Visit http://malaysianneedvisa.com John asks Born UK in 1990.Only have Uk birth cert.all other ID is Malaysian.Am I entitled to any edu or residency in UK? OK These are two very different questions. The citizenship one depends on the status of your parents when you were born. See here This is an extract about the immigration act of 1981 Other criticisms were levied at the time at the removal of the automatic right to citizenship by birth in the United Kingdom. However, due to the fact that UK-born children of permanent residents are automatically British, the number of non-british children born in the United Kingdom is relatively small. Special provisions made in the Act for those who do not have another nationality, and for those who live a long time in the United Kingdom, have meant there is little pressure for any change to the current law. 1 / 7
This is a link to info on it http://www.answers.com/topic/british-nationality-act-1981 What it seems to say is that ONLY if your parents were permanent residents in the UK at the time of your birth are you entitled to UK citizenship automatically. ============================================ In terms of education in the EU this is mostly done on residency and not on nationality. In the most part this means that you have to be Normally Resident in the EU for the three years previous to your date of application. This does not include a student visa. Here is what Oxford University has to say. (This is a bit tricky to read but it says everything you might need to know) http://www.admin.ox.ac.uk/postgraduate/finance/clas.shtml Good Luck! Steven asks British and a medical student, priority date for USA residency is current.. what about my other half? I m a british medical student and will be graduating in 2 years. My family has been sponsored by dad s sister for USA residency for 10 years now and the priority date is about to become current. Hopefully I will be able to get a green card in the next few months. When I graduate, I want to move to the states to practise medicine. 2 / 7
My other half is malaysian but he is also studying medicine here in the UK and will be graduating in 2 years with a british degree. How hard would it be for him to come to the states with me to practise medicine. Would we need to get married first? Would I need to sponsor him for 5 years? Would he need to get his own visa through finding a job? Are the prospects quite slim? Thank you for reading in advance The first answer is wrong. You will not be able to file for a fiance/k1 visa for him as a green card holder, only US citizens can do that. The first thing I would try to find out is if you are even still eligible to be a derivative of your aunt s petition. If you are already over 21, there is a chance that you might have already aged out which will render you ineligible for an immigrant visa/green card. You can look up the Child Status Protection act and do the calculation to see if you have or have not aged out. If you are indeed still eligible to get the green card, you will be able to sponsor him once you get married so yes, you would need to get married first and then file the petition. Mandy asks Malaysian married to UK citizen, immigration HELP!!? i am a malaysia national and i am in a civil partnership with a british citizen, we are currently 3 / 7
staying in malaysia whilst i finish my degree, we will be here for 1-5 years but then plan to move back to the UK (i was there for 3 years as a student) we are reading about the immigration process and the new requirement to earn 18,600! we dont earn that and when we move to the UK we will both be jobless to begin with, until we can find jobs there, we wont be accessing public funds. what visa can i apply for? we are really worried we cant live there together, will we be able to? what can we do? any help is greatly appreciated In order to sponsor you, your British partner must be earning the minimum amount of 18,600. If he is returning to the UK he must have a firm job offer which starts within three months of is arrival if you want to return with him. If this is not possible, then your only option is a work visa until such time as your British partner can sponsor you. However, as all occupations that qualify for work visas have salary levels of 20,000 minimum, you are in the same boat with regards to minimum salary. Apart from this, your partner will have to return alone, find employment and after at least three months of employment at or above the minimum salary, he can then sponsor you to join him. Nancy asks Will i pay international or home fees? okay, so i am living in Shanghai right now, and i will be doing my GCSEs at the end of this year 4 / 7
May 2010. If i finish my secondary education here in shanghai, (i will do an IB course for year 12 and 13.) will i have to pay internstional fees, even if i lived in the UK since i was born till i was about 11? even if my grandparents live there? ( do they even pay tax??) i need to know, cause if i need to pay international fees, i would want to convince my parents for me to move to england to do my A levels. ANDD if i lived there, would my parents being paying tax? thanks in advance i am british, i have ALWAYS had a british passport since i was born. my father is british, my my mother is chinese, but she is now a british citizen I m afraid you are getting some poor advice here. Your status as a home vs international fee payer has nothing to do with your citizenship. For example, my son is British and has to pay the international fee, his girlfriend is Japanese and does not. There are two things you have to do to be considered a home fee payer; you need to be both ordinarily resident in the UK for three years prior to your uni start date and you need to be of settled purpose in the UK some time before your course starts. Ordinarily resident means living in the UK for something other than just to study. So for example, if you were just there to do your A levels you would not be ordinarily resident, if your whole family moved over for three years you would be. They can and do check your family s tax status to see if they are filing as UK residents if you claim this status especially if your educational records or family background suggests something different. I have a Malaysian/British friend whose records were checked every way to Christmas even though the family had been settled in the UK for six years and her father is English. Of settled purpose means you have the right to be in the UK (no need for a student visa). This could be because you have a British/EU passport or could be because you are a refugee or have ILR. 5 / 7
Linda asks Can i Apply for Permanent Residence or British Citizenship? Hi I am a Malaysian who had just finished my degree in Mechanical Engineering in the UK. I came over to the UK last September (Sept 2009) to do the final year in the university. Because my Study Visa lasted only for a year (expired on Sept 2010), i applied for Post-Study Work Visa. The PSW Visa last for 2 years. I am currently applying for job over here in the UK. How can i apply for Permanent Residence or British Citizenship? Am i qualified? Thanks for your time. Your help/answer is much appreciated. Cheers Andrew Neither the time as student nor the time spent on a Tier 1 Post Study Work visa counts towards eligibility to apply for settlement (Indefinite Leave to Remain, ILR) in the United Kingdom. Once you are doing a job which qualifies you to switch to either Tier 1 (General) or to Tier 2 visa and you have applied for and have been issued one of these immigration type visa your required five year period in the U.K. For ILR application (SET O) starts..
