The Cities denied the Application on the dates shown on the resolutions attached to this Petition as Exhibit A. This petition is timely because it is being filed within 30 days of each City's respective final decision.l In support of this Petition and Motion, SPS respectfully shows the following: 1. Jurisdiction The Commission has jurisdiction over this matter under 14.001, 32.001, 33.051, 33.053, 33.054 and 36.001 of the Public Utility Regulatory Act ("PURA"),2 governing appeals of decisions of a municipality's governing body. II. Request for Review and Consolidation On February 16, 2016, SPS filed an application to change rates with the Commission and with the municipalities in SPS's Texas service territory that have retained original jurisdiction over SPS's rates within their municipal limits, including the Cities named above. The Cities have passed resolutions on the dates shown thereon denying SPS's Application. SPS therefore requests that the Commission exercise its appellate jurisdiction in the matter under PURA 33.051 to conduct a de novo review of the resolutions denying the Application, consolidate the ' Tex. Util. Code Ann. 33.053(b) (West 2007 & Supp. 2015). 2 Tex. Util. Code Ann. 11.001-66.016 (West 2007 & Supp. 2015). appeal of these resolutions with this rate case, and fix the rates or interim rates that the Cities should have fixed by approving SPS's Application. III. Conclusion SPS respectfully requests that the Commission review the actions of the Cities, consolidate this Petition with this rate case, and grant SPS the relief requested in the Application. On February 16, 2016, Southwestern Public Service Company (SPS) filed its Statement of Intent and Application for Authority to Change Rates (application) with the City. The application seeks authority for new base rate tarfs. 2. The Council has reviewed SPS's application. On MARCH 10 2016, the City held a hearing at which it considered SPS's application. 3. SI'S's proposed tarfs should be considered on a Texas retail service territory wide basis. Consequently, based upon these findings,of facts, NOW, THEREFORE BE IT RESOLVED by the CITY Council of the CITY of Rc7PESUILLE that SP Ss application is denied in order to enable an appeal that will result in a decision establishing unorm system-wide rates throughout SPS's Texas retail service territory.
