One Nation Your Story Contest Official Rules. NO PURCHASE NECESSARY TO ENTER OR WIN. 1. Contest Submission Period: The contest submission period starts at 5:00pm Pacific Standard Time ( PST ) on 5/8/14 and ends at 11:59:59 pm ET on 7/18/14 (hereafter, Contest Submission Period ). 2. How To Enter the Contest: To participate in the One Nation- Your Story Contest (the Contest ), visit www.raiders.com/onenation during the Contest Submission Period, complete the contest entry form, check the box expressly agreeing to the terms and conditions of these Official Rules, and submit a video in up to three (3) minutes in length depicting your story. The video, entry form, and express agreement to be bound by the terms and conditions of these Official Rules are hereafter collectively referred to as an Entry or Entries and each individual submitting a valid, complete Entry is referred to herein as an Entrant. Incomplete Entries, including Entries where individuals have not expressly and effectively agreed to be bound by the terms and conditions of these Official Rules shall be void, shall not be eligible for the contest and shall not be eligible to win any prize. You may enter as often as you wish, however each Entry must be different and original. Modification of an existing work does not qualify as different or original. All Entries must meet the Contest Entry Requirements set forth below. Entries must be received during the Contest Submission Period and no later than 11:59:59 pm ET on 7/18/14 to be eligible. 3. Contest Entry Requirements: Video must (i) be original, on which no image editing software has been used; (ii) be taken and/or created by you; and (iii) only include friends, family members, or other individuals for whom you have secured legal permission to use their image and likeness and submit it in an Entry in this Contest. To the extent the story of any individual under the age of 18 is told in any Entry, the parent or legal guardian of the individual depicted in the Entry must be the Entrant. Video must be no more the three (3) minutes in length, in a 3GP, AAC, AVI, FLV, MP4 or MPEG-2 file not exceeding 1 GB in size. To be eligible, any Entry (and all individual components therein) cannot have been previously published or submitted in any competition or have won any prizes or awards, and must be (i) about yourself or your family only; (ii) complete, (iii) in English, and (iv) your original creation and solely owned by you. In addition, to be eligible, Entry must not include any third party packaging, logos or any other third party intellectual property or general property other than NFL Team names, logos or slogans (hereafter, Permitted Marks ), unless requisite permission has obtained prior to submitting the Entry. Entry cannot defame or invade publicity and/or intellectual property rights or the privacy of any person, living or deceased, use any individual s image or likeness without permission, or infringe upon any proprietary or other rights of any person or party. Entry may also not contain, as determined by the Oakland Raiders ( Raiders ) in its sole discretion, any content that is offensive, profane, violent, derogatory, sexually explicit or suggestive, or pornographic, contains nudity; promotes alcohol, illegal drugs, tobacco, firearms/weapons (or use of any of the foregoing); promotes any activities that may appear unsafe or dangerous; promotes any particular political agenda or message; is obscene or offensive; endorses any form of hate or hate group; defames, misrepresents or contains disparaging remarks about other people or companies; contains trademarks, logos, or trade dress (such as distinctive packaging or building exteriors/interiors) owned by others, other than as outlined above; contains any personal identification (other than as provided in the registration form); contains materials embodying the names, likenesses, or other indicia identifying any person, including, without limitation, celebrities and/or other public or private figures,
living or dead, without requisite permission; contains look-alikes of celebrities or other public or private figures, living or dead; communicates messages or images inconsistent with the positive images and/or good will to which Raiders wishes to associate; and/or violates any law. Entries deemed by the judges, in their sole discretion, to be immoral, obscene, profane or not in keeping with Raiders image or in violation of these Official Rules will be void. In the event of non-compliance with any requirements specified herein or with any of the terms of these Official Rules, Entry will be void. By entering the Contest, each Entrant warrants and represents that his/her Entry is original, has not been previously published or won any award, does not contain any material that would defame or otherwise violate or infringe upon the rights of any third party, including patents, copyrights, trademarks or rights of privacy or publicity, and will not violate any federal, state or local laws or ordinances. Entrants further warrant and represent that they have secured the requisite consent from any third party referenced in their Entries. Incomplete Entries and/or Entries containing inaccurate entrant information will be disqualified at Raiders sole discretion. The use of script, macro or any other device to automate or subvert the entry process is prohibited and all such Entries and Entries made by any other means which subvert the entry process will be void. In the case of a dispute as to the Entrant who submitted an Entry, Entry will be deemed made by the person named on the applicable registration form (regardless of whether that is the name of the authorized account holder of the email address from which said Entry was submitted) and he/she must comply with these Official Rules. Other than as otherwise specified herein, neither Raiders, nor anyone acting on its behalf, will enter into any communications with any Entrant regarding this (except for the purposes of notifying the Finalists and winners) or acknowledge any Entry (or portion thereof) received. Any Entry not meeting all Entry requirements stated herein will be void. If the Entry contains any material or elements that are not owned by the Entrant (with the exception of Permitted Marks), and/or which are subject to the rights of third parties, the Entrant is responsible for obtaining, prior to submission of the Entry, any and all releases and consents necessary to permit the use and exhibition of the Entry by Raiders in the manner set forth in these Official Rules, including, without limitation, name and likeness permissions from any person who appears in or is identifiable in the Entry (and, if such person is a child or legal ward of Entrant, Entrant will be required to provide their consent in a form acceptable by Raiders). Raiders reserves the right to request proof of these permissions in a form acceptable to Raiders from any Entrant at any time. Failure to provide such proof may, if requested, render Entry null and void. By submitting an Entry, entrant warrants and represents that he/she and any persons appearing or who are identifiable in the Entry consent to the submission and use of the Entry in the Contest and to its use as otherwise set forth herein. Entrant recognizes that all of the right, title, and interest in the Permitted Marks as well as all derivative works created using the Permitted Marks (including the Entry) shall vest exclusively in Raiders, and Entrant will not have or take any action that might harm or adversely affect such rights. All Entries shall become sole property of Raiders when submitted. No right, title, or interest in and to the Permitted Marks except for the limited license granted to entrant in these Official Rules is transferred or created. Entrant shall not be permitted, by these Official Rules or otherwise, to use any names of NFL players, NFL stadiums or employees or officers of the NFL or any NFL team. By submitting an Entry, Entrant hereby grants the the Raiders, the National Football League, and each of their respective past and present partners, limited partners, owners, entity owners (and the current and former officers, directors, shareholders, partners, members, limited partners, assigns and employees of any owners or entity owners), members (including all NFL
member clubs), employees, agents, attorneys, directors, officers, shareholders, contractors, successors, assigns and insurers (collectively Released Parties ), without any limitation of any other rights granted herein, permission for the Entry to be posted on raiders.com, togetherwemakefootball.com, NFL.com and any other websites as determined by Raiders. Entrant agrees that Released Parties are not responsible for any unauthorized use of Entries by third parties. Released Parties do not guarantee the posting of any Entry and may elect not to post the Entry at all or remove a posted Entry at any time. By submitting an Entry, Entrant acknowledges and agrees that Raiders may obtain many submissions under this Contest and that such Entries may be similar or identical in theme, idea, format or other respects to others submitted under this Contest and/or other Contest staged and/ or sponsored by the Raiders, or to other ideas conceived by or provided to Raiders and Entrant waives any and all claims Entrant may have had, may have, and/or may have in the future, that any Entry and/or other works accepted, reviewed and/or used by the Raiders (or its designees) may be similar to his/her Entry. Except where prohibited by law, each entrant acknowledges and agrees that the Raiders does not have now, nor shall it have in the future, any duty or liability, direct or indirect, vicarious, contributory, or otherwise, with respect to the infringement or protection of any copyright in and to Entrant s Entry or any other right related thereto. 4. Entry Judging: Round 1 of Judging: All eligible video Entries will be grouped and judged against each other based on the following criteria by Raiders: 1) Storytelling; Does the Entry tell a story that captivates its audience; 2) Visual Artistry/Originality; For Video Entries: Does the video showcase the Story artistically?; 3) Passion; Does the Entry stir emotion in those who watch/see it?; 4) Relevance; Does the Entry meet the criteria of the Story?; and 5) Sense of Community; Is the Entry something that people will want to share with their digital community?.the five (5) Video Entries with the highest scores, as determined in Round 1 by the judges in their sole discretion, will advance to Round 2 judging. Raiders reserves the right to advance fewer than five (5) Entries to Round 2 if, in their sole discretion, they do not receive a sufficient number of eligible and qualified Entries in each or both categories. Round 2 of Judging: During Round 2 of judging, the top five (5) Entries will be judged based on the following criteria: 1) Storytelling; Does the Entry tell a Story that captivates its audience?; 2) Visual Artistry/Originality; Does the video showcase the Story artistically?; 3) Passion; Does the Entry stir emotion in those who watch/see/read it?; 4) Relevance; Does the Entry meet the criteria of the Story?; 5) Uniqueness; Does the Entry tell a one of a kind story? and 6) Sense of Community; Is the Entry something that people will want to share with their digital community? The five (5) Video Entries with the highest ranking during Round 2, as determined by the judges in their sole discretion, will win a prize according to their ranking. In the event of a tie during Round 2 of judging, the tied Entries will be re-judged based on: the degree of positive influence the Raiders had on the entrants story. By participating, entrants agree to abide by these Official Rules and the decisions of the Raiders and judges, which are final and binding in all matters relating to this Contest. Upon verification of the Finalists, representatives of the Raiders will produce a video conveying each individual Finalist s Story as submitted in their Entry (hereafter, Finalist Entry ). Each Finalist Entry will be the same length. The Raiders will allocate resources to each Finalist Entry in a fair and equitable manner at its discretion. Finalists agree that the Raiders shall have full
creative authority over the development and creation of the Finalist Entries and that Finalists will not have the opportunity to review or request revisions of the Finalist Entry. 5. Finalist Notification: Potential Finalists will be selected on or about 7/25/14 and will be notified by telephone, email and/or overnight mail. Potential Finalists will be required to execute and return an Affidavit of Eligibility, Liability and (where legal) Publicity Releasewithin two (2) days of date of issuance of notification. Failure to comply may result in disqualification and, based on the criteria described above and time permitting, selection of another Finalist to compete. In addition, at the discretion of the Raiders, potential Finalist(s) may be disqualified if not eligible based on the eligibility requirements set forth above. Noncompliance with these Official Rules, the inability to immediately contact a potential Finalist, the failure to complete and return requested documentation in a timely manner, or any notification being returned as non-deliverable will result in disqualification and, at Raiders s discretion, an alternate Entry will be chosen. Finalist status is subject to verification of eligibility and compliance with these Official Rules. Finalists Entries will be posted on www.raiders.com/onenation during the Contest as outlined below. 6. Prizes: One (1) Grand Prize: A five (5) day/four (4) night trip for winner and three (3) guests to attend the Raiders vs. Dolphins International Series game, currently scheduled to take place in London, England on September 28, 2014. Trip includes all of the following: a) round trip coach air transportation from a major U.S. gateway airport nearest winner s residence in the U.S. to destination city; b) one (1) standard double occupancy hotel accommodations (one (1) room) for four (4) nights; four (4) tickets to the Raiders vs. Dolphins game at Wembley Stadium. Approximate Retail Value ( ARV ) = $20,000 of Grand Prize package. Actual prize value may vary based upon location of winner s residence. Any difference between stated value and actual value will not be awarded. Trip must be taken on dates designated by Raiders or prize will be forfeited in its entirety and, at Raiders s discretion, awarded to an alternate Entrant. Travel and accommodation restrictions and other restrictions may apply. Winner and his/her guests must travel together on same itinerary and are responsible for obtaining all required travel documents. Released Parties are not responsible for travel delays or cancellations. In the event Winner cannot obtain required travel documents or clearances, Winner will forfeit the prize and no substitute prize shall be awarded to Winner. In the event the International Series game is postponed and rescheduled, the trip will be rescheduled. In the event the International Series game is postponed and not rescheduled, no compensation or substitution for such portion of the prize will be provided. Winners and applicable guests must comply with all venue rules and regulations. Failure to do so may result in forfeiture of such portion of the prize and removal from event. Released Parties reserve the right to remove or to deny attendance to any winner and/or guest who engages in a non-sportsmanlike or disruptive manner, or behave in any way that is annoying, abusive, threatening or harassing any other person at the International Series game. The tickets are subject to the terms and conditions specified thereon. If unused, tickets cannot be returned, refunded or exchanged for cash value or substitute tickets. One (1) Second place prize: Twelve (12) suite tickets and three (3) parking passes to one Raiders home game in 2014, selected at Raiders discretion. One (1) Third place prize: Four (4) club tickets and one (1) parking pass to one Raiders home game in 2014, selected at Raiders discretion. One (1) Fourth place prize: Four (4) general admission tickets and one (1) parking pass to uponone Raiders home game in 2014, selected at Raiders discretion. One (1) Fifth place prize: One (1) autographed Raiders football helmet. Autograph shall be de-
termined in Raiders discretion. 7. Eligibility and Liability: Contest is open to legal U.S. residents over the age of eighteen (18) who fully complete an Entry, including clicking the box expressly agreeing to be bound by the terms and conditions of these Official Rules. Employees, officers and directors of The Oakland Raiders, Raider Image, LLC, or their respective affiliates, officers, directors, or their immediate family members are excluded. Void where prohibited by law. By submitting an Entry or accepting any prize, all Entrants and Winners expressly agree to forever waive, release, discharge, and covenant not to sue the Oakland Raiders ( Raiders ) and all Released Parties of, for and from any and all claims, debts, liabilities, demands, obligations, costs, fees, expenses, actions and causes of action whatsoever, of every nature, character and description (collectively, Claims ), known and unknown, including, but not limited to, all those arising out of or in any way related to the Contest; these Official Rules; Entrant s Entry; any video submitted; any individual or other content depicted in any video; the negligence of Raiders or any of the Released Parties; the acceptance, possession, misuse or use of any Prize; any travel related to any prize; any presence in London or at O.Co Coliseum related to any prize; and any participation in the Contest. By submitting an Entry or accepting any prize, each Entrant and Winner represents and warrants that he or she owns and/or has the authority to release the Claims stated herein expressly agrees to waive the provisions of Section 1542 of the California Civil Code which provides: A general release does not extend to claims which the creditor does not know or suspect to exist in his or her favor at the time of executing the release, which if known by him or her must have materially affected his or her settlement with the debtor. Further, by submitting an Entry or accepting any prize, all Entrants and Winners expressly agree to at all times defend, hold harmless, and indemnify the Raiders and all Raiders Related Parties from and against any and all Claims of any kind or nature whatsoever (including reasonable attorneys fees and disbursements) arising out of or in any way related to the Contest; these Official Rules; Entrant s Entry; any video submitted; any individual or other content depicted in any video; the negligence of Raiders or any of the Released Parties; the acceptance, possession, misuse or use of any Prize; any travel related to any prize; any presence in London or at O.Co Coliseum related to any prize; and any participation in the Contest. Raiders are not responsible for incorrect or inaccurate entry information whether caused by technical difficulty or human error, which may occur in the processing of the entries. Raiders reserve the right to, in its sole discretion, cancel, modify, or suspend the Contest at any time. Raiders also reserves the right to substitute any similar prize or a prize of equal or greater value for any prize listed in these Official Rules or any other communication regarding the Contest and reserves the right to revoke the prize at any time, if the Entrant acts in a manner that is, in the Raiders sole discretion, offensive, harassing, threatening, repugnant, or violent at any time in connection with the Contest. NO PURCHASE IS NECESSARY to enter the Contest or be eligible to win any prize. Entrants need not be Raiders season ticket holders or customers to be eligible to win any prize. 8.
