J HOUSE BILL lr By: Delegate Hubbard Rules suspended Introduced and read first time: March, 0 Assigned to: Rules and Executive Nominations A BILL ENTITLED 0 AN ACT concerning Food Service Facilities Artificial Trans Fats Prohibition FOR the purpose of providing for the types of foods that contain artificial trans fat; prohibiting a food service facility from using food containing artificial trans fat for certain purposes; providing for a certain exception to the use of trans fat by a food service facility; requiring a food service facility to maintain on site the original label for certain food under certain circumstances; authorizing a food service facility to provide certain documentation indicating the contents of a food instead of providing the original label; requiring a food service facility to obtain certain documentation under certain circumstances; requiring the Secretary of Health and Mental Hygiene to adopt certain regulations; requiring the Department of Health and Mental Hygiene to list certain food service facilities on the Department s Web site under certain circumstances; providing that a violation of this Act shall have no effect on the issuance of a certain license; providing for the applicability of this Act to certain penalties; providing that certain provisions of this Act do not preempt certain local entities from enacting certain measures; and generally relating to the prohibition on the use of artificial trans fat in a food service facility. HOUSE BILL BY adding to Section through to be under the new part Part VIII. Artificial Trans Fat Annotated Code of Maryland (00 Replacement Volume and 0 Supplement) SECTION. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, That the Laws of Maryland read as follows: 0. (e) Excluded organization means: () A bona fide nonprofit fraternal, civic, war veterans, religious, or charitable organization or corporation that does not serve food to the public more often than days per week except that once a year an organization may serve food to the public for up to consecutive days; and () A volunteer fire company that does not serve food to the public more often than days per week except that once a year a volunteer fire company may serve food to the public for up to 0 consecutive days. 0 (f) Food establishment means: () A food service facility; or () A food processing plant. 0 (h) () Food service facility means: (i) A place where food or drink is prepared for sale or service on the premises or elsewhere; or (ii) Any operation where food is served to or provided for the public, with or without charge. () Food service facility does not include: (i) A kitchen in a private home where food is prepared at no charge for guests in the home, for guests at a social gathering, or for service to unemployed, homeless, or other disadvantaged populations;

HOUSE BILL (ii) A food preparation or serving area where only nonpotentially hazardous food, as defined by the United States Food and Drug Administration, is prepared or served only by an excluded organization; or (iii) A location in a farmer s market where raw agricultural products, as defined in 0(d)()(iii) of this subtitle, are sold. 0. (a) () The Department shall adopt rules and regulations necessary to carry out the provisions of this subtitle.. THIS SECTION DOES NOT APPLY TO PART VIII OF THIS SUBTITLE. 0 (B) If the Department finds that a food establishment is in violation of this subtitle or any rule or regulation adopted under this subtitle, is in an unsanitary condition, or is not equipped properly, the Secretary shall notify the licensee: () Of the specific findings; () Of a specific, reasonable date by which the licensee shall correct the violations or deficiencies specified in the notice; and () That, if the licensee fails to correct the conditions by the date specified, the Department may suspend or revoke the license issued under this subtitle.. THIS SECTION DOES NOT APPLY TO PART VIII OF THIS SUBTITLE. (B) The Department may suspend or revoke a license issued under this subtitle if the licensee: () Violates or fails to meet the requirements of this subtitle or any regulation adopted under this subtitle; or () Fraudulently or deceptively obtains a license.. THIS SECTION DOES NOT APPLY TO PART VIII OF THIS SUBTITLE. 0 [(a)] (B) If the Department believes that a person is violating any provision of this subtitle or [of] any regulation adopted under this subtitle, the Department may

HOUSE BILL have the person served with a written order that directs the person served to abate the violation within a time specified in the order. [(b)] (C) Except as otherwise provided in Title, Subtitle of the State Government Article, the Department shall give any person served with an order under this section an opportunity for a hearing before the Department. [(c)] (D) After a hearing under this section, the Department may affirm, modify, or withdraw the order. [(d)] (E) violate that order. A person who is served with an order under this section may not. EXCEPT AS PROVIDED IN SUBSECTION (B) OF THIS SECTION, A FOOD CONTAINS ARTIFICIAL TRANS FAT IF THE FOOD: () IS LABELED AS CONTAINING PARTIALLY HYDROGENATED: (I) (II) VEGETABLE SHORTENING; MARGARINE; OR 0 (III) VEGETABLE OIL; () LISTS AS AN INGREDIENT PARTIALLY HYDROGENATED: (I) (II) VEGETABLE SHORTENING; MARGARINE; OR (III) VEGETABLE OIL; OR () CONTAINS PARTIALLY HYDROGENATED: (I) (II) VEGETABLE SHORTENING; MARGARINE; OR

HOUSE BILL 0 0 (III) VEGETABLE OIL. (B) A FOOD WITH A NUTRITION FACTS LABEL OR OTHER DOCUMENTATION FROM THE MANUFACTURER THAT LISTS THE TRANS FAT CONTENT OF THE FOOD AS LESS THAN 0. GRAMS PER SERVING MAY NOT BE CONSIDERED AS CONTAINING ARTIFICIAL TRANS FAT.. EXCEPT AS PROVIDED IN SUBSECTION (B) OF THIS SECTION, FOOD CONTAINING ARTIFICIAL TRANS FAT MAY NOT BE STORED, DISTRIBUTED, HELD FOR SERVICE, USED IN PREPARATION OF ANY MENU ITEM, OR SERVED IN ANY FOOD SERVICE FACILITY. (B) () SUBJECT TO PARAGRAPH () OF THIS SUBSECTION, THIS SECTION DOES NOT APPLY TO FOOD THAT IS SERVED DIRECTLY TO PATRONS IN THE ORIGINAL SEALED PACKAGE OF THE MANUFACTURER. () BEGINNING ON OCTOBER, 0, THIS SECTION SHALL APPLY TO FOOD THAT IS SERVED DIRECTLY TO PATRONS IN THE ORIGINAL SEALED PACKAGE OF THE MANUFACTURER.. EXCEPT AS PROVIDED IN SUBSECTION (B) OF THIS SECTION, A FOOD SERVICE FACILITY SHALL MAINTAIN ON SITE THE ORIGINAL LABEL FOR FOOD: () THAT CONTAINS FATS, OILS, OR SHORTENINGS; () THAT IS REQUIRED BY FEDERAL OR STATE LAW TO HAVE A LABEL WHEN PURCHASED BY A FOOD SERVICE FACILITY; AND () THAT IS STORED, DISTRIBUTED, HELD FOR SERVICE, USED IN PREPARATION OF ANY MENU ITEMS, OR SERVED BY THE FOOD SERVICE FACILITY. (B) A FOOD SERVICE FACILITY MAY PROVIDE DOCUMENTATION ACCEPTABLE TO THE DEPARTMENT FROM THE MANUFACTURER OF A FOOD, INDICATING TRANS FAT CONTENT OR WHETHER THE FOOD CONTAINS PARTIALLY HYDROGENATED: () VEGETABLE SHORTENING;

(C) () IF A FOOD THAT IS RESTRICTED UNDER OF THIS PART CONTAINS FATS, OILS, OR SHORTENINGS AND THE FOOD IS NOT REQUIRED TO BE LABELED WHEN PURCHASED, A FOOD SERVICE FACILITY SHALL OBTAIN AND MAINTAIN DOCUMENTATION FROM THE MANUFACTURER OF THE FOOD INDICATING WHETHER THE FOOD CONTAINS PARTIALLY HYDROGENATED VEGETABLE SHORTENING, PARTIALLY HYDROGENATED MARGARINE, OR ANY KIND OF PARTIALLY HYDROGENATED VEGETABLE OIL, OR INDICATING TRANS FAT CONTENT. () THE SECRETARY SHALL ADOPT REGULATIONS THAT PROVIDE FOR THE DOCUMENTATION TO BE OBTAINED BY A FOOD SERVICE FACILITY FROM THE MANUFACTURER UNDER PARAGRAPH () OF THIS SUBSECTION.. () THE DEPARTMENT SHALL LIST ON THE DEPARTMENT S WEB SITE A FOOD SERVICE FACILITY THAT IS IN VIOLATION OF THIS PART. () A FOOD SERVICE FACILITY LISTED ON THE DEPARTMENT S WEB SITE UNDER PARAGRAPH () OF THIS SUBSECTION SHALL REMAIN LISTED ON THE WEB SITE UNTIL THE DEPARTMENT FINDS THAT THE FOOD SERVICE FACILITY IS IN COMPLIANCE WITH THIS PART. (B) A VIOLATION OF THIS PART SHALL HAVE NO EFFECT ON THE LICENSE ISSUED BY THE DEPARTMENT TO THE FOOD SERVICE FACILITY UNDER 0 OF THIS SUBTITLE.. NOTHING IN THIS PART MAY BE CONSTRUED TO PREEMPT A COUNTY OR MUNICIPAL GOVERNMENT FROM ENACTING AND ENFORCING MORE STRINGENT MEASURES TO REGULATE THE USE OF ARTIFICIAL TRANS FAT BY FOOD SERVICE FACILITIES.. THIS SECTION DOES NOT APPLY TO A VIOLATION OF SUBTITLE, PART VIII OF THIS TITLE.

HOUSE BILL [(a)] (B) Any person who violates any provision of Subtitle of this title or any rule or regulation adopted under Subtitle of this title is guilty of a misdemeanor and on conviction is subject to: () For a first offense, a fine not exceeding $,000 or imprisonment not exceeding 0 days, or both; and () For a second offense, a fine not exceeding $,00 or imprisonment not exceeding year, or both. [(b)] (C) In addition to any criminal penalties imposed under this section, a person who violates any provision of Subtitle of this title or any rule or regulation adopted under Subtitle of this title or any term, condition, or limitation of any license or registration issued under Subtitle of this title: () Is liable for a civil penalty not exceeding $,000, to be collected in a civil action in the District Court for any county; and () May be enjoined from continuing the violation. [(c)] (D) this section. Each day on which a violation occurs is a separate violation under SECTION. AND BE IT FURTHER ENACTED, That this Act shall take effect October, 0.
