Open meeting, Invocation, Pledge of Allegiance- Mayor Frazier called the meeting to order at 6:30 p.m. Mike Parker offered the invocation. 2. Roll Call- All members of the City Council were counted present. 3. Citizen Comments- No citizens appeared to speak to the Council. 1
4. Update by the City Manager/Staff Comments- Mr. Wall informed the Council that the grant for Buffalo Creek Linear Park has been submitted to Texas Parks and Wildlife. Mr. Wall stated that CISD has expressed their support for the project. Mr. Wall announced that Jana Shelton, City Secretary, has completed her City Secretary Recertification Program and Bobbi Jo Taylor, Finance and Utilities Clerk, has completed her Certification for Texas Municipal Clerks Certification Program. Mr. Wall stated the course includes over 200 hours of homework and seminar attendance. Mr. Wall congratulated both City employees for a job well done. Mayor Frazier stated that he has been in contact with the owner of Cotton Gin and the he stated that no decisions have been made at this time regarding what is planned for the property. Mayor Frazier stated that he has a meeting scheduled with Mr. James Feagen, Cartwright Ranch Development, and will report back to the Council after the meeting. Mayor Frazier stated he is looking for programs to help clean up or beautify Crandall such as Keep Texas Beautiful. 5. Approval of Minutes: January 5, 2015- Jason Warren made a motion to approve the Minutes of January 15, 2015. Shannon Barnes seconded the motion. The motion carried with unanimous vote of the Council. 6. Presentation by the Municipal Court Judge Beasley-. Judge Beasley appeared to speak to the Council, giving the Council a brief report of the status of the Court including the number of Juvenile cases. Mr. Beasley stated that the court is now a court of record which helps when cases go to trial. Mr. Beasley stated that he enjoys being the Municipal Judge for the City of Crandall. 7. Discuss and consider a request by Progressive Waste Management for an annual adjustment to the rates for services to reflect the change in the Consumer Price Index (CPI-U)- Shannon Barnes made a motion to discuss Item #7. Victor Morales seconded the motion. The motion carried with a unanimous vote of the Council. Dick Demien, Progressive Waste Management, spoke to the Council stating that Progressive is asking for an annual adjustment in rates 2
for services by 0.8% as provided for by the original contract with the City of Crandall and Progressive Waste Management (Formerly IESI). Shannon Barnes made a motion to approve the annual adjustment rate by 0.08%. Victor Morales seconded the motion. The motion carried with Ron Lanier voting against the motion. 8. Discuss and consider adopting Ordinance No. 020915, a renewal of the Trinity Valley Electric Corporation Franchise Agreement- Shannon Barnes made a motion to adopt Ordinance No. 020915 to renew the Trinity Valley Electric Corporation Franchise Agreement. Victor Morales seconded the motion. The motion carried with a unanimous vote of the Council. 9. Public Hearing: To receive input for a variance request by Lisa and Warren Harris on property located at 129 Buffalo Creek to construct a living space on the property- Mayor Frazier opened the public hearing at 6:50 p.m. Mayor Frazier asked for any opponents or proponents. City Planner, Rob Baldwin, presented a memo that explained the variance request. Mr. and Mrs. Harris live at 129 Buffalo Creek Drive and are asking to expand an existing 25 x 25 accessory building to convert it into an apartment for an immediate family member. Mr. Baldwin and the Planning and Zoning Commission recommended approval of the variance. Mayor Frazier closed the public hearing at 6:55 p.m. 10. Discuss and consider a variance request by Lisa and Warren Harris on property located at 129 Buffalo Creek to construct a living space on the property- Mike Parker made a motion to approve the variance as requested by Lisa and Warren Harris. Shannon Barnes seconded the motion. The motion carried unanimously by the Council. 11. Discuss and consider adopting Ordinance No. 020915A, An Ordinance of the City of Crandall, Texas, allowing chickens in the Old Town District - The Council discussed restriction of allowing chickens in the Old Town district as referred to with the attached map. Shannon Barnes made a motion to adopt Ordnance No. 020915A which allows chickens in the Old Town District. Jason Warren seconded the motion. The motion carried with a unanimous vote of the Council. 3
12. Discuss and consider the amended and restated Interlocal and Cooperative Agreement between the City of Crandall, Texas, Kaufman County Municipal Utility District No. 11, District No. 12 and District 14 for Peace Officer Services- Shannon Barnes made a motion to open Item #12 for discussion. Jason Warren seconded the motion. The Council discussed the additions to the contract which included covering more administrative cost such as a percentage of the Chief s salary. Shannon Barnes made a motion to approve the amended and restated Interlocal and Cooperative Agreement between the City of Crandall, Texas, Kaufman County Municipal Utility District No. 11, District No. 12 and District 14 for Peace Officer Services. Jason Warren seconded the motion. The motion carried with Ron Lanier opposing the motion. 13. Discuss and consider an additional School Resource Officer (SRO) for the Crandall Independent School District (CISD)- Mayor Frazier explained that CISD is currently requesting an additional School Resource Officer (SRO). Mr. Frazier stated the agreement would remain the same with the adjusted cost for the second officer. Mr. Frazier stated that CISD would be responsible for transportation for that officer. Jason Warren made a motion to approve the additional School Resource Officer for Crandall Independent School District. Shannon Barnes seconded the motion. The motion carried with Victor Morales opposing the motion. 14. Discuss and consider adopting Resolution No. 020915R, a Resolution of the City of Crandall, Texas, stating that the Mayor or City Council Member may not serve on any City Boards or Commissions while serving on the City Council- Victor Morales made a motion to open Item #14 up for discussion. Ron Lanier seconded the motion. The motion carried with unanimous vote of the Council. Mayor Frazier stated he understands that no one on the Council should serve on a governmental board such as Economic Development Corporation but feels that a liaison is necessary at times which would be appointed by the Council. The Council discussed the intent of the resolution and stated that the resolution should be made clear by stating any and all boards, commissions and bodies that are appointed by the Council with the exceptions of Liaisons. 4
Victor Morales made a motion to approve Resolution No. 020915R with the above amendments. Ron Lanier seconded the motion. The motion carried with a unanimous vote of the Council. 15. Discuss and consider Resolution 020915RR, A Resolution of the City of Crandall, Texas ordering a General City Election to be held on the 9 th day of May 2015, for the purpose of electing a Mayor and two (2) Council Members, for two-year terms each; providing for election officers; designating the places and manner of holding said election; providing for notice of said election and the conduct thereof; and providing an effective date- Mike Parker stated that the word majority on page 2 should read plurality. City Manager, Scot Wall stated he will have the City Attorney review the wording on the referred section. Jason Warren made a motion to approve Resolution No. 020915RR with the attorney reviewing the wording of "majority to plurality". Shannon Barnes seconded the motion. The motion passed with a unanimous vote of the Council. 16. Presentation of the Crandall Police 2014 Racial Profiling Report- Chief of Police, Dean Winters, prepared a 2014 Racial Profiling Report. The Council reviewed the 2014 Racial Profile Report. 17. Discuss and consider entering into a contract with Kaufman County Tax Assessor-Collector, Tonya Ratcliff, for the conduct and supervision for the City of Crandall 2015 General Election- Shannon Barnes made a motion to approve entering into a contract with the Kaufman County Tax Accessor-Collector for the City of Crandall 2015 General Elections. Jason Warren seconded the motion. The motion carried with a unanimous vote of the Council. 18. Discuss and consider rescheduling the regular March Council meeting to March 9, 2015- Shannon Barnes made a motion to reschedule the March Regular Council meeting to March 9, 2015. Victor Morales seconded the motion. The motion passed with a unanimous vote of the Council. 19. Adjourn into Executive Session- 5
Jason Warren made a motion to adjourn into Executive Session at 8:41 p.m. Mike Parker seconded the motion. The motion carried with a unanimous vote of the Council. 20. Executive Session: Open Meetings Act, Section 551.074, Personnel Matters (City Manager s Evaluation)- 21. Adjourn from Executive Session- Jason Warren made a motion to adjourn from Executive Session at 9:25 p.m. Shannon Barnes seconded the motion. The motion carried with a unanimous vote of the Council. 22. Discuss and consider an amendment to the City Manager, Scott Wall s - Employment Agreement- Victor Morales made a motion to amend the City Manager s contract for to allow for a one (1%) percent increase to his salary. The motion died for a lack of a second. Jason Warren ask for clarification on the percentage the City employees received for the current year. Mayor Frazier stated it was one (1%) percent. Jason Warren made a motion to allow a one (1%) increase in salary as an amendment to the City Manager s contract. Victor Morales seconded the motion. Jason Warren and Victor Morales voted in favor of the motion. Ron Lanier, Mike Parker and Shannon Barnes opposed the motion. The motion did not pass. Mike Parker made motion to amend Mr. Wall s contract to allow a two (2%) increase to his salary. Shannon Barnes seconded the motion. The motion carried with Victor Morales opposing the motion. 23 Adjourn- Shannon Barrens made a motion to adjourn the meeting at 9:30 p.m. Jason Warren seconded the motion.
