DOUGLAS COUNTY CIVIL MANDATED MEDIATION MEMORANDUM From: Judge Susanna Meissner-Cutler Division B Date: August 19, 2011 ALL CIVIL CASE, EXCEPT THOSE SPECIFICALLY EXCEPTED BY THE COURT, SHALL SET THE CASE FOR MANDATORY MEDIATION FOLLOWING THE SUMMONS RETURN AND FILING OF AN ANSWER BY THE DEFENDANT. A. The parties are ordered to set their civil case for MANDATORY MEDIATION following the Summons Return and filing of an Answer by the Defendant. B. The case shall be set for Mediation through the mediation program in the Douglas County Courthouse or through any ADR provider mutually agreed upon by the parties within 35 days of the case being at issue. C. If the case is set through the mediation program in the Courthouse, the case shall be set for a minimum two-hour session on the Court s Mediation Schedule (to be set with the Division Clerk.) 1. The parties must bring to the mediation session $60 in cash, money order or credit card only (attorney checks are permitted) to be paid to the mediator at the start of the mediation session. The mediation session may not proceed without full payment from both parties. 2. In the event the parties want to continue the mediation discussions past the two hour session, they may do so, if the mediation docket allows on that scheduled day. Each party will then be required to pay for the additional time at the end of the session at the rate of $30 per hour in 15 minute intervals, rounded up. 3. If the parties wish to continue the mediation session to another day, the mediation may be rescheduled pursuant to the Mediation Schedule (to be set with the Division Clerk), or the parties may continue with that mediator at his/her private office at the mediator s private rate, if so desired. 4. In the event a party fails to appear for the scheduled mediation, the party in attendance shall still pay the required $60 at the time of the mediation in compliance with this Order. However, the paying party may request reimbursement as a cost in the case.
5. Attorney checks may be made payable to the mediator the day of the mediation. Attorney checks issued in advance must be made payable to Elledge Group Inc. D. If a party fails to appear at the scheduled mediation date/time, sanctions including default and/or attorney fees amy result unless the parties give notice to the Court within two business days prior to the scheduled mediation that they have stipulated to an alternative ADR provider or have settled the case. E. If a party has been deemed indigent, the court may choose to order the case to mediation through a private pro bono provider or through the 18 th Judicial District s Office of Dispute Resolution where the indigent party s rate would be $10/hr and the paying party s rate would be $50/hr. E. At the conclusion of the Mandatory Mediation session, the parties are to obtain a compliance sheet from the mediator. The parties are ordered to go to the Division Clerk immediately upon completion of the Mandatory Mediation and file the compliance sheet with the court. If an alternative ADR provider is used the parties shall, within 5 days of the date of mediation, file the compliance sheet with the court. F. If the case is not resolved at the time of mediation, the parties are ordered to set the case for Trial and Pre-trial Conference (only if the case is set for jury trial or if specifically requested by the parties) If the case is set for trial, the parties are ordered to comply with this Court s Case Management Order. DO NOT LEAVE THE COURTHOUSE UNTIL YOU HAVE FILED THE COMPLIANCE SHEET WITH THE COURT AND RECEIVED APPROPRIATE DIRECTION FOR FURTHER PROCEEDINGS (IF NECESSARY) FROM THE COURT.
