Policy No. 6026 1.0 ANTI-DISCRIMINATION 1.1 The Board of Education calls upon all educators in the district to take upon themselves an individual and collective responsibility to teach their students both by example and instruction, the true meaning of brotherhood. Students in all schools in the district should be encouraged to accept the responsibility for learning and practicing the art of tolerance, empathy, and concern for others. Educators and students alike should develop a sensitivity to the feelings and attitudes of others in their use of language and that they work to gain an understanding and respect of the many cultures, races, religions and ideologies which make up the United States of America. Statement of Policy It is the policy of Alpine School District to maintain all learning and working environments free of discrimination. This policy provides procedures for requesting accommodations as appropriate under the law and complaint procedures for persons who believe themselves to have been the object of improper discrimination. The policy also provides procedures the District will follow in investigating and resolving complaints. B. Authority and Designation of District Officials 1 Federal statutes both mandate and provide authority to the District to prohibit discrimination on the basis of disability, gender, race, color, national origin, sex, religion, and age, or any other classification protected by law in its programs, activities or employment practices. District officials designated to administer and enforce nondiscrimination policies can be reached at (801) 610-8400. These individuals can also provide information and answer questions regarding the legal protections against discrimination. Some examples are identified below, but not limited to: 1. Discrimination on the basis of Disability: 1 The Individuals with Disabilities in Education Act (IDEA) is not considered an antidiscrimination law and is not addressed in this policy. IDEA is a spending clause statute that requires states and public agencies to provide a free and appropriate public education to all students and dictates how education agencies provide intervention, special education, and related services to children with disabilities. The Special Education Department administers the IDEA for the District and all inquiries about the IDEA or special education should be directed to the school principal and/or the Director of Special Education.

Auxiliary Aids: mean services or devices that enable persons with impaired sensory, manual, or speaking skills to have an equal opportunity to participate in, and enjoy the benefits of, programs or activities conducted by a governmental agency. 2. Board: means the Alpine School District Board of Education. 3. Complaint: means an allegation that an action, policy, procedure, or practice violates a law or regulation listed above. 4. Complainant: means the person filing a complaint. 5. Respondent: means the person alleged to have violated a law or regulation mentioned above. 6. Designated District Official: means the person responsible at the District level for receiving complaints involving the laws or regulations mentioned above. The titles of Designated District Officials are listed in subsection b. Above. 7. Superintendent: means the Superintendent of Alpine School District or the Superintendent s designee. 8. Complaint Answer: means the respondent s written statement concerning the alleged violation. 9. Hearing Officer: means the person assigned to conduct a hearing. Procedure No. 7100 Anti-Discrimination

1.0 Requesting Accommodations for School Functions or Events 1.1 Requests by individuals with a disability or other individuals entitled to receive an accommodation for access to school facilities, school programming, and school sponsored functions or events shall be made in writing to the school principal (if applicable) and/or to the Director of Human Resources at Alpine School District, 575 North 100 East, American Fork, Utah, 84003. 1.2 Many accommodations and auxiliary aids can be offered without prior planning when requested, and schools and other District facilities will make every effort to accommodate needs as they arise. However, because some requests for accommodations may require additional planning (and may include competing needs), students, parents, guardians, and patrons are encouraged to make written requests for accommodations, particularly auxiliary aids, in advance of the date of the scheduled function or event. Such requests shall include: 1.2.1 the individual s name, school or work site, and a description of the school or work functions for which the auxiliary aid is being requested; 1.2.2 an affirmation that the accommodation is required because of disability; and 1.2.3 a detailed description of the accommodation being requested. 1.3 School principals and District officials shall work collaboratively with students, parents, guardians, and patrons to determine what reasonable accommodations are available at no cost to the requester to achieve equal access to school events and functions. Primary consideration will be given to the accommodation choices of the individual making the request unless other equally effective means of accommodating an individual s need are available or if accommodation choices would fundamentally alter the District or school service, program, or activity or cause an undue financial or administrative burden. 1.4 Examples of accommodation requests include, but are not limited to: 1.4.1 Auxiliary aides for communication where available such as interpreters; readers and note takers, audio enhancement devices, computer aided communication devices, telecommunication devices (TDD s) or closed captioning, written materials, additional lighting, preferential seating, and audio recordings. 1.4.2 Physical accommodations such as manual assistance from staff, access to elevators and lifts, and reasonable access to handicapped parking, walkways, and ramps. 2 2 District facilities are compliant with Title II of the ADA with respect to all new construction and required retrofitting. The District has a retrofit calendar for all facilities. The District makes programs available to any student in alternate locations where facilities have not yet been retrofitted.

1.4.3 Use of service animals (see District Service Animal policy). 1.4.4 Alternate forms or enhanced access to transportation. 1.4.5 Modifications to existing practices or procedures. 2.0 Complaint Filing Procedures for Parents, Guardians, Patrons, and Citizens 2.1 Complaints by parents, guardians, and patrons regarding discrimination may be filed with the Designated District Official. The District will attempt to resolve issues working collaboratively with parents, guardians, and patrons at the lowest possible level. A complaint form is attached to this policy. Alternatively, if concerns cannot be resolved at the school or District level, complaints may be filed with the Office for Civil Rights, Region VIII, US Department of Education, Federal Building, Suite 310, 1244 Speer Boulevard, Denver, Colorado 80204. 3.0 Complaint Filing Procedures for Students or District Employees 3.1 Complaint Filing 3.1.1 Any employee or student who believes that he or she has been discriminated against may personally, or through a representative, file a complaint. The building principal is the person responsible for receiving complaints of discrimination at the school level. If the complaint involves the principal, or the complainant is otherwise unwilling to notify the principal, the complaint may be filed directly with the Designated District Official. If the complaint involves the Designated District Official, the complaint shall be filed directly with the Superintendent. 3.1.2 The person with whom the complaint is filed shall encourage the complainant to meet with the respondent to resolve the complaint. The person with whom the complaint is filed may mediate that meeting. If the complainant refuses a meeting, the person with whom the complaint is filed shall contact the Designated District Official who will process the complaint as set out in this policy. 3.2 Complaint Substance 3.2.1 Complaints filed with a Designated District Official shall be in writing and shall provide at least the following information: 3.2.1.1 name, home address, and home and work telephone numbers of complainant; 3.2.1.2 nature and date of the alleged violation; 3.2.1.3 names of persons responsible for the alleged violation (if known); and

3.2.1.4 relevant background information. 3.2.2 The complaint may also include a statement of requested relief or corrective action. The form attached to this policy may be used for this purpose. 3.3 Complaint Forms 3.3.1 Complaint forms shall be available online and in each District building. Complainants may request assistance in the preparation or filing of a complaint. 3.4 Time Limits 3.4.1 A complaint must be filed within 180 calendar days of the occurrence of the alleged discriminatory action. The Designated District Official, upon a finding that the circumstances of a complaint warrant an extension, may extend this time limitation or other time limitations of this policy. 4.0 Initial Complaint Processing 4.1 Notification of Respondent 4.1.1 The Designated District Official shall notify the respondent by personal delivery or registered mail within five (5) days of the filing of a complaint. The notice shall include a copy of this policy and advise the respondent of the responsibility to submit an answer to the complaint. 4.2 Respondent's Complaint Answer Within five days of receiving notice of a complaint, the respondent shall submit a written answer to the Designated District Official. The answer shall include: 4.2.1 affirmation or denial of each allegation in the complaint, 4.2.2 an indication as to the extent to which the complaint has merit, 4.2.3 an acceptance or rejection of relief or action requested in the complaint, if any, and 4.2.4 other relevant information. 4.3 Referral of Complaint to a Hearing Officer 4.3.1 Within five days of receiving respondent's complaint answer, the Designated District Official shall determine the level of hearing appropriate to the complaint and deliver the complaint to the appropriate hearing officer as determined in G(4) below. A hearing officer receiving a complaint shall be

knowledgeable about laws and policies relevant to the subject matter of the complaint. 4.4 Three Hearing Levels 5.0 Hearings 4.4.1 Level I: If the complaint involves a single school policy or practice, or if a respondent is assigned to a single school or department, the Designated District Official shall deliver the complaint to the District Compliance Officer or other appropriate person, as determined by the Designated District Official, who shall then be the hearing officer. 4.4.2 Level II: If the complaint involves a district-wide policy or practice, if there are multiple respondents in multiple schools or departments, or if the respondent is a school principal or department Director, the Designated District Official shall report the complaint to the Superintendent who shall then be the hearing officer. 4.4.3 Level III: If the complaint involves the Superintendent, the Designated District Official shall report the complaint to the Board. The Board shall designate hearing officers in accordance with this policy. 5.1 Level I 5.1.1 Within five days of receiving the complaint assignment, the hearing officer shall schedule an informal hearing and notify the complainant and respondent. The notice shall include a statement of procedures which will govern the conduct of the hearing. The hearing shall be held no sooner than 10 days nor more than 20 days after service of the notice of hearing. 5.1.2 Persons present at the informal hearing shall include the complainant, respondent, any individual requested by either party to provide assistance relevant to the consideration of the complaint, and the hearing officer. The hearing officer may request the assistance of the Designated District Official or others. 5.1.3 Within five days after the informal hearing, the hearing officer shall issue a written decision which includes statements regarding the validity of the complaint allegation, any necessary corrective action, and the reasons upon which the decision is based. Copies of the decision shall be delivered to the complainant, the respondent, and the Designated District Official. If no written hearing decision is received by the Designated District Official within five days of the hearing, the Designated District Official shall, in writing, request the decision. If the written hearing decision is not received within an additional five days, the Designated District Official shall refer the complaint for Level II hearing. 5.1.4 A complainant or respondent may appeal a decision of the hearing officer

5.2 Level II by submitting a written request for a Level II hearing to the Designated District Official within ten days of receipt of the written hearing decision. 5.2.1 The Superintendent shall schedule a Level II hearing within five days of receiving a request from the Designated District Official. The complainant and respondent shall be notified in writing of the date, time, and location of the hearing, copies of materials or records which are provided to the Superintendent which are pertinent to the hearing, and a statement of procedures to be followed at the hearing. The hearing shall be held no sooner than 10 days nor later than 20 days after service of the hearing notice. 5.2.2 Persons present at the Level II hearing shall include the complainant, the respondent, any individual requested by either party to provide assistance relevant to the consideration of the complaint, and the Superintendent. The Superintendent may request the assistance of the Designated District Official or others. 5.2.3 The duration of the hearing shall be allocated in equal parts to the complainant and respondent. Parties shall not be charged with time spent responding to questions posed by the superintendent. Time will be moderated. 5.2.4 Both the complainant and the respondent shall have the right to present witnesses as they deem necessary to develop facts pertinent to the complaint. Formal rules of evidence shall not apply to Level II hearings. 5.2.5 Within five days after the Level II hearing, the Superintendent shall issue a Level II written hearing decision which includes statements regarding the validity of the complaint allegation, any necessary corrective action, and the reasons upon which the decision is based. Copies of the decision shall be delivered to the complainant, the respondent, and the Designated District Official. If no Level II written hearing decision is received by the Designated District Official within five days of the hearing, the Designated District Official shall, in writing, request the decision. If the written hearing decision is not received within an additional five days, the Designated District Official shall refer the complaint for Level III hearing. 5.2.6 A complainant or respondent may appeal a decision of the hearing officer by submitting a written request for a Level III hearing to the Designated District Official within ten days of receipt of the written hearing decision. 5.3 Level III 5.3.1 If a Level III hearing is necessary, the Board shall select among four alternatives:

6.0 General Provisions 5.3.1.1 the hearing may be conducted by the entire Board; 5.3.1.2 the hearing may be conducted by at least three members of the Board, 5.3.1.3 the Board may delegate hearing authority to an ad hoc hearing panel, or 5.3.1.4 the Board may delegate hearing authority to an individual hearing officer. 5.3.2 The Board shall send written notification of the alternative which it intends to utilize for the hearing to the Designated District Official, the complainant, and the respondent within thirty days of receipt of the complaint. The Designated District Official shall schedule the hearing within five days of receipt of the Board's notification. The complainant and respondent shall be notified in writing of the date, time, and location of the hearing, copies of materials or records which are provided to the Board which are pertinent to the hearing, and a statement of procedures to be followed at the hearing. The hearing shall be held no sooner than 10 days nor later than 20 days after service of the hearing notice. 5.3.3 Persons present at the Level III hearing shall include the complainant, the respondent, any individual requested by either party to provide assistance relevant to the consideration of the complaint, and the Level III hearing body. The Level III hearing body may request the assistance of the Designated District Official or others. The Level III hearing body shall designate a member of their body to moderate the hearing to ensure compliance with procedures which shall be determined by the body itself. 5.3.4 The Level III hearing body shall issue a Level III written hearing decision which includes statements regarding the validity of the complaint allegation, any necessary corrective action, and the reasons upon which the decision is based. The findings and recommendations of the hearing body shall be determined by majority vote and shall specify the reasons on which the decision was based. Any hearing body member in disagreement with the majority may prepare a dissenting opinion to be included with the hearing decision. 5.3.5 The Level III hearing decision and related materials shall be submitted to the Board. If the Board accepts the Level III hearing decision, it shall so state and issue a final board decision. Copies of the decision shall be delivered to the complainant, the respondent, and the Designated District Official. If the Board rejects the findings and recommendations of the Level III hearing body, it shall issue a detailed decision stating its reasons for such a rejection and at its discretion may issue a final decision or repeat the Level III hearing process beginning with selection among the four alternatives.

6.1 Complainant and Respondent Right to Records 6.1.1 A complainant or respondent may request access to information and records in the possession of the District which bear upon the validity of the grievance. Records must be requested with reasonable specificity. 6.1.2 If obtaining the information requires unreasonable interference with other District duties and responsibilities or unreasonable District expenditure, the District may require that the requesting party pay the District reasonable fees for actual costs incurred in procuring and duplicating the records. 6.1.3 The District is not required to create a record in response to a request. 6.1.4 Information in requested records about subjects or persons not relevant to the complaint or which is otherwise private, controlled, or protected shall be expunged from the record. 6.2 Right to Assistance 6.2.1 Both the complainant and the respondent have the right to be assisted by knowledgeable persons, organizations, or groups of their selection at their own expense, at any point during the initiation, filing, or hearing of the complaint. 6.3 Confidentiality 6.3.1 The District will strive to respect the confidentiality of the complainant and respondent, consistent with the District's legal obligations and the necessity to take appropriate corrective action. 6.4 Prohibition of Retaliation 6.4.1 Good faith submission of complaints will not adversely affect the complainant's future employment, grades, or work assignments. However, malicious or frivolous complaints may subject a complainant to discipline. The District will discipline any individual who retaliates against any person who files a complaint or who testifies, assists, or participates in a proceeding or hearing relating to a complaint. Retaliation includes, but is not limited to, any form of intimidation, reprisal, or harassment. 6.5 Complaint Records 6.5.1 Complaint records shall be kept by the designated District official for a period no less than three years. Records shall include the names and positions of complainants and respondents, dates of filing and resolution, specific allegations and answers, levels of hearings and hearing officers,

a statement of final resolution, and details of corrective action. Such records shall be protected under Utah Code 63-2-304. Any complainant or respondent may, at personal expense, make a voice recording of any hearing. Level II and Level III hearings shall be recorded by the District. Such recordings shall be made available to complainants and respondents at their request. District recordings shall be a part of the complaint record. 6.6 Notice 6.6.1 Subsection B. of this policy identifying the civil rights protected by this policy shall be delivered to each patron of the District annually. It shall also be posted in the front office of each District building and in the Department of Human Resources.
