1. TERMS AND CONDITIONS FOR THE SUPPLY OF STITCHED UNIFORM & UNIFORM ACCESSORIES AT IMU, MUMBAICAMPUS 1.1. Open tenders are invited by the Deputy Registrar (Admin.), IMU, Mumbai Campus, Karave, Nerul, Navi Mumbai- 400706 for and on behalf of IMU, for the supply of stitched uniform &uniform accessories to the cadets of IMU, Mumbai Campus as per attached Annexure - 1 in the technical bid of tender documents. 1.2 Tender documents consisting of Technical & Financial Bids shall be submitted by the bidders in two separate sealed envelopes, envelope - I for Technical Bid and envelope - II for Financial Bid, latest by 1330 hrs. On28/04/2017. 1.3 The technical bids of the tender shall be opened by a committee nominated by the Director, IMU, Mumbai Campus in the presence of the authorized representatives of the bidders, if present, at 1430 hrs. on28/04/2017 in the office of the Deputy Registrar (Admin.), IMU, Mumbai campus. 1.4 The technical bids, which do not contain full information and documents called for, shall be rejected. The price bid of only bidders who qualify the minimum eligibility criteria of technical bids will be opened. 1.5 The financial bids of the tender shall be opened by a committee nominated by the Director, IMU, Mumbai Campus in the presence of the authorized representatives of the bidders, if present, at 1100 hrs. on05/05/2017 in the office of the Deputy Registrar (Admin.),IMU, Mumbai Campus. 1.6 The bidders shall submit all relevant documents as required in the tender document. Duly numbered and signed on each page. Fax:022-27716805 Email: dradmin.mumbai@imu.ac.in 1.8 IMU, Mumbai Campus at its sole discretion reserves the right to extend the last date of submission of tender and the same shall be intimated to those bidders, who have purchased the tender document. 1.9 IMU, Mumbai Campus reserves the right to reject any tender without assigning any reason. IMU, Mumbai Campus shall be under no obligation to inform the bidders for the reasons of such action. 1.10 IMU, Mumbai Campus, in exceptional circumstances and at its discretion, may extend the tender due date by issuing a corrigendum. 1.11 IMU, Mumbai Campus reserves the right to annul the bidding process at any time without any liability for such annulment, without assigning any reason thereto. 1.12 IMU, Mumbai Campus reserves the right to invite revised tenders with or without amendment at any stage without any liability for such invitation and without assigning any reason thereof. 1.13 IMU, Mumbai Campus shall notify the successful bidder through Registered letter/ speed post / fax / e-mail or in person confirming that their offer has been accepted. IMU Mumbai Campus will issue the Purchase Order (PO) to the successful bidder. This PO shall indicate the items & quantity to be supplied by the bidder and the sum which IMU, Mumbai Campus shall pay to the successful bidder in consideration of the execution of the contract by them. 1.14 Upon receipt of the Purchase Order by the Contractor, he shall prepare two sets of the Agreement as per Annexure - 4 of the tender documents at the earliest without any delay and complete all the formalities and submit same to IMU, Mumbai Campus duly executed on stamp paper for value of Rs.200/- (Rupees Two Hundred only) within 07 days from the date of receipt of Purchase Order. The agreement should be submitted by the contractor along with the required security deposit. One set of the agreement will be returned to the Contractor after the signature of authorized signatory of IMU Mumbai Campus. Cost of the agreement should be borne by the successful bidder. 1.15 Estimated cost of the items including all groups is approximately Rs. 50 Lakhs. 1.16 Security Deposit: The successful bidder shall, within 07days from the date of receipt of Purchase Order, deposit with IMU Mumbai Campus a sum equal to 10% of the value of the accepted tender, in the form of Demand Draft. The security deposit amount of 10% of the contract value so deposited, will be refunded within 60 (sixty) days from the date of complete supply of all material as per tender document. In case security deposit amount fall short on subsequent order, the bidder must deposit the differential amount of Security deposit within 10 days of subsequent order. Security Money will not carry any interest. 1.17 Cancellation of order/ forfeiture of Security Deposit, Risk purchase clause: In the event of failure to deliver the materials within the stipulated date/period in accordance with the specification, IMU-Mumbai Campus reserves its right:- i) To cancel the order ii) To forfeit the security deposit iii) To procure the materials or equivalent material from alternative sources at the vendors risk, responsibility and cost. Any extra cost incurred in the procurement of the material from the alternative source will be recovered from Security Deposit/Bank Guarantee as referred to earlier and if the value of the materials under risk purchase exceeds, the amount of Security Deposit/Bank Guarantee, same may be recovered, if necessary, by due legal process. 1.18 The supplier must take the measurement of all uniform items and uniform accessories wherever required on getting the intimation from the institute over phone/writing. The supplier must attend to this call without fail within 48 hours after receiving the call. The required uniform materials are of different measurement hence the successful bidder should arrange a Tailor to take the measurement of each cadets within specified Page 4 of 33

time and make necessary arrangements to deliver the stitched uniforms within the time frame stipulated in the tender. 1.19 Within 90 days from the date of receipt of Purchase Order, the Contractor shall complete the work as specified in the tender documents and shall hand over the total items as specified in the tender documents. The measurement of fresh cadets to be taken from 15 th July to 25 July and delivery to be completed before 15 th Aug. Measurement of existing cadets to be done before 1 st June for delivery within 90days. In the event of failure to deliver or dispatch the material within the stipulated date/period in accordance with the samples and specifications IMU, Mumbai Campus would have the right to: Penalty for the delay in completion of supply/work beyond the stipulated period will be charged at the rate of 0.5% per day upto a maximum of 10% of the value of unexecuted work order and defaulter will be black listed by IMU. 1.20 There should not be any complaints from the cadets regarding quality, colour and stitching of the uniform stated in Group A. Besides items stated in Group B, C & D should also conform to desired quality, size etc. All complaints related to fitting of uniform, uniform accessories, shoes and sports items should be attended within two weeks, failing which appropriate amount will be deducted from the bill. 1.21 It is the responsibility of the supplier to take the signature of the concerned cadets to whom he has issued the stitched uniform and uniform accessories on the acquaintance roll, counter signed by the institute representative nominated by the authority. 1.22 Institute may provide storage facility, if required, for maximum period of five days after the delivery of items at site. 1.23 The supplier has to submit their bill along with acquaintance rolls duly signed by cadets and counter signed by the institute representative, only after the successful completion of work as per tender documents. 100% payment shall be made to the supplier by IMU, Mumbai Campus within 90 days after the receipt of bill. 1.24 All costs, charges and expenses, if any, in connection with the Contract as well as preparations and completions of Agreement formalities shall be borne and payable by the Contractor only. 1.25 The Contractor shall pay all taxes which he may be liable to pay to the State or Central Government or any other statutory authority under the law for the time being in force in respect of or in accordance with the execution of the contract. 1.26 Contract Period:-The Contract between IMU MC and the successful Bidder (Vendor) will be for Supply of Stitched uniform and uniform accessories for IMU, MC during the period from issue of work order to one year, extendable on, satisfactory performance, one year at a time for a maximum of 2 years, at the same quoted price, terms and conditions. In other words, the rate quoted by the Bidder should be valid for up to 2 years. 1.27 Validity of Rate:-Rate quoted and accepted should be valid for a period of two consecutive years from date of agreement and no price escalation during the contract period will be entertained. 1.28 Test/Guarantee Certificate: Manufacturer s Test Certificate (T.C.) is to be submitted along with the material. In case T.C. is not made available at the time of dispatch, a Guarantee Certificate from the supplier has to accompany the material confirming that the material has been manufactured confirming to the specification mentioned in the order. 1.29 Settlement of Disputes: The Bidder shall make request in writing to the Director, IMU, Mumbai Campus for settlement of any dispute within 30 (thirty) days of arising of the cause of dispute, failing which no disputes/claims shall be entertained by the IMU, Mumbai Campus. The decision of the Director, IMU Mumbai Campus will be final and binding on the parties. 1.30 Jurisdiction: The Court of Mumbai in the State of Maharashtra only will have the jurisdiction to deal with and decide any legal matters or disputes what-so-ever arising out of this contract. 1.31 The bidder who quoted lowest (L1) of the Grand Total (A+B+C+D) or in each individual group(a,b,c and D) of the financial bid will be awarded the contract at discretion of IMU. 1.32 IMU reserves the right to accept any bid under this tender in full or in part, or to reject any bid or all bids without assigning any reason. 1.33 The IMU shall have the right to call upon the Bidders to explain/substantiate/prove the various claims made by the Bid document and if satisfactory explanation/proof is not forthcoming, the IMU reserves the right to treat the claim as Not Proved and ignore it. 1.34 The bidder must bid for at least one group and all item in that group. In case bidder has submitted bid for few item in the group then bid for that group of the bidder will be rejected. IMU may declare L1 on the basis of each group or for all groups cumulatively at its discretion. 1.35 Bidders are not allowed to submit multiple bids nor bid through a consortium. 1.36 Bidders are not allowed to sub-contract any part or whole of this contract. 1.37 Information, references and certificates from the respective clients certifying technical, delivery and execution capability of the Bidder should be signed and the contact numbers of all such clients should be mentioned. The IMU, Mumbai Campus may also independently seek information regarding the performance from the clients. 1.38 All prices/rates in the Price Bid should be clearly written both in figures and in words. In case of a discrepancy between the prices/rates in figures and words, the prices/rates in words will be considered correct. 1.39 Bidder should avoid alterations/corrections in the prices/rates submitted by them. However, if alterations/corrections in prices/rates are in escapable each alteration/correction should be indicated both in figures and words and duly attested under the full signature of the Authorized Signatory of the Bidder. 1.40 The Bidder may furnish modes of proof other than the ones indicated but it shall be entirely up to IMU whether to accept them or not. TECHNICAL BID 2 ELIGIBILITY CRITERIA: The Bidder must possess ALL the Minimum Qualifying Criteria. If he does not possess even one of these, he shall stand technically disqualified and his bid will not be taken up for Price Bid evaluation. 2.1 (a) The bidder should submit copy of valid Trade License, PAN and Sales Tax/VAT Registration No. with the Technical bid of Tender document. 2.1 (b) The tenderer during past 3 years should have executed. i. Three similar jobs(in each of the last 3 years) costing not less than the amount equal to 40% of the estimated cost. (Mode of proof: Copy of Purchase order/contract for providing Award of Work. Copy of Completion Certificate/Final Invoice/ Letter indicating return of Security Deposit for providing satisfactory Completion of Work, should be furnished for each of the projects completed/executed during the last three years) OR ii. Two similar jobs (in each of the last 3 years) each costing not less than the amount equal to 60% of the estimated cost. (Mode of proof: Copy of Purchase order/contract for providing Award of Work. Copy of Completion Certificate/Final Invoice/ Letter indicating return of Security Deposit for providing satisfactory Completion of Work, should be furnished for each of the projects completed/executedduring the last three year) OR iii. One similar job (in each of the last 3 years) costing not less than the amount equal to 80% of the estimated cost. (Mode of proof: Copy of Purchase order/contract for providing Award of Work. 4 STITCHED UNIFORM AND UNIFORM ACCESSORIES (Specifications and additional instructions) 4.1 The list of items along with their specification is mentioned in the Annexure-1, which is attached in the technical bid of the tender documents. 4.2 The items classified as Group A, B, C and D is enclosed as Annexure 2. 4.3 The bidder must bid for all the items in a group. However, the choice of the groups is entirely up to the bidder. Bidder can bid for one group or combinations of any four groups or all the four groups. 4.4 The items supplied by the supplier may be sent to a laboratory for test and suitable action will be taken by the IMU, Mumbai Campus against the supplier for not complying with the specification against each items as mentioned in the tender documents. 4.5 The Technical Bid should not contain the Financial Bid.
