CORPORATION OF THE TOWN OF BRADFORD WEST GWILLIMBURY BY-LAW 94-084 PARKLANDS AND PROPERTIES BY-LAW.. Being a By-Law to provide for the management, regulation, control, maintenance, and usage of all PARKLANDS and PROPERTIES owned or leased by the Town of Bradford West Gwillimbury for park or recreation purposes. WHEREAS the Municipal Act, R.S.O. 1990, c. M.45, s. 207(52) authorizes municipal councils to enact by-laws to manage, regulate, control, and maintain the use of all parklands and properties within parklands; AND WHEREAS it is deemed desirable that parklands and properties be maintained and controlled for the enjoyment and benefit of the citizens of the Town of Bradford West GwillimburYi NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF BRADFORD WEST. GWILLIMBURY ENACTS AS FOLLOWS: 1. DEFINITIONS for the purpose of this By-Law: (a) (b) (c) "Committee" means the Parks and Recreation Commi ttee or appropriate body as appointed by By-Law by the Council of the Town of Bradford West Gwillimbury. "Council" means the elected Council of the Corporation of the Town of Bradford West Gwillimbury. "Department" means the Parks and Recreation Department of the Town of Bradford West Gwillimbury. (d) "Director" means the Director appointed by Council. of Parks and Recreation (e) "Parking area" means an area that is physically laid out and/or improved for the purpose of parking vehicles or that is designated by an official sign for such purpose in, on or by a Town parkland. (j) " Parklands" available has been dedicated means any and all lands owned by or made by lease, agreement or otherwise to the Town that or hereafter may be set apart, designated, or establisned by Council as public parkland. (g) "Person" means a natural person, unincorporated association or organization, firm, partnership, private club, corporation, agent or trustee and the heirs, executors, administrators or other legal representatives of a person to whom the context can apply according to the By-Law. (h) "Police" means the Bradford West Gwillimbury Police Service.. (i) "Posted area" means any area that is posted by sign, notice, or other device for a specific purpose or to restrict certain activities in or on Town parklands under the authority of this By-Law. (j) "Properties" means any and all buildings, structures, equipment, trees, shrubs, horticultural displays, benches, walkways, tennis courts, arenas, rinks, pools, waste disposal containers, playground apparatus, shelters, washrooms, fencing, lighting, parking areas or other such properties that may be placed or erected on Town of Bradford West Gwillimbury parklands. (k) "Roadway" means an area that is physically laid out and/or improved for use by vehicular traffic except where posted as a seryice road for Town vehicles only.

2 Parklands & Properties By-law 94-084 2.' (1) "Town" means the Corporation of the Town of Bradford West Gwillimbury. (m) "Vehicle" means any, motorized vehicle or conveyance including trucks, automobiles, trailers, buses, motorcycles, snowmobiles, ATV (all terrain vehicles), or any other mode of transportation of a like nature. (n) "Walkway" means an area that is physically laid out and/or improved for use in or on Town parkland by pedestrians, and non-motorized manually propelled vehicles, providing that ped~strians shall at all times be given the right of way. It shall be the duty and responsibility of t he Director or his authorized representative to: 0) Administer the management, control, regulations, maintenance, development, and usage of all parklands and properties, and the employment and performance of departmental personnel. (b) Enforce the provisions of this By-Law through the proper authorities. (c) Recommend as required, from time to time, to Committee, revisions, additions or amendments to the By-Law for improvement to the management, control, regulations, maintenance, and usage of parklands and properties. 3. It shall be an offence for any person or persons to do any acts hereinafter specified within the limits of Town parklands and properties: (a) To damage, destroy, injure, deface, tear up, burn, dig, or mark any portion of parkland or any properties erected, installed, or contained on parklands. (b) To dump, deposit, or leave any refuse, garbage, waste, paper, soil, sod, plants, or any other type of domestic or industrial waste on or in parklands or properties contained therein except in receptacles that may be provided for such purpose. (~ To pollute or contribute to the pollution of water in any rivers, lakes, streams, watercourses, reservoirs, ponds, swimming or wading pools, or other receptacles for water by allowing pets to enter, or by throwing or depositing any solid or liquid matter into said waters. (d) To kill, maim, or in' any way molest, or disturb any animal, bird, or water fowl that is enclosed, or whose habitat is in Town parkland. ~) To lead, ca~ry, or otherwise take any animal upon or into any Town parkland with the exception of household pets who must be kept on a leash and in control. For the purpose of this section "household pet" shall mean a domestic dog or cat.. m To conduct or participate in sports, or other active endeavors in areas that are designed specifically as horticultural and landscaped sites, passive and sitting areas, and facilities for young children. (g) To enter a "posted area" that is designated "no admittance" or "no trespassing". / (h) To contravene any posted rules and regulations relating to the operation of any parklands, arenas, swimming pools, recreation centres, or other Town properties.

3 Parklands & Properties By-law 94-084 (i) To conduct oneself in a manner that in the opinion of the Municipal Law Enforcement Officer, Police Officer or other person appointed for the purpose of enforcing this by-law, is detrimental to the safety and enjoyment of others using Town parklands and properties. (j) To use any part of Town parklands or properties for the purpose of: (i) washing, clea'ning, polishing, servicing, maintaining or, with exception of any emergency, repairing any motorized vehicle; (ii) instructing, teaching or coaching any person in the driving or operation of a motorized vehicle. 4. (k) (l) (a) (b) (c) (d) (e) (j) (g) (h) To conduct or participate in organized sports or activities in areas 'other than those designated as a "posted area", or physically laid out and/or improved for such use. To breach while on or in Town parklands or properties any existing municipal By-Law or federal or provincial statute. It shall be an offence for any person or persons to do any of the acts hereinafter specified in this section within Town parklands and properties without receiving prior written permission from the Council. The Director or his designate, is hereby authorized by Council to accept applications for and issue any permits or written permission from the Council: To remove from parklands or properties any wood, turf, grass, and other vegetation, soil, rocks, sand, gravel, dew worms, or any form of equipment; To lead or bring animals of any nature into a Town facility or property, except as provided in Section 3 (e) of this By-Law or provided such dog is required as a seeing-eye dog for an individual; To conduct public meetings, gatherings, speeches, lectures, carnivals, festivals, firework displays, overnight camping, large picnics, organized sporting events, or other such events which involve a large number of people; To operate or use any apparatus, mechanism, or device for the amplification of the human voice, music, and other sound; To cause or create any unnecessary noise or disturbance that contravenes the Noise and Nuisance By-Law of the Town parkland or properties anytime between the hours of 11: 00 p.m. and 8:00 a.m.; To turn on or tamper with any lighting contrpl boxes for facilities, or any equipment relative to parkland properties; To distribute any hand bills or circulars; To sell, offer, or expose, for sale for immediate or future delivery any: (i) '(ii) (iii) food, drink or refreshment, goods, wares or merchandise, art, skill, service or work;

4 Parklands & Properties By-law 94-084 j (i) W W To build or use a fire other than a fire permitted in accordance with any rule or regulation established under Section 3(h) for any purpose without receiving prior permission from the Fire Department and the Director. It shall also be an offence if any person or persons do not completely extinguish said fire when not in attendance; To carry or discharge any firearms, firecrackers, rockets, arrows, airguns, catapults, or fireworks; To drive or operate: (i) Any motorized vehicle within a Town park or in or on any Town parklands or properties unless the said vehicle is licensed for use on public highways in Ontario, or unless the vehicle is operated in an area specifically designated for use by that type of vehicle; Any vehicle on public parkland roadways and parking areas in excess of fifteen (15) miles per hour, or so as to interfere with or endanger any person in said parklands; Any motorized vehicle within a Town park or in or on any. Town parklands or properties except upon roadways, parking areas, and other areas intended for public vehicular use; (ii) To drive or operate vehicles such as snowmobiles, minibikes, or any other motorized recreational vehicles upon any parklands with the exception of areas that are posted and designed for such purposes; (iii) To park or leave standing; Any vehicle on parkland property other than on areas posted or designated for parking; Any vehicle in front of a public building, emergency exits, walkway entrances, or in any way that will obstruct the normal flow of traffic on a public park roadway or parking lot; Any vehicle for more than the time specified on an official sign and in any event, overnight parking shall only be permitted between the hours of 10:00 p.m. and 8:00 a.m.; and Any vehicle belonging to any person other than park/recreation participants during the hours of 8:00 a.m. to 10:00 p.m.. A police officer, police cadet, or municipal law enforcement officer may, upon discovery of any vehicle' parked or left in contravention of this by-law, may cause it to be moved or taken to and placed or stored in a suitable place and all costs and charges for removing, care and storage thereof, if any, are a lien upon the vehicle which may be enforced in the manner as provided by Part III of the Repair and St,orage Liens Act, 1989. (1) To carry or use a hockey stick or similar equipment on a natural or artificial ice rink designated for pleasure skating only; (m) To erect barbecues in parklands with the exception of areas designated for that purpose.

5 Parklands & Properties By-law 94-084 5. The Council and organizations operating under its auspices may apply for and maybe granted an annual permit which shall be deemed to cover all of its activities and programs that may be undertaken in and on parklands and properties and shall be deemed to be written permission under this By-Law for its activities where required by the By-Law. 6. Every person who contravenes any provision of this By-Law is guilty of an offence and liable upon conviction to a penalty not exceeding $5,000.00, exclusive of costs and the prov1slons of the Provincial Offences Act, R.S.O. 1990, C. P.33, as amended, shall apply to the said f~ne. 7. If any court of competent jurisdiction finds that any of the provisions of this By-Law are ultra-vires of the jurisdiction of the Council of the Town of Bradford West Gwillimbury to pass, or are invalid for any other reason, such provision shall be deemed to be severable and shall not invalidate any of the 6ther provisions of the By-Law. 8. That By-Law 90-043 of the former Town of Bradford, and all Parkland By-Laws and amendments thereto inconsistent with the provisions of this By-Law are hereby repealed. That By-law 93-069 is hereby repealed. 9. This By-Law shall be cited as Parklands and Properties By-Law. 10. This By-Law shall come into full force and take effect on the day of the final passage thereof. BY-LAW READ A FIST, SECOND AND THIRD TIME AND FINALLY PASSED THIS 8TH DAY OF AUGUST, 1994.
