6 INSTRUCTIONS IN RESPECT OF WEBSITE 1. Tender document will be made available on website www.midcindia.org 2. The first envelope should contain the D.D. for EMD, D.D. for cost of tender document. 3. If D.D. for cost of tender (Non-refundable) and the EMD is not found in the 1st envelope, then price bid of the tender shall not be opened. The price bid of the tenderers who qualify for the work as per the prescribed criteria will only be opened. Provide the separate DDs for payment of EMD and cost of blank tender form document. 4. The tenderers who fulfill qualification criteria should only submit the tender and they should enclose all the documents as prescribed in Notice Inviting Tender. 5. The tender duly down loaded from website should be filled & submitted. No change should be made in the tender script by the tenderer & if after submission of the tender, it is noticed that the tender script is modified or any change what so ever is made in the tender document, the tender submitted will be summarily rejected. 6. The queries of the contractors in respect of the tender document should be submitted by the tenderers through web site to the competent authority within allotted time limit as mentioned in tender notice. 7. The queries received from the tenderer before due date will be replied and the reply to the queries will be exhibited on the website which should be down loaded by the intending tenderers. 8. The document of reply to the queries of the contractor will form part and parcel of the tender documents and the clarification given in this document will supersede the provisions in the tender. The document will be down loaded by the tenderer and will be duly signed by tenderer on each page and will be submitted along with the tender in 2nd envelope.

7 INSTRUCTION TO TENDERER FOR FILLING THE TENDER FORM 1. Tender must be enclosed in properly sealed envelope addressed to the Suptd. Engineer (MIDC ) cicle office Udyog Bhavan Nagpur. The tender must be superscripted TENDER for the work of --- M & R to PWSS @ Various I/A under Nagpur Circle.. Supplying of Liquid Chlorine 2. The tenderer will duly sign and complete the printed form. 3. Every page of the tender and contract documents including specifications every correction, deletion or addition and every slip pasted etc. will be signed by the tenderer. The tenderer should quote the rates in words and figures. 4. Where the rate in words differs from the figures, the lowest of the two will be taken as correct rate. 5. The tenderer should carefully note the unit of each item. No change in this unit is to be made. In case of any doubt, the intending tenderer should refer the matter to the Executive Engineer and get necessary clarification in writing. 6. E.M.D. should be pay in the form of DD/Pay Order of any Nationalised Bank payable at Nagpur in the name of Executive Engineer, MIDC (E&M) Dn., Nagpur. 7. If, tenderer imposes his own conditions other than specified in NIT, the tender shall be liable for rejection. 8. Validity of offer should not be less than 180 days. 9. The tenders should be submitted either by registered post or through reputed courier service / hand delivery. The same shall be received up to above given date and time. 10. Engineer, MIDC E&M Dn., Plot No. X-50, Hingna Indl. Area, Nagpur upto 24/03/2014 @ 11.00 Hrs. will be opened on date 24/03/2014 @ 13.30 Hrs. (If possible) @ EE(E&M) office, Hingna, Nagpur in the presence of tenderers or their authorised representative who may like to be present. In case, the date of opening of tender falls on a holiday declared by the Govt., tenders will be received/opened on the next working day following the holiday at the scheduled time.

The tender received after the aforesaid date and time, for whatsoever reason may be, will not be considered under any circumstances and will be rejected outright without assigning any reason. 12. E.M.D. deposited by the tenderer/supplier shall be forfeited, if the tenderer withdrew his tender during the period of validity of offer. 13. The tenders are to be submitted in two envelopes. The contents of the same shall be as under Following documents be enclosed to the tender as Envelope No. 1& 2 duly attested. 1st Envelope: - 1. DD for EMD / EMD exemption certificate issued by MIDC only and separate DD for cost of Tender form. 2. Authorization certificate of manufacturer / Authorised Dealership Certificate issued by manufacturer. 3. Professional Tax Registration/Clearance Certificate 4. Registration Certification with Sales Tax Deptt. under VAT Act 2002, of Govt. of Maharashtra. 5. Certified copy of PAN card., 6. Experience certificate of similar work (for supply of 900 kg tonner and 100 kg cylinder) single work order costing not less than Rs. 7.75 Lakhs executed in the executed in Govt. Deptt. / semi Govt. / Local bodies such as MIDC/ CIDCO/ MJP etc. in last five year. 7. Reply to queries of the contractor duly downloaded from Web site and duly signed. All the above required documents shall be attested by the Gazetted officer or Special Executive Magistrate Only. After opening envelope No 1, all the above mentioned enclosure will be seen & checked chronologically & if they are found satisfactorily & in order, then only sealed envelope No 2 will be opened & rate quoted will be read out. 2nd Envelope: - Tender shall be with clear offer without any condition. Any conditional offer would be rejected outright. Contractor should submit the sealed tender by registered post / reputed courier services / Hand delivery only.

9 1) PAYMENT OF E.M.D.: - 1. The earnest money deposit as declared in detail tender notice shall be paid fully in the form of Demand Draft only. If the Earnest Money Deposit is not found as per tender notice, the offer of the contractor placed in 2 nd envelope shall not be opened and the tender is liable for rejection out-right. 2. If the contractor desires to make the payment of EMD or initial security deposit in the form of demand draft, the D.D. shall be on any Nationalized Bank or Scheduled Bank in the name of EXECUTIVE ENGINEER (E&M), MIDC, DIVISION NAGPUR duly crossed. 3. The EMD in other form is not acceptable and in absence of proper earnest money deposit, tender is liable to rejection out-right. 4. The contractor who have been exempted by MIDC for payment of earnest money deposit, need not pay the earnest money deposit along with the offer. However, the copy of such exemption certificate shall be enclosed in the first envelope. 5. Tenderer imposing their own conditions other than specified in NIT, the tender documents should be liable for rejection. 6. Telegraphic tender will not be considered in any circumstances. The tender/revised offer received after the aforesaid date and time, for whatsoever reason may be, will not be considered under any circumstances and will be rejected outright without assigning any reason. 7. The tenders will be received up to 24/03/2014 @ 11:00 hrs and will be opened on date 24/03/2014 @ 13.30 Hrs. (If possible), @ EE(E&M) Hingna Office,Nagpur In the presences of tenderers or their authorised representative who may like to be present. In case, the date of opening of tender falls on a holiday declared by the Govt., tenders will be received/opened on the next working day following the closed day at the scheduled time. 8. Any tender, which is not submitted in blank tender form downloaded from MIDC s web site and is not duly sealed and signed by the tenderer, will not be considered and will be rejected outright. 9. The offer must be firm for the period of not less than 180 days. All tenders/offers will be regarded as constituting an offer or offers open to acceptance in whole or part to the last date of validity as indicated by the tenderer in his tender/offer. 10. Price quoted should be for delivery in safe condition and should include loading, taxes, duties, transport, packing forwarding charges and insurance against damage, loss or theft etc. in transit and unloading, stocking charges at site of delivery etc. In case, the material is delivered by road transport, the rates should for delivery to stores, of consignment in good condition.

10 11. E.M.D. deposited by the tenderer should be forefieted, if the tenderer withdraw his tender during the period of validity of offer. 12. Right to reject any or all the tenders are reserved by the competent authority. 13. It is sole responsibility of agency to presence & protect complete installation till the handling over to MIDC during contract period except unforeseen reasons. 2) SECURITY DEPOSIT: - a. The contractor is required to pay 8% security deposit of estimated cost or tendered cost whichever is higher, if his offer is acceptable and he is called for execution of agreement as explained below. b. 3% initial security deposit shall be paid at the time of execution of agreement in the form of Banker's Cheque or D.D. However, if the contractor desires to submit a Bank Guarantee, he must mention the same at the time of submission of offer in first envelop only. The request of contractor after opening of tender for payment of initial security deposit in the form of Bank guarantee shall not be accepted. c. The mention of payment of initial security deposit in the form of Bank Guarantee at the time of submission of offer will not be treated as a condition. d. The balance 5% security deposit shall be recovered through running account bills. No Bank Guarantee or fixed deposit receipt shall be accepted for the same. e. The security deposit will be released as under. 1. 3% initial security deposit will be released after completion of the work and payment of final bill. 2. 5% security deposit recovered through R.A. bills will be released after three month period from the date of completion of work & after receipt of NOC from Concerned Deputy Engineer.

11 3) STAMP DUTY: - The contractor whose offer is proposed for acceptance and called for execution of agreement shall have to pay the stamp duty as per provision of article 63 of schedule-i of Bombay stamp act-1958. The Provision of Article 63 are as below. Works contract, that is to say a contract for works and labour or services involving transfer or property in goods (whether as goods or in some other form) in its execution and includes a sub-contract Where the amount or value set forth in such One hundred contract does not exceed rupees ten lakh b) Where it exceeds rupees ten lakh One hundred rupees plus one hundred rupees for every Rs.1,00,0001- or part thereof, above rupees ten lakh, subject to the maximum of Rs.5,00,0001- The contractor whose offer will be accepted will called for execution of the agreement and shall only be liable to pay the stamp duty applicable thereon. Terms and conditions for the reimbursement of taxes/duties Clause: While submitting the tender, the contractor shall consider prevailing taxes and duties on the date of submission. In case there is statutory increase in the taxes/duties, the contractor shall submit documentary evidence for the payment of the same. On verification of the documents, the reimbursement will be made if there is increase. In case there is reduction in the statutory taxes, duties, deduction will be effected It may also be noted that this clause is not applicable if there is increase in the Octroi during execution of the work."

12 CLAUSE FOR RECOVERY OF ADDITONAL SECURITY DEPOSIT A) Clause for Recovery of Additional Security Deposit in case tenders ACCEPTED more than 15% below The tenderer shall note that, in case the tender is quoted and accepted more than 15% below then the additional security deposit shall be recovered in the form of cash at the time of execution of agreement. 13 MAHARASHTRA INDUSTRIAL DEVELOPMENT CORPORATION (A Govt. of Maharashtra Undertaking) SUBMISSION OF MULTIPLE BIDS. 1. The bidder may submit more than one bid, each consisting of Envelope No. 1 & Envelope No.2 for the same work provided that. a) The DDs for EMD & cost of blank tender form and other technical requirement and Financial criteria have to be fulfilled by the bidder, completee in all respects in at Least one of the bids of same work and this envelope containing DDs for EMD and cost of blank tender form along with technical equirements and financial criteria shall be considered for further action about the bid part/ incomplete submission of technical and financial documents in this envelope will amount to disqualification. b) Out of multiple bids submitted by a bidder, the best in the interest of MIDC, amongst these bids shall be considered for evaluation of offer.

14 BRIEF NOTE MIDC has augmented water supply scheme at various places in Vidarbha region for catering water demand of Industrial Area at Hingna, Butibori, Kalmeshwar, Bhandara, Gondia, Saoner, Wardha, Chandrapur, Katol, Mul & Gadchiroli, Warora etc. These water supply schemes comprise of raw water pump house, pure water rising main, water treatment plant, pure water pump house, ESR etc. Raw water is being treated at Water Treatment Plant where chemical treatments have been given like alum dosing and dosing of chlorine to supply potable water for Industrial as well as domestic purpose. We have installed chlorinators at above Water Treatment Plants ranging from 1 Kg/hr. to 5 Kg/hr. capacities for proper control on dosing of chlorine through chlorinator. The tenderer shall have to procure duly tested cylinders & supply chlorine in them. In the scope of this tender the contractor shall supply chlorine as per delivery schedule in the stores of respective water supply scheme.

15 SCOPE OF WORK The scope of works therefore starts right from pre-inspection at site at own interest of agency to verify whether cylinder is empty or otherwise, cylinder valve is in working condition. This should be confirmed by the supplier of liquid chlorine. The scope of work includes loading, unloading, transporting of empty tonners/ cylinders as well as filled tonners / cylinders and delivery at site as per instruction of site engineer. Supplier shall have to supply liquid chlorine in 900 kg tonners & 100 kg Cylinders at respective water supply schemes. The transportation of chlorine cylinders is expected to be carried out in such vehicle which should be approved by Explosive Department for transportation. This is the responsibility of contractor to ensure that such approved vehicle is available for transportation.

16 GENERAL TERMS & CONDITIONS NAME OF WORK :- M&R to PWSS @ various industrial areas in Nagpur Circle -- Supplying of liquid chlorine 1. Prices:- The rate shall be inclusive of all taxes, transportation, loading unloading duties, octroi & free delivery at destinations. (All destination). The rate shall be firm & fixed during the period of supply. No variation will be accepted. 2. Mode of Payment:- 100% payment of each container will be made after the receipt of the container in good and acceptable condition at site of work. 3. PLACE OF DELIVERY: The material should be supplied at 1 Butibori WTP & Wateghat P/H 2 Hingna WTP 3 Kalmeshwar WTP 4 Bhandara WTP 5 Gondia WTP 6 Saoner W.T.P. 7 Chandrapur Growth Center 8 Mul WTP 9 Gadchiroli WTP 10 Warora WTP 11 Wardha WTP 12 Deoli WTP The Contactor should have capacity to supply the liquid chorine in 900 Kg toner and 100 Kg cylinder as specified in scheduled D. Contractor is hereby instructed to load and unload the tonner/ cylinders at the places mentioned as above. However contractor is hereby directed to provide the tonner/cylinders at the various water works of MIDC as per our requirement only. It is to be noted specifically that contractor has to supply chlorine filled tonner/ cylinder as per the normal delivery schedule to be fixed after discussion with concerned Deputy Engineer. In case urgent requirement, agency shall have to supply tonner/cylinder within 8 days on receipt of information either telephonically or in writing. If agency failed to supply the liquid chlorine within eight days even after communicating the requirement, necessary arrangement shall be made by MIDC from other source & extra burden shall be recovered from bill along with compensation of Rs. 500/- per day.

17 Any risk involved due to leakages in container/cylinders valve/body shall be the responsibility of the contractor either in transit or after delivery of material. Contractor shall always see the chlorine container/cylinders are in good condition and its valves are operating properly. 4. Rental Charges :- The contractor has to supply the liquid chlorine in his own container/cylinder, the supply shall be without rent. It is the responsibility of contractor to lift container/cylinders from the site of work. 5. COMPENSATION : Failure to supply of material by the agency within eight days from the date of communication will attract the payment of compensation @ Rs.500/- per day, if it differs from the delivery schedule. 6. Training : Agency have to arranged training for operation & handling of chlorine cylinder @ Hingna & Butibori W/W for operation in Ist 02 months of contract period, on his risk & cost. If the contractor is fail to deliver the training for how to attend the leakage of cylinder/gas, use of appliances/safety equipments in case of emergency for arresting leakages and effect of chlorine gas, then Rs. 2000/- per training location i.e. total Rs. 4000/- shall be deducted from the contactor s final bill. 7. The Supplier may have their own 900 Kg. tonner & 100 Kg. Chlorine cylinders. 8. Suppliers may have their own vehicles for transportation of cylinders/tonners exclusively reserved for transportation of cylinders/tonners. 9. All the facts are hereby cleared by the department & suppliers are requested to go through the details and their rates for the same. 10. If any doubt regarding the tender conditions, agency may contact the Ex. Engineer (E&M) Dn., Nagpur well in advance before submitting the tender.

18 TERMS AND CONDITIONS OF SUPPLY OF LIQUID CHLORINE GAS 1. The Quality of liquid chlorine gas shall be as per IS:646/1986 or subsequent amendment if any. 2. Tenderer shall furnish his full address including telephone no. & E-mail ID to enable the staff of water works to contact them for urgent need of liquid chlorine gas and for any other problems. 3. Supply shall be made in tonners of 900 kg. And cylinders of 100 kg. Nett as per requirement. 4. The rates shall be for delivery at various water works inclusive of all taxes, including to and fro transportation of the cylinders. 5. The arrangement to deliver the filled tonners / cylinders and to collect the empty tonners/cylinders from water works including loading & unloading transportation of container/cylinders shall be the responsibility of supplier. 6. The suppliers shall see themselves the filling and connecting facilities provided at water works for the safety point. If the manufacturer or the firm suggests any change or extra arrangement during the execution of contract the same shall be done by the Deptt. Immediately. The supplier shall be responsible for the compliance of the explosive conditions as prescribed by the Govt./Central Govt. from time to time. 7. Ownership or right of taking possession of the tonners/cylinders from the consignee shall rest with supplier. 8. Damages to the tonners/cylinders shall be brought to the notice of the consignee within 3 days from the date of receipt of report from the manufacturer alongwith a copy of the report of the manufacturer. 9. The consignee will give minimum 8 days prior intimation for dispatch of chlorine gas in tonners/cylinders to ensure smooth and uninterrupted supply. 10. It is hereby made clear to contractor that the he should ensure the Tonner / cylinder before lifting the same for filling the gas that they are in perfect working condition and no repairs replacement are required. If any defects arises during transit and container/cylinders require some repairs/replacement that should be contractors account and MIDC will not pay any charges for the same. 11. Delivery Schedule: You have to supply the chlorine tonner 900 kg & 100 kg each @ respective W/W and actual delivery date shall be confirmed from respective Deputy Engineer of Sub-Division. The probable delivery schedule during the contract period shall be fixed after discussion with respective Deputy Engineer.

19 SPECIAL CONDITIONS The supplier shall have to quote the rates in Schedule D. The quantities mentioned in the tender are approximate and are likely to increase or decrease by more than 25%. Under such circumstances the material will have to be supplied at the same rate and extra claims in this regard will not be entertained.

If the tender is accepted no separate agreement shall be necessary and the tender itself shall be treated as the contract. 2. In the event of the tender being submitted by a firm, it must be signed by each partner there of or in the event of the absence of any partner, it must be signed on his behalf by a person holding a power of attorney authorizing him to do so. 2. Receipts for payments made on account of any work, when executed by a firm, should also be signed by all the partners, except where the contractors are described in their tender as a firm, in which case the receipts shall be signed in the name of the firm by one of the partners, or by some other person having authority to give effectual receipts for the firm. 3. The amount of earnest-money to be deposited shall be at the rate of 1 per cent of the estimated cost of the work or at such higher percentage rate as may be fixed by the officer concerned in accordance with the provisions of paras. 202 and 203 of the P. W.D. manual. such earnest money should generally be paid by the contractors direct into a MIDC Dnl, Office and the receipt obtained therefore should be attached to the tender form. 4. The Executive Engineer or his duly authorized Assistant shall open tenders in the presence of contractors who have submitted tenders or their respectives who may be present at the time and he will enter the amounts of the several tenders in comparative statement in a suitable form. Receipts for the earnest money forwarded with the tenders shall be given to the contractors on the day the money is received. In the event of a tender being accepted the contractor shall, for the purpose of identification sign copies of the specifications and other documents as may be necessary. In the the event of a tender being rejected, the Divisional Officer shall refund the amount of the earnest money deposited to the contractor making the tender on his giving a receipt for return of the money. 5. The officer competent to dispose of the tenders shall have the right of rejecting all or any of the tenders. 6. Every contractor shall unless exempted in writing by the Superintending Engineer produce along with his tender a solvency certificate from the Collector of the District within which he resides or a Banker's Certificate of his financial stability. If he falls to produce such a certificate, his tender shall not be considered.

The security deposit referred to when paid in cash may, at the cost of the depositor be converted into interest bearing securities provided that the deposit has expressly desired this in writing. if the amount of the security deposit to be paid in a limp sum within the period specified at (A) above is not paid the tender / contract already accepted shall be considered as cancelled and the legal steps taken against the contractor for recovery of the amounts. The security deposit lodged by a contractor shall be refunded after the expiry or three months from the date on which the final bill is paid. Clause 2 - The contractor shall deliver the materials on or before the dates mentioned in the tenders, failing which he shall be liable to pay a sum of Rs. 500/- liquidated damages for every that he shall delay the delivery of the said materials. 24 Clause 3 - In every case in which the delay mentioned in clause 2 shall continue for consecutive days the Officer competent to dispose of the tender shall have power either to annual the contract altogether or to have the supply completed without further notice at the contractor's risk and expense, as he may deem necessary in the interest of the MIDC and the contractor shall have no claim to compensation for any loss that he may thus incur on account of the action of the officer. Clause 4 If at anytime after the execution of the contract documents, the Executive Engineer or his Assistant shall for any reason whatever not require the whole or any part of the work as specified in the tender to be carried out the Executive Engineer or his Assistant shall give notice in writing of the face to the contractor (s) who shall thereupon have no claim to any payment or compensation whatsoever on account of any profit or advantage which he/they might have derived from the execution of the work in full but which he / they did not derive in consequence of the amount of the work not having been so carried out. No compensation for restriction of work Extension of time Clause 5 - If the contractor shall be hindered in the supply of the material so as to necessitate an extension of the time allowed in this tender, he shall apply in writing to the Officer in charge of the work who shall grant it in writing with the sanction of competent authority on reasonable grounds being shown for it-. In the absence of such written authority of the Executive or Assistant Engineer, the Contractor have no claim to exemption from the fine leviable under clause 2. Clause 6 - The contractor shall give notice to the Executive Engineer or his Assistant of his intention of making delivery of materials and on the materials being approved. a receipt shall be granted to him by the Executive Engineer or by his Assistant, and no materials which is not so approved shall be considered to have been delivered. Clause 7 - On the completion of the delivery of materials the contractor shall be furnished with a certificate to that effect but the delivery shall not be considered to be complete until. the contractor shall have removed all rejected material and shall have the approved materials stacked or placed in such position as may be pointed out to him. Clause 8 - The materials to be supplied shall be of the best quality and in strict accordance with the specification and the contractor shall received payment for such materials only as are approved and passed by the Executive Engineer or his Assistant. Should the Executive Engineer consider that any of the materials delivered are not of the best quality are not in strict accordance with specifications but that they may be accepted and made use of it shall be within his full discretion to. accept the same at such reduced rates as he may fix thereon. Clause 9 - In the event of the material being considered by the Officer in charge of the work to be inferior to that described in the specifications, the contractor shall on demand in writing forthwith remove the same at his own cost and in the event of his failure to do so within such period as may be named by the Executive Engineer or his Assistant the said Officer may have such rejected materials removed at the contractor s risk and expense the expense so incurred being deduced from any sums due or which may become due to the contractor. Approval of and receipt of materials Certificate Payment for materials Action when inferior materials is supplied

25 Clause 10 - If the contractor or his workmen shall break or defect any building, road, fence, enclosure or grassland or any cultivated land he shall repair or replace the same and if any damage has been done he shall make good the same at his own expense and in the event of his refusing or failing to do so, the damage shall be made good at the contractors expense by the Officer inviting the tender who shall. deduct the cost from any sums due or which may become due to the contractor or from his security deposits or the proceeds of sale thereof or a sufficient portion thereof. Clause 11 - The contractor shall supply at his own expense all tools, plants and implements required for the due fulfillment of his contract and the materials shall remain at his risk till the date of final delivery except such portion as shall have been in the meantime removed for use of Executive Engineer or his Assistant. Clause 12 - No materials shall be brought to the site of the work or delivered on Sundays without the written permission of officer in charge of the work. Clause 13 - This contract shall not be sublet without the written permission of the Executive Engineer. In the event of the contractor sub-letting his contract without such permission, he shall be considered to have thereby committed a breach of the contract and shall forfeit his security deposit and shall have no claim for any compensation for any loss that may accrue on account of the collection of the materials or engagements entered into Clause 14 - The contractor shall responsible for and any compensation to his workmen which may be payable under the Workmen's compensation Act 1923 (VIII of 1923) herein after called the said Act, for injuries suffered by then. If such compensation is paid by the MIDC as principal under subsection (I) of section 12 of the said Act on behalf of the contractor it shall be recoverable by the MIDC from the contractor under sub section (2) of the said section. Such compensation shall be recovered in the manner laid down in Clause I above. Action for damages Supply of tools, plant etc. by contractor for due fulfillment of contract Delivery of Sunday Sub-letting of contract Compensation under the workmen s compensation Act. Clause 15 - The decision of the Superintending Engineer for the time binding shall be final, binding and conclusive on all question elating to the meaning of the specification. Decision Superintending Engineer to be final of Clause 16 - No guarantee can be given that the total number of quantities of material indicated in the scheduled of the contract will be ordered during the period of the contract. But the Executive Engineer shall purchase from the contractor all such materials as are detailed in the scheduled which he may require to purchase during the period of tire contract. Clause 17 - No claim or claims made by the contractor for increased rates on the grounds that the market or other rates, included in the contract have rise during the period of his contract will be recognized that is to say the contractor is bound to complete the work and I or to supple materials at rates mentioned in the contract. Clause 18 - All quarry fees, royalties, octroi, dues and ground rent for stacking materials, if any should be paid by the contractor, who will however be entitled to a refund of such of the charges as are permissible under the rules on obtaining a certificate from Executive-in-Charge that the materials were required for use on MIDC work. 26 Clause 19 - (i) No contractor shall employ any person who is under the age 12 years. (ii) No contractor shall employ donkeys or' other animals with breeching of string' or thin rops. The breeching must be. at. least three inches wide and should be of taps (nawar). (iii) No animals suffering from sores lamenes's or emaciation or which is immature shall be employed on the work. (iv) The contractor shall pay fair and reasonable wages to the workmen employed by him in the works undertaken by him. In the event of any dispute arising between the contractor and his workmen on the ground that the wages paid are not fair and reasonable the dispute shall be referred without delay to the Executive Engineer who shall decide the same; The decision of the Executive Engineer shall be conclusive and binding on the contractor, but the existence of the dispute or the decision if any of the Executive Engineer shall not in any way affect the conditions in the contract regarding the period during which the work is to be completed or the payment to be made by the MIDC at the sanctioned tendered rates. Clause 20 - Payment to contractors will be made by Cheque drawn on any treasury within the Division most convenient to them provided the amount to be paid exceeds Rs. 10 Smaller amounts will be paid by cash. Clause 21 - Any contractor who does not accept these conditions shall not allowed to tender for works and his name shall be removed from the list of contractors. Tonner of MIDC or contractor Tonner @ Hingna Water Works & Butibori Water Works. Specifications :- Contractor is hereby requested to quote the rates for 100% active chlorine duly filled in 900 kg capacity chlorine tonners. The liquid chlorine shall be as per the relevant IS specification. The rate shall be inclusive of all taxes, VAT, duties, transporting upto said destination i.e. Hingna & Butibori water treatment plant including retesting and rechecking of empty chlorine cylinders at their works. Any damages while loading, unloading and transportation shall be borne by contractor. Due to any reason beyond the control of MIDC, if MIDC s container/cylinder are not available for supply, the contractor shall have to supply the chlorine gas in his own container/cylinder. There shall be no rent for his container/cylinder. Contractor shall have to deliver the container/cylinder as and when required by MIDC within a period of 8 days from the date and information given by MIDC. Mode of Measurement & Payment :- The contractor shall be paid as per actual quantity supplied on kg basis.
