STUDENT REPRESENTATIVE COUNCIL CONSTITUTION, SPIRITAN UNIVERSITY COLLEGE, Ejisu-Ashanti PREAMBLE With the power of the Holy Spirit and under the protection of the Immaculate Heart of Mary, the students of the above mentioned College putting the ethos and goals of the College in mind have adopted this constitution as a guide in achieving the aspirations of the College. CHAPTER ONE ARTICLE 1: Official Name a) The official name of this organisation shall be Students Representative Council. ARTICLE 2: Functions of SRC The functions, duties and powers of SRC shall be the following The SRC shall be responsible for promoting the general welfare of all the students in the College It shall also ensure that the views of the students are well-presented to the appropriate quarters To Plan all major students activities in the College shall be its responsibility To promote cordial and mutual relationship among students the past students between students and staff To formulate Rules and Regulations and also ensure that the existing rules are adhere to without discrimination To promote cordial relationship and cooperate with other universities, institutions and colleges, both local and international To collaborate with the National Union of Ghana Students (NUGS) and the Private University Students Association of Ghana (PUSAG) The Body is also charged with ensuring that the students magazine (insight) and other news letters are published To submit annual reports to the General students body. ARTICLE 3: Composition of SRC

The body shall be composed of The Executive Officers 2 representatives from various Halls 2 representatives from each level 2 representatives from non-resident students e) The Executive Officers The executive officers shall be made up of: The President The Vice President (non- voting member) The General Secretary The Treasurer Other Officers The other officers are: Assistant General Secretary Public Relation Officer Organising Secretary Sports Chairperson Entertainment Chairperson ARTICLE 4: Duration for executive The term of office of the executive shall be one academic year. ARTICLE 5 Functions of SRC members (a) President The president shall be the spokesperson and intermediary between students and staff. Presides over meetings of SRC either executive or entire students. Has power to appoint chairpersons of the various sub-committees in consultation with his council members. Represents students at governing council meeting.

(b) Vice-President He/she shall assume the position and responsibility of the president, when the president is absent, impeached, or the president s seat becomes vacant as stated in article 12. He/she shall serve as the coordinator of the activities of SRC by working with other committees. He/she shall also be responsible for any assignment given by the SRC. c) General Secretary He/she shall convene ordinary general meetings under the guidance of the president or executive office and present the agenda. He/she keep records and other documents of the executive and SRC, and record minutes of SRC meetings. He shall see to the day to day running of the SRC office (d) Assistant Secretary He/she shall help the General Secretary in convening meetings, keeping records, and recording the minutes of SRC meetings and shall see to the day to day running of the SRC. He/she shall assume the position of the General Secretary when the seat becomes vacant. He/she shall take the position of the treasurer in his/her absence. (e) Treasurer He/she shall be responsible for all cheques and cash books of SRC and deposit all monies in the bank. He shall keep all financial records of SRC (f) P.R.O He/she shall represent the SRC at Editorial Board meetings of the Insight magazine as a non-voting member He/she shall be in charge of all publicity of SRC He /she shall also be the spokesperson in and outside college (g) Organizing Secretary He shall be responsible for the organization of all SRC programmes or meetings. He/she shall also perform any function assigned to him or her by the SRC. CHAPTER TWO

ELECTIONS ARTICLE 6: Qualification of candidate The person must be a student of the college Should not have had any misdemeanor or bad record. Must have spent at least a year in the college Must pay his or her dues regularly and Fulfill his or her obligation as student. ARTICLE 7: MODE OF CONDUCT OF ELECTION Student aspiring to hold SRC office must be required to officially apply for the desired office through either the Registrar s office or Dean of studies. In the absence of any application within the stipulated time, the whole student body will nominate the SRC officers for various offices. The E.C in accordance with article 19 (II) shall vet the aspiring candidates. a) A simple majority is required to win an election. An unopposed candidate requires 50% + 1 to win or qualify for election to the SRC. In the event of a tie, there should be a fresh election. Any candidate who engages in any electoral malpractice shall be withdrawn by the EC. ARTICLE 8: THE RIGHT TO VOTE AND BE VOTED FOR Every student has the right to vote and be voted for Every student of this college shall use his student ID card as voters ID during elections ARTICLE 9: MODE OF CAMPAIGNING Campaigning for various SRC offices start immediately after vetting Candidates are allowed to paste their posters at designated places by SRC or electoral commission All campaigning shall end two days before the election. CHAPTER THREE ARTICLE 10: RESIGNATION

Any member of SRC with the exception of the Executive officers may voluntarily resign his/her post and it should be communicated to the president, copied to the registrar in writing a week (7 days) before his resignation. Any member of the executive may voluntarily resign his/her post two weeks after tendering a letter of resignation to the executives. The SRC Executives shall designate an executive to discharge the duties of the vacant post until an election is held for that post in question. The entire student body should be notified of any resignation of the executive officer five (5) days after his/her resignation. All documents of SRC in the possession of the resigned executive shall be handed to the executives after three days of resignation. In like manner, in the case of all Executives resigning in block, they should hand over to the office of the Registrar three (3) days after resignation. ARTICLE 11: SUSPENSION. A member of the SRC shall be suspended based on cases of misconduct for two weeks by more than 50% majority of members of the SRC at meeting called purposely for that. ARTICLE12: IMPEACHMENT Any student may give notice in writing addressed to the Judicial Committee to commence impeachment proceedings against any Executive Officer provided that such notice shall be authenticated by the signatures of at least ten (10) students from each level. The Judicial Committee shall within 7 days of the receipt of the notice of impeachment examine and publish its report on the issues. If there is any merit of impeachment, the report shall be submitted to the various for a forum Halls to be called for that purpose for debate/deliberations after which votes may be cast. An Executive against whom impeachment charges have been preferred shall be officially removed from office by majority of all the Halls at a meeting specially called for that purpose. A simple recorded majority of the entire membership of each Hall voting by secret simultaneously under the supervision of the Judicial Committee carries the vote. ballot, held EACH DEPARTMENT SHALL BE COUNTED AS ONE ON CONTITUENCY BASIS. ARTICLE 13: BYE-ELECTION Bye-election shall be held to fill vacancies created by virtue of any clause of this constitution without any hindrance. Any member of the SRC who wants to vie for any bye election should resign his/her post. The duration for any bye- election should be two weeks. CHAPTER FIVE ARTICLE 14: BODIES UNDER SRC The following bodies shall come under SRC: power is also vested in SRC to create standing sub - committees when necessary. The Quorum of students committee shall be half (½) of the membership. Executive Committee The Executive Committee shall be the highest body of SRC. It shall consist of The President, Vice President, General Secretary, and Treasurer. The committee shall be a policy maker and ensures the implementation of all policies based on the provision of this constitution. ARTICLE 15: Judicial Committee There shall be an independent student body known as the students judicial committee. Composition: It shall be composed of Presidents of the various Halls, and the Presidents of non-residential students. The head of the judiciary shall be called the speaker. The speaker shall be appointed by the SRC. Functions of the Judiciary Committee: The committee shall have jurisdiction over every matter relating to the interpretation of any provision in this constitution and in every matter where it is alleged that a person or a body of persons has acted ultra vires to the power conferred on him/her by this constitution. The committee shall have the mandate to resolve conflicts between students or groups of students. It shall have power to co-opt members without voting right on ad-hoc basis and to summon a student or groups of students or any member of SRC to appear before it to give evidence. The judiciary committee shall have appellate jurisdiction over all election petitions lodged with the electoral commissioner; such petitions shall be addressed with 72 hours. All impeachment procedures against a member of the executive committee of the SRC shall be brought before the judicial committee as stated in Article 12. Power vested in the judicial committee in the exercise of its function shall be subjected to the provision of this constitution, the College act and general rules and regulation of the College. Notwithstanding any provision to the contrary, the judicial committee shall where necessary recommend decisions to the appropriate College Authority to be considered for implementation.

ARTICLE 16: Social Committee The Social Committee shall consist of a representative from each Hall and non-resident student appointed by the SRC. The Social Committee shall be responsible for all entertainment organized by the SRC or the College. There should be a chairperson who shall steer their affairs and report to the President. ARTICLE 17: Academic Committee The committee shall consist of a representative from each Hall, non-resident student and from each level in the College appointed by the SRC. It shall elect from within a chairperson and a secretary. The committee shall advice SRC on students academic matters or issues, regarding the nature of the Teaching, Research and Content of Courses, conduct of examination and the availability of Books and Equipment. ARTICLE 18: Transport Committee. The mode and composition of the Transport committee shall be in the same manner as provided in ARTICLE 15 (a); that is, the Committee shall consist of a representative from each Hall, non-resident student to be appointed by the SRC. It shall be responsible for all SRC Transport arrangement in the College. Request by a student or group(s) of students for Transport shall be channeled through it but with the approval from the executive Committee of the SRC. ARTICLE 19: Electoral Commission The E.C shall consist of a representative from each Hall and a representative from non-resident students The Academic board of the College shall also appoint a representative who shall Chair the commission. She/he has the right to appoint a vice in consultation with other members. The EC shall be responsible for vetting all candidates aspiring for any office. It shall be empowered to conduct all elections, be it Referendum, General Elections, etc. of the SRC. The commission shall ensure the implementation of the Laws governing elections in the college. The EC when necessary shall make additional rules with regards to the conduct of elections. ARTICLE 20: Welfare committee There shall be a welfare committee responsible for the general welfare of the students. It shall be chaired by a Non-resident student appointed by the SRC. ARTICLE 21: Sports Committee.

The Sport Committee shall consist of a member from each Hall and a member from the non residential students appointed by the SRC. The chairperson shall be appointed by the committee members. Their aim is to organize all sporting activities of the College in consultation with the authorities of the College. The chairperson shall represent the committee at SRC meetings. He/She shall work hand in hand with the sports advisor appointed by the College. The University shall be represented in all sports related activities in consultation with the SRC. ARTICLE 22: Students Magazine Name The Students Magazine shall be called the Insight The magazine shall be published annually. Editorial Board Editorial Board shall be opened to all students in the College The membership shall not be more than nine (9) students excluding the Editorial advisors and representatives from SRC [as stated in Art. 5 (f) (I)]. Mode of election Interested students shall apply in writing to the Editorial Board. The candidates shall be interviewed or vetted by the Vice Rector, SRC representative, and the Chief Editor. Duration The term of office for the chief Editor and other members is one (1) academic year renewable through the same process as stated in Article 21 (III). Functions of the Board To solicit articles from students for the publication of the Magazine and all other related matters. Signatories to Magazine accounts. The SRC President, Chief Editor and Treasurer (SRC) shall be the signatories of the account.

Finance The account of the Magazine shall belong to the SRC. The Board shall depend upon the account and other individuals/companies for sponsorship for its annual publications. The Board shall report to the SRC after every publication and the SRC shall in turn publish it to the entire student body the financial position when the need arises. CHAPTER SIX ARTICLE 23: CLUBS AND SOCIETIES All clubs and Societies in the College shall be accordingly registered with copies of their constitutions to the office of the Registrar and the SRC Executives for approval. The SRC has the power to ban any society/club which goes contrary to the norms and regulations of the College after a thorough investigation. ARTICLE 24 SOURCES OF SRC INCOME I. All students shall pay dues annually and the amount shall be determined in consul tation with all stakeholders. II. Dues shall be included in the fees charged by the College and deducted at source. The amount shall then be worked out and paid into the SRC account. III. The SRC shall seek sponsorship from individuals, companies and corporate institutions. ARTICLE 25: Disbursements of Funds Administrative functions Miscellaneous ARTICLE 26: Accounts of SRC The SRC shall have accounts which will be different from the Magazine account. ARTICLE 27: Signatures of the Accounts The signatories shall be the SRC President, Treasurer and General Secretary. ARTICLE 28: Auditing of the Account. The account of the SRC shall be submitted to the offices of the Accountant and the Rector every semester for auditing.

The account can be called for auditing by the College Accountant and the Rector, and should be made available within a week. Officers involved can in writing ask for extension of time in case of difficulties. Failure to comply with this may lead to suspension or removal from office. ARTICLE 29: General Forum There shall be a general forum for all students every semester and any other time when need be. ARTICLE 30: AWARDS. Certificates and awards shall be presented to all SRC members on successful completion of term in office. The package shall be determined by the Rector and the Registrar of the College. ARTICLE 31: Authority of the Constitution It supersedes every rule and regulation of the SRC In the realm of conflict, it shall take precedence over everything. ARTICLE 32: Amendments Any need or call for the amendment, repeals of any provision of this constitution shall be made to the SRC through the Judiciary committee, the EC and with the approval from the Academic Board. The SRC shall set up a committee to make the necessary enquiries. For this constitution to be amended there must be a call of at least more than 50% from each level.
