Pout Pout Pout Poutine Contest Official Rules NO PURCHASE NECESSARY 1. CONTEST AND CONTEST PERIOD The Pout Pout Pout Poutine Contest (hereinafter the Contest ) is held by Rôtisseries St-Hubert Ltée (hereinafter the Contest Organizer ). It takes place in participating St-Hubert and St-Hubert Express rotisseries from February 2, 2015 at 11:00 a.m. (EDT) to March 1, 2015 at 11:59 p.m. (EDT) (hereinafter the Contest Period ). 2. ELIGIBILITY This Contest is only open to people who meet the following criteria at the time of entry in the Contest: they must reside in Quebec, Ontario or New Brunswick and have reached the legal age in their province of residence. Excludes any employee, officer or director of any company or organization associated with this Contest, its representatives or assignees, advertising and/or marketing agents, members of their family (father, mother, siblings, children), legal or common-law spouse and all individuals with whom such employees, representatives and agents reside, whether or not they are related. 3. HOW TO ENTER To enter, follow these steps: Participating Rotisserie Segment: a) Ask for your Pout Pout Pout Poutine card. When purchasing one of the following poutine from the Pout Pout Pout Poutine promotion: St-Hubert poutine, Pulled pork poutine or Poutine with chicken, bacon and peas (hereinafter the Promotion Product ) in rotisseries at take-out or delivery; you will receive a sticker to be affixed at the back of the card. b) Once you have all three (3) stickers, fill out the back of the card clearly by entering your name and telephone number (hereinafter Entry Form ); c) Give the card to your server or drop it in the box provided for that purpose during the Contest Period. Copies or reproductions are not accepted; Entry Without Purchase. To enter the Contest without purchase: 1
a) Clearly write an original hand written letter of at least fifty (50) words explaining why you would like to win the Prize, along with your name, full address including the postal code, telephone number including the area code, and email address (hereinafter the No Purchase Entry Letter ). Sign and mail your letter in an envelope with sufficient postage; b) Send your letter to this address: Les Rôtisseries St-Hubert Ltée, Pout Pout Pout Poutine Contest No Purchase Entry 2500 Daniel-Johnson Blvd., Suite 700, Laval, Quebec, H7T 2P6. No Purchase Entry Letters shall be mailed before March 1, 2015. The postmark bearing proof thereof, otherwise invalid. Following the validation of your letter, you will be automatically entered in the Contest. Limit. There is a limit of one (1) entry per person per visit. 4. PRIZE 4.1 There are three (3) prizes to be won which consist of: three (3) 10.5 inch Samsung Galaxy S tablets of 16 GB with Wi-Fi titanium colour with a total approximate retail value of $1,425 (the Prize ), including: Each prize has a total approximate retail value of $475 (the Prize ). Limit. There is a limit of one (1) prize per person and per household for the Contest Period. 5. DRAW On March 27, 2015 at 11:00 a.m. (EDT) at the Contest Organizer s head office located at 2500 Daniel-Johnson Blvd., Suite 700, Laval, Quebec, H7T 2P6, a random selection will be conducted to select three (3) winners from all valid cards received during the Contest Period. Odds of Winning. Chances for an entry form to be selected depend on the number of eligible cards received during the Contest Period. 6. AWARDING OF THE PRIZES The Contest Organizer will contact the selected entrants by phone within seven (7) days of the draw date. In the event the Contest Organizer is unable to contact the selected entrants for any reason whatsoever, the Contest Organizer reserves the right, at its sole discretion, to conduct another draw in an attempt to award the prize. If no entrant is declared a winner within thirty (30) days of the original draw, the Contest Organizer reserves the right to withdraw the prize. Under no circumstances shall the Contest Organizer be required to award more prizes or to award prizes other than specified in these Rules. To be declared a winner (the Winner ), the selected entrant must, in addition to meeting the Contest eligibility criteria and complying with the Contest Rules: 2
i. Return the phone call made by the Contest Organizer s representative within three (3) business days following the call; ii. iii. iv. Sign a Liability Waiver and Release Form in regards to the Prize and consent to the use of certain personal information for promotional purposes. The Contest Organizer must receive this document within seven (7) days of its delivery; Correctly answer, without help (calculator or otherwise) a mathematical skill testing question posed in the Liability Waiver and Release Form; At the Contest Organizer s request, if applicable, provide photo identification. Claiming the Prize. The Winner will be informed of the conditions related to claiming the Prize by the Contest Organizer representative. Accepting the Prize. The Prize must be accepted as described herein and shall under no circumstances, be fully or partially transferred to another individual, substituted for another prize or exchanged for money, subject to what is provided herein. The Winner shall not be entitled to the difference, if any, between the approximate and actual prize value. Prize Substitution. At any time and for any reason whatsoever, the Contest Organizer reserves the right to substitute the Prize as described herein (or any component thereof) with a prize (or component of the Prize) of similar nature and of equal or greater value or, in its sole discretion, award the monetary value of the Prize (or component of the Prize) specified herein. 7. GENERAL TERMS AND CONDITIONS Verification. Entry forms, No Purchase Entry Letters and Liability waiver and release forms are subject to verification by the Contest Organizer. Any entry form, no purchase entry letter or liability waiver and release form that is, as the case may be, incomplete, illegible, mutilated, fraudulent, registered or submitted late, which has an invalid email address or phone number, or does not have the correct answer to the mathematical skill testing question or is otherwise non-compliant, may be rejected. Contest Procedure and Disqualification. The Contest Organizer reserves the right, at its sole discretion, to void an entrant s entry form or disqualify an entrant from this Contest and/or exclude him from any other future contest or promotion held by the Contest Organizer 1) if he fails to comply with each of the conditions specified herein; 2) if he enters or tries to enter this Contest using means contrary to these Rules or which is unfair to other entrants; or 3) if he is suspected of i) directly or indirectly tampering with the Contest operations, ii) makes a false statement in regards to his entry, or iii) violates these Rules. In such case, the Contest Organizer reserves the right, at its sole discretion, to conduct a new draw from all eligible entries received, under the same terms and conditions. 3
Any attempt to deliberately damage any component related to the entry or administration of this Contest or to undermine the legitimate operation of the Contest is a violation of criminal and civil laws. If such attempts occur, the Contest Organizer reserves the right to deliver the entrant or any other individual to competent legal authorities and seek redress under the law. Limitation of Liability. No obligation or liability rests with the Contest Organizer, any company, corporation, trust or other legal entity controlled by or related to it, participating establishment, their advertising and promotional agencies, and their directors, officers, employees, shareholders, agents or other representatives (collectively the Beneficiaries ) due to an entrant s entry or attempt to enter the Contest. The Beneficiaries are released from any obligation and liability in respect to any loss or damage caused by any problem or technical malfunction likely to disrupt the Contest or its operation thereof, arising from but not limited to, malfunctioning of any computer component, software or communication line, loss or absence of network communication or any faulty, incomplete or erased transmission or download by any computer or network. The Contest Organizer does not guarantee in any way that all components related to the entry and administration of the Contest, or any related website, will be accessible or functional without interruption during the Contest Period or that they will be free of errors. The use of any component related to the entry and administration of the Contest is at the user s own risk. The Beneficiaries cannot be held responsible for human, typographical, technical or computer errors, or printing or network errors that may arise in connection with the administration of the Contest, download, vote counting or processing entries, the announcement of the Prize or in any Contest-related material. The Beneficiaries cannot be held liable for any claim, action, damage, demand, means of action, cause of action, suit, debt, duty, account, security, agreement, warranty, compensation, contract or liability of any nature whatsoever arising from or related to the entry or attempt to enter the Contest. The Beneficiaries shall not be held liable for lost, incomplete, late or misdirected entry forms, No Purchase Entry Letters or Liability waiver and release forms. By accepting the Prize, winners release the Beneficiaries of any liability, claim, action, damage, demand, means of action, cause of action, suit, debt, duty, account, security, agreement, warranty, compensation, contract or liability of any nature whatsoever arising from or related to the acceptance and/or use of the Prize. Winners acknowledge that upon receiving the award, obligations related to it become the responsibility of the service and product suppliers related to the Prize, within the limits set by applicable law. Contest Modification. The Contest Organizer reserves the right, at its sole discretion, to withdraw, terminate, modify or suspend, in whole or in part, this Contest in the case where an event of any human intervention occurs which could alter or affect the administration, security, fairness or proper operation of the Contest as provided herein, subject to the approval of the Régie des alcools, des courses et des jeux du Québec, if required. End of the Contest Entry. In the event that the computer system is not able to register all Contest entries during the Contest Period, for any reason whatsoever, or if entry in the Contest should be terminated, in whole or in part, before the end date specified herein for any reason whatsoever, the draw shall be conducted, at the sole discretion of the Contest Organizer, from 4
all eligible entries received during the Contest Period or, as the case may be, until the date of the event has ended the entry in the Contest. Authorization. By entering this Contest, winners authorize the Contest Organizer and its representatives to use, if required, their name, photograph, likeness, voice, place of residence and/or statement regarding the Prize for advertising purposes and without any compensation or prior approval. Personal Information. Personal information collected about entrants as part of this Contest will only be used for this Contest s administration purposes. No communication, commercial or otherwise, unrelated to this Contest shall be sent to entrants, unless they have otherwise agreed to it, subject to applicable laws. Property. Entries received, No Purchase Entry Letters and Liability waiver and release forms are the property of the Contest Organizer and will, under no circumstances, be returned to entrants. Entrant Identification. For the purpose of these Rules, the entrant is the individual whose name appears on the entry form or No Purchase Entry Letter, as the case may be, and it is to this individual that the Prize will be awarded if this individual is selected and declared a winner. Contest Organizer Decision. Any decision made by the Contest Organizer or its representatives regarding this Contest is final and without appeal, subject to any decision from the Régie des alcools, des courses et des jeux du Québec, in regards to any matter within its jurisdiction. Compliance with Laws. The Contest is void in any jurisdiction where prohibited by law and is subject to all applicable laws and all Federal, Provincial, Territorial and Municipal Regulations in Canada. Dispute. For Quebec residents, any litigation with respect to the operation or organization of a promotional contest may be submitted to the Régie des alcools, des courses et des jeux du Québec for a ruling. Any dispute respecting the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement. Severability. If any section of these Rules is declared illegal, unenforceable or invalid by a competent court, that section shall be considered invalid, but all other sections which are not affected will be enforced to the extent permitted by law.
