms. Eggemeyer stated that she called a plumber for a leaky toilet in her basement and when the plumber removed the toilet he noticed it was draining slowly and that she should have the City come check out the main. The City did go and check the main and jetted the main, then checked her yard vent and everything was running smoothly. Ms. Eggemeyer and the city crews stated there was no backup in the house, just a slow moving drain, which was taken care of by jetting the sewer main. Mayor Cage thanked Ms. Eggemeyer for her comment. Correspondence - None
Bids Animal Control Kennel Remodel Bids/Budget Amendment In June of 2015 a bid was requested to remodel the kennel, the remodel would consist of adding another exterior door and swapping the office and cat room locations. The original quote was $5025.00 after budget was approved for $5,500, the health department went out for bids in late January 2016, and those bids came in ranging from $6,995 to $12,558. Bids received were: Joe DeRousse Contracting $6,995; Steve Roubidoux Construction $7,100.00; and ICS Construction Services $12,558. Councilman Wehner made a motion to approve the bid from Joe DeRousse Contracting and to amend the budget, motion seconded by Councilman Montgomery. On a call by the chair, the bid was approved by the following votes: Ayes Underwood, Schaffer, Montgomery, Wehner, Dennis, Venz, Tinnin and Cook; Nays None. Public Works Salt Storage Structure Matt Clemens requested that all bids received on January 21, 2016 be rejected as they came in over budget Kimes Construction $79,500 and Kemper Home Creations $190,125. Councilman Underwood made a motion to reject all bids on the salt storage structure, seconded by Councilman Venz. Motion carried unanimously. Matt Clemens stated the project was re-bid for March 9, 2016 to construct a 60 x50 salt storage structure on the public works parking lot and that the city crews will saw cut and remove the asphalt. Matt Clemens then requested that Council approve the low bid from Kimes Construction in the amount of $69,500. The other bid was from R Precision Builders for $72,822. Councilman Venz made a motion to approve the bid from Kimes Construction in the amount of $69,500, seconded by Councilman Underwood. On a call by the chair, the bid was approved by the following votes: Ayes Underwood, Schaffer, Wehner, Montgomery, Venz, Dennis, Tinnin and Cook; Nays None. Library Removal of Cottonwood Tree Kathy Condon-Boettcher, Library Director, stated that the Library had received bids for the removal of a large cottonwood tree from the creek bank behind the Library. Bids were Midwest Tree Service $7,500 and DeClue and Sons $10,000. Kathy stated that only $5,000 was approved in the budget for this expenditure and she and the Library Board were recommending to reject all bids. After discussion it was determined that prices were only going to go up and that we should go with the low bidder.
Councilman Cook made a motion to accept the low bid from Midwest Tree Service in the amount of $7,500, seconded by Councilman Venz. On a call by the chair, the bid was approved by the following votes: Ayes Underwood, Schaffer, Wehner, Montgomery, Venz, Dennis, Tinnin and Cook; Nays - none. Library Sell Old Card Catalog Kathy Condon-Boettcher, Library Director, asked for permission to sell an old card catalog. Councilman Dennis made a motion to allow Kathy to sell the old card catalog, seconded by Councilman Dennis. On a call by the chair, the motion carried unanimously. Ordinances and Resolutions Bill No. 4276 An Ordinance of the City Council of the City of Festus, MO.; authorizing the Mayor to enter into and execute a Water Services Meter Agreement with Rayal Corporation, owner of Westowne Parc Mobile Home Community; incorporating said Agreement as a part of this Ordinance; and establishing an effective date. Councilman Venz made a motion to read Bill No. 4276 for the second time. Motion was seconded by Councilman Schaffer. Motion was approved. Bill No. 4276 was then read for the second time and approved by the following votes: Ayes Underwood, Wehner, Venz, Cook, Dennis, Schaffer, Tinnin and Montgomery; Nays none. Mayor Cage declared Bill No. 4276 passed. Bill No. 4277 An Ordinance of the City Council of the City of Festus, MO.; amending Section 210.237 of the Festus City Code to provide for the possession, consumption and sale of intoxicating liquors and beers on streets, alleys and other public ways of the downtown area of the City of Festus in accordance with the issuance of downtown civic festival permits; and establishing an effective date. Mayor Cage called for discussion. Happy Welch gave a staff report. Chief Lewis stated that his only recommendation for this Ordinance would be to state that alcohol cannot be brought in (no coolers) and must be purchased from the vendors at the event. Councilman Venz made a motion to read Bill No. 4277 for the second time. Motion was seconded by Councilman Wehner. Motion was approved. Bill No. 4277 was then read for the second time and approved by the following votes: Ayes Underwood, Wehner, Venz, Cook, Dennis, Schaffer, Tinnin and Montgomery; Nays none. Mayor Cage declared Bill No. 4277 passed. Councilman Schaffer left the room.
Bill No. 4278 An Ordinance of the City Council of the City of Festus, MO.; amending the Zoning Map of said City as established by the Planning and Zoning Ordinances of the City of Festus, MO.; and establishing an effective date. Rezones 1237 American Legion Drive, Dianna Kay Schaffer property, from R-2 to B-2. Pat Parsons read Bill No. 4278 for the second time. Mayor Cage called for discussion. Councilman Montgomery stated he had spoken with the son of Mrs. Hewitt and her son stated they were okay with the rezoning of the Schaffer property from R-2 to B-2. Councilman Montgomery made a motion to read Bill No. 4278 for the second time. Motion was seconded by Councilman Venz. Motion was approved. Bill No. 4278 was then read for the second time and approved by the following votes: Ayes Underwood, Wehner, Venz, Cook, Tinnin and Montgomery; Nays Dennis; Abstain - Schaffer. Mayor Cage declared Bill No. 4278 passed. Councilman Schaffer returned to the meeting. Bill No. 4280 An Ordinance of the City Council of the City of Festus, MO.; approving the Major Subdivision Gannon West Plat Three; as described in attached Exhibit A ; and establishing an effective date. Pat Parsons read Bill No. 4280 for the first time. Mayor Cage called for discussion. Matt Clemens gave a staff report and stated this had been approved by the Planning and Zoning Commission. Councilman Cook asked Matt Clemens if there were issues and Matt stated the property owner did not want to restrict his property but it was in his business best interest to keep it open. Councilman Venz made a motion to read Bill No. 4280 for the second time. Motion was seconded by Councilman Tinnin. Motion was approved. Bill No. 4280 was then read for the second time and approved by the following votes: Ayes Underwood, Wehner, Venz, Cook, Dennis, Schaffer, Tinnin and Montgomery; Nays None. Mayor Cage declared Bill No. 4280 passed. Bill No. 4281 An Ordinance of the City Council of the City of Festus, MO.; authorizing the Mayor to enter into and execute a Government Entity Tower License Agreement with Year Sites Tower Holdings LLC and CCATT, LLC; incorporating said contract as a part of this Ordinance; and establishing an effective date. Pat Parsons read Bill No. 4281 for the first time. Mayor Cage called for discussion. Happy Welch gave a staff reporting stating that this is for a receiving antenna on the AT&T tower on Horine Rd. to put up the dispatching equipment.
Councilman Underwood made a motion to read Bill No. 4281 for the second time. Motion was seconded by Councilman Cook. Motion was approved. Bill No. 4281 was then read for the second time and approved by the following votes: Ayes Underwood, Wehner, Venz, Cook, Dennis, Schaffer, Tinnin and Montgomery; Nays None. Mayor Cage declared Bill No. 4281 passed. New Business Next work session date was set for March 30, 2016. Old Business None. Reports City Administrator Happy Welch presented his report to the City Council which discussed the following topics: Multiple small focus group meetings coming up for Comprehensive Plan review. Have invited a Council member to each meeting except the general resident meeting. If Council wants to attend, please let me know so it can be posted if required. Meetings on March 16 th and 21 st Corps of Engineers meeting last night didn t include any major projections about flooding, but weather service said spring/summer rainfall should be less than normal this year FEMA is redrawing the flood plain maps in Jefferson County and we have an update meeting with them on March 30 th Surveyor could have everything completed at the Pounds and Hwy. A intersection before the end of the week and then the engineer will start work on the plans. This all depends on weather. MoDOT has provided ROW plans, CBB has owner deeds and subdivision information and they need to finish topo part before survey is done Electrician was finishing up with new LED lighting in police department To remove some of the clutter on Main St. light poles we are removing are the two hour parking signs and will be installing some new poles with two hour parking signs on them and installing some new directional signs that point to free parking on the back side of Main St. businesses. Also putting up new banners and shortening poles that hold banners. Also plan on working on a section of sidewalk to eliminate some trip hazards around Behring St. Councilman Venz Asked Chief Lewis to look into restricting parking on N. Mill Drive and Huber Street. Residents are parking on both sides and other vehicles can t get through.
Councilman Cook Asked about Ms. Eggemeyers claim. Happy stated that the City does not normally pay for private plumbing bills. Councilman Cook asked what is appropriate to bring up in Council discussions. Council discussed this matter. Councilman Cook also asked about Tim Myer s house and Matt Clemens stated that they had the remainder of six months to complete, but that no real work has been done. Councilman Underwood Stated that he is getting a lot of calls about the house on S. Fourth St. Matt Clemens answered that the Building Department had been there this week. Councilman Wehner Stated there had been discussions down at Main & Mill about handicap parking and a loading zone. Councilman Wehner asked the Council to think about this issue and that it be discussed at a work session. Councilman Dennis Renter on Sixth St. has an issue with the landlord, he is paying the landlord for his water bill but the landlord is not paying the City so then the water got shut off. Councilman Tinnin Asked about the trestle and Matt Clemens responded that it was going to be fixed. Park Supt. Larry Crites Asked for permission to sell some old vehicles and tractors. Councilman Venz made a motion to allow Larry Crites to sell some old city property, seconded by Councilman Schaffer. On a call by the chair, the motion carried unanimously. Finance Director Pat Parsons Stated that the January sales tax report was passed out and the numbers look good. CLOSED SESSION Councilman Schaffer made a motion to go into closed session pursuant to Missouri Law for the purpose of dealing with matters relating to RSMo. 610.021 (1) Legal Actions. Motion was seconded by Councilman Venz. Motion to go into closed session was approved by the following votes: Ayes Underwood, Schaffer, Wehner, Montgomery, Venz, Dennis, Cook and Tinnin; Nays None. ADJOURNMENT Councilman Cook made a motion to adjourn, seconded by Councilman Dennis. On a call by the chair the motion carried unanimously. Meeting then adjourned. Councilman Montgomery was not present when meeting adjourned.
