Tender schedule I Name of work Supply of Power Tillers & Small tractors up to 40 HP Ref Agros/FMD/IMP/11-12. Dated 14-3-2011 Preamble A.P.S. Agro. Ind. Dev. Corp. Ltd. (A.P.Agros) is a State Govt. undertaking. Government of Andhra Pradesh has appointed A.P.Agros as a Nodal Agency for procurement of Power Tillers and Small Tractors(Upto 40 HP) under Farm Mechanization subsidy scheme of Department of Agriculture. The Department of Agriculture, Government of Andhra Pradesh is implementing various subsidy schemes for supplying different types of agricultural implements/machinery to the farmers in Andhra Pradesh state. A. FIRMS ELIGIBLE TO TENDER 1. Firms whose models are approved by Ministry of Agriculture, Government of India up to the latest eligibility list need apply. 2. The tenderer(s) shall have a full fledged workshop with sufficient technical personnel and dealers net work to attend after sales service. 3. Tenderer(s) who are bidding for power tillers have to handover one sample piece of each tiller quoted by them in the tender schedule to our Regional Manager, Chintal, Hyderabad under proper acknowledgement. The tenderers who have not submitted the sample piece along with tender document will not be considered for price bid opening 4. The firm shall have VAT(TIN) Registration and PAN number. B. INSTRUCTIONS FOR SUBMISSION OF TENDER SCHEDULE 1. The Tenderer(s) shall submit Technical Bid with all documents indicated in Annexure-I in a separate sealed cover duly super scribing Technical Bid for power tillers and small tractors(upto 40 HP) and Price Bid as per Annexure II in a separate sealed cover duly super scribing Price Bid for power tillers and small tractors(upto 40 HP) with name and address of the tenderer. Both 3

covers are to be placed in a third cover along with covering letter and EMD draft as stipulated under Item No.2 of the Instructions for submission of Tender Schedule duly super scribing Tender Schedule for power tillers and small tractors(upto 40 HP). 2. Earnest Money Deposit (EMD) for an amount of Rs. 1.00 lakh (Rupees one lakh only) shall be paid in the form of Demand Draft drawn in favour of A.P.S.A.I.D.C. Ltd., payable at Hyderabad along with a covering letter. Tenders without EMD will be rejected. The firms who have paid the EMD in previous tender need not pay the EMD again and can submit the payment particulars of previous EMD viz., DD number, date, amount, name of the Bank 3. The tenderer(s) shall submit duly notarized declaration along with Tender schedule as per the proforma furnished under Annexure-III hereto on Rs.100/- Non-Judicial stamp paper. 4. The last date for submission of Tender schedule is up to 2.30 pm on 30.3.2011. The Technical Bids will be opened at 3.30 p.m on the same day. 5. Pre-Bid meeting will be conducted on 28.3.2011 at 2.30 p.m at the Regd. office with the prospective bidders. 6. The EMD of un-successful tender(s) shall be returned on finalization of applications. 7. The EMD of successful tender(s) shall be retained by the Corporation and refunded only after satisfactory completion of the contract. The EMD shall be adjusted against the Performance Guarantee for the successful Tenderer. This deposit will not carry any interest. C. GENERAL TERMS AND CONDITIONS 1. Negotiations will be held as per the decision of the Technical Committee at the Regd. Office of the Corporation. The aim is to reach agreement on all the points and sign a contract. 2. The agreement period will be up to 31.3.2012 from the date of signing the agreement. No Escalation charges will be paid for supply of power tillers and small tractors during the agreement period. 3. The supplies made shall be invoiced on VAT invoice with serial No. of invoice printed on it. No invoice other than Tax invoice will be accepted. VAT applicable, if any, shall be clearly mentioned in the Tax invoice. Invoiced amounts will be paid to the suppliers. 4. Performance Guarantee deposit of Rs.2.00 lakhs (Rupees two lakhs only) should be paid along with agreement in the shape of Demand Draft drawn in favour of A.P.S.A.I.D.C Ltd., payable at Hyderabad. This deposit will not carry any interest and shall be paid before entering into contract agreement. The firms who have paid the EMD in previous tender need not pay the EMD 4

again and can submit the payment particulars of previous EMD viz., DD number, date, amount, name of the Bank 5. No dealers or traders are allowed to participate in the tender. 6. The manufacturers, who are submitting their tender, should indicate the details of dealers / distributors in the Tender. The authorized dealer/distributor of the successful applicant will have to pay the performance Guarantee deposit of Rs. 25,000/-(Rupees Twenty five thousand only) to empanel their firm as authorized dealer/distributor before entering into contract agreement. The name of the dealer/distributor once included in the approved list will not be deleted until completion of the financial year. 7. Agros will be charging an additional 4% as service charge on the final price quoted by the tenderer. The total selling price including the service charge should not exceed the MRP of the equipment quoted. 8. a. Performance guarantee produced by the successful tenderer and dealer/distributor shall be forfeited & alternate arrangements shall be made, if the firm does not fulfill the obligation of supply of equipment as per orders / specification / quality and alternate arrangements will be made for procurement of such equipment and any additional cost incurred in this regard will be recovered from the concerned firm. b. The responsibility of quality and quantity of the power tiller and small tractors supplied lies with supplier only. 9. The approved firms shall supply the ordered equipment etc. as per terms and conditions within the stipulated time indicated in the purchase order placed from time to time by Agros to the beneficiary at Mandal Headquarter and obtain acknowledgement from the concerned. They shall also ensure that all the components shall be made available through dealer s network at least for a period of three years from the date of supply of the unit on payment basis. 10. The equipment supplied must be covered with warranty for one year from the date of supply against any defective manufacture/workmanship etc., Repairs / Replacements / servicing shall be attended free of cost within the warranty period. 11. If the supplying firms fail to supply the equipment within the scheduled time i.e. 21 days from the date of receipt of purchase order, the performance Deposit shall be forfeited besides initiating action as per procedure. 12. Liquidated damages will be levied at the rate of 0.5% of the total value of work per week up to a maximum of 5% in case of default in the supply as per schedule. 13. The supplier has to show the demonstration of the machine to the farmer, before taking signature from the farmer on Utilization Certificate. The firm has to educate the farmer on do s and don ts of operation of machinery. The 5

firm should submit the utilization certificate to the local Agros Sales Executive within one week after delivery of the equipment. The Corporation is not responsible for delayed subsidy payments, if the UCs are not submitted in time by the suppliers. 14. The acknowledgement (Proof of Delivery) along with photograph and other required documents for the equipment delivered should be signed by the beneficiary and countersigned by the Mandal Agricultural Officer for all the equipment. Equipment should not be delivered without valid purchase order of AGROS. 15. The loading and un-loading charges, if any, should be borne by the supplier only. 16. Random inspection of all equipment distributed under subsidy schemes will be conducted by suitable committee/team as appointed by the Government before/ after the equipment is distributed to the farmers. 17. The manufacturer shall provide detailed operational and maintenance manuals (in the local language) at the time of supply of the equipment and awareness should be created in beneficiaries to follow the instructions. The firm shall also supply two copies of such operational and maintenance manuals to the Corporation. 18. A metal/aluminum sheet (Size 4 x 2 ) shall be fixed on the purchased equipment in a prominent place with the following details in Telugu must be affixed with the following details. The Engine & chassis.no. which is indicated in the equipment must also be mentioned in the supply order 19. A.P State Agro Industries Development Corporation Limited reserves the right to award the tender either in part or full or to empanel on rate contract or follow any other suitable procurement procedure. AP Agros at its sole discretion and without assigning any reason thereof, reserves the right to accept / reject any or all bids at any stage of the tender process. 6

20. In the case of power tillers A.P State Agro Industries Development Corporation Limited reserves the right to empanel similar models (having similar technical specifications) under one rate contract. 21. In case of any dispute or difference arising out of the agreement between the two parties relating to any aspect of the agreement, the parties should attempt to settle the dispute through mutual and amicable discussions. If the dispute is not settled through such discussions, the matter shall be referred / settled as per provisions of arbitration & conciliation Act.1996. 22. It is further to be agreed by both the parties that all differences and disputes if not resolved as above, shall be got remedied through the Court of Law of Hyderabad jurisdiction only. 23. Tender can be rejected if at any stage of the procurement process, it comes to knowledge that any applicant(s) is involved in any fraudulent practice or misrepresentation of the facts or tried to influence the selection process or indulged in any corrupt activities in competing with others. 24. The manufacturer shall be liable for blacklisting and further prosecution, if they fail to adhere to the above conditions. D. TERMS OF PAYMENT 1) Payment of non-subsidy shall be made within 15 days after production of proof of delivery signed by the beneficiary and countersigned by the Agriculture Officer along with invoice about supply of equipment in the presence of Mandal Agricultural Officer. 2) Subsidy amount shall be released subject to receipt of funds from Commissioner & Director of Agriculture and after submission of utilization certificates signed by the beneficiary and counter signed by the Mandal Agricultural Officer along with photograph as required by Department of Agriculture and if there is no complaint in functioning of machinery. If there is any complaint, the payment will be made after attending to the complaints and rectification of defects. NOTE Any changes in terms of payment will be intimated to suppliers as per Commissioner & Director of Agriculture guidelines. PLACE DATE SIGNATURE OF THE TENDER WITH SEAL 7
