LEGAL 500 APPEALS AND JUDICIAL REVIEW We are often approached by individuals who have had their application refused or delayed, and there may be an opportunity to take that refusal on appeal or judicially review the actions of the Secretary of State. The scope for unsuccessful applicants to challenge unfavourable decisions of the Home Office was dramatically curtailed by the Immigration Act 2014. Rights of appeal only remain in respect of: 1 2 3 4 The refusal of a human rights or protection claim and renovation of protection status. In some circumstances refusal of entry clearance and refusal to vary leave to remain. Refusal to issue and EEA family permit and certain other EEA decisions. Deprivation of citizenship. Where there is no right of appeal an individual may be able to apply to the Home Office for an administrative review of that decision. This review takes place on the papers and there is no opportunity for a hearing. If there is no alternative remedy available to an unsuccessful applicant they may able to apply for judicial review of the Home Office decision. immigration status for applicants outside of the normal Immigration Rules and where they would otherwise have been refused. However, there is no doubt that challenging decisions of the Home Office has become more difficult as a result of these changes. It is crucial that any application to the Home Office is carefully prepared with a view to securing an appeal right if the application is refused. BUSINESSES We have also successfully acted on behalf of businesses who have had their sponsor licence revoked, suspended, or downgraded. This is a complicated process requiring an in depth knowledge of the Home Office s policy guidance, rules and regulations. It is essential that the initial sponsor licence application is successful, as if it is refused, the Home Office may impose a six month cooling off period within which the business may not make a further sponsor licence application.
