1. Brief description and Mechanism of Yuttha Medai All Stars Most Popular Duo Viewers Choice. i. The Yuttha Medai All Stars Most Popular Duo Viewers Choice Award Voting ( Voting ) is organized by Measat Broadcast Network Systems Sdn Bhd ( Astro ) for its programme known as Yuttha Medai All Stars ( Programme ) where Voters (as defined under 2a(iii) below) will vote for contestant(s) of their choice. ii. iii. iv. Yuttha Medai All Stars is a show which presents 12 celebrities in a duet dance competition. The show will be aired on Astro Vinmeen HD every weekend from 1 st February 2014 to 22 nd March 2014. On the 7 th week, 8 th March 2014, 5 pair of contestants will be selected to perform in the Grand Finals and one of the team will stand a chance to win the Viewers Choice Most Popular Duo Award. Viewers will be given a chance to vote for their favorite contestant(s) as the winner of the Viewers Choice Most Popular Duo Award via SMS and online voting service. The winner for the Viewers Choice Most Popular Duo Award shall be determined solely by online and SMS voting ( the voting ). The winner will be announced during the telecast of the Grand Finals. In the event of a tie, the judges of Yutta Medai All Star shall determine which Contestant will be crowned as the winner for Most Popular Duo. 2) Voting Mechanics and Eligibility a) Online Voting i. Profiles/details of the Grand Finalists are made available by ASTRO on the official website www.astroulagam.com.my/yutthamedai, Facebook page and/or other ASTRO Facebook page/website (as the case may be) during the Online Voting Period (as hereinafter defined) to enable the public to vote for their favorite groups ( Online Voting ). ii. The Online Voting shall be held from 12.00 am on 9 th March 2014 to 22 nd March 2014, upon host announcement or such other time as may be determined by ASTRO ( Online Voting Period ) at its sole and absolute discretion. iii. The Online Voting is open to citizens of Malaysia of all ages ( Voters ) provided always that any Voters under the age of eighteen (18) years must seek parental and/or guardian approval before participating in the Online Voting. ASTRO considers it the responsibility of parents and/or guardian to monitor their children s (who are below the requisite age) participation in the Online Voting. iv. Voters may cast their vote as follows: b) SMS voting 1. Go to the Programme s official website at www.astroulagam.com.my/yutthamedai. 2. At the official website, Voter will need to click on the Facebook tab to login with their own Facebook account before voting for the nominees; 3. Users/Voters will be allowed to view the profiles of all finalist during the Online Voting Period; 4. Each Voter will only be allowed to vote once per day for his/her favourite group. 5. The total number of Votes will be calculated by ASTRO and verified by an auditor appointed by ASTRO; and 6. The daily tally of votes in each category will be made available on the official website and updated regularly on the FB Page for the public s reference. Page 1
i. The Voting will be held from 12:00 am, 9 th March 2014, to 22 nd March 2014, upon host announcement ( Voting Period ). Astro reserves the right to change the Voting Period at its own discretion. ii. Entries received after the Voting Period shall not be counted for the Voting Service. iii. The Voting is open to subscribers of prepaid and post-paid services of Maxis, DiGi and Celcom providing Short Messaging System ( SMS ) services in Malaysia. iv. To enter the Voting, the voter must complete the following SMS commands for the voting to be successful ( Voting Entries.) v. Voters can submit their votes via SMS in the following manner : (1) Single vote Voters must key in YM<space><CONTESTANT CODE > and send it to 32777. Eg. YM 01 and send to 32777. 1. Charges Standard Terms and Conditions Online Voting 1.1 Online Voters votes will not be subject to any charges. SMS Voting 1.2 Each Voting entry sent by the voter shall be subject to a premium charge of RM0.50 per vote. For the sake of clarify, in the case of bulk voting, if the voter makes 5 votes (VS5), the premium charge will be RM2.50. 1.3 These charges will be in addition to the standard fee charged by the Voter s respective telecommunications service provider. 1.4 If a SMS sent is not valid, the SMS Voter will be notified by his/her telecommunications service provider via SMS. Each of such SMS will be charged RM0.30 by the SMS Voter s telecommunications service provider (save for Maxis users). 1.5 Voters shall be solely responsible for all charges and costs incurred as a result of his/her participation in the Voting including (without limitation) all charges imposed by the respective telecommunications service provider. 2. Voting Entries & Eligibility 2.1 Each vote shall be deemed as a voting entry by the Voter ( Voting Entry ) or ( Voting Entries ) (hereinafter Voter shall mean both SMS Voter and Online Voter). SMS Voters can send in as many Voting Entries as they wish during the Voting Period. However, Online Voters are only allowed to vote for any or all nominees once per day during the Voting Period. 2.2 The voter must ensure that their votes are complete and accurate. Astro shall have the right to disqualify any Voting Entries which are incomplete, invalid or not made in accordance with the Terms and Conditions herein. 2.3 All votes must be submitted in the language specified. Votes in any other languages will be rejected by Astro. 2.4 Voters under the age of eighteen (18) must seek parental and/or guardian approval before participating in the Voting. Astro considers it the responsibility of parents and/or guardian to monitor their children s (below the requisite age) participation in this Voting. 2.5 Where applicable, voters must obtain consent from the bill payers before participating in the Voting. Payment shall be made irrespective of whether such SMS/votes were authorized by the bill payer. For the purposes herein the term "bill payer" shall mean the individual, company or entity specified in the registration or subscription form whose application for the relevant telecommunication service has been approved and accepted by the telecommunications service provider it subscribes to. Astro will not entertain any complaints (whether made orally or in writing) with respect to such unauthorized SMS/votes made by voters. Page 3
3. Proof of Receipt 3.1 Proof of voting entry sent by a voter does not constitute proof that the voting entry was received by Astro. 4. Use of Mobile Numbers 4.1 The voters acknowledge and consent that Astro and/or its affiliates reserves the right to send informational and/or promotional SMS messages to the voters. 4.2 If a voter does not wish to receive any informational and/or promotional SMS messages from Astro, the voter must contact Astro s call centre at 1 300-82-383 to discontinue the aforesaid message service. 5. Adherence to Voting Terms & Conditions 5.1 All Voters shall be required to adhere to these Online and SMS Voting Terms and Conditions including any changes made thereto. Astro reserves the right to disregard the SMS or the Online Voting Entry, in the event any of the Online and SMS Voting Terms and Conditions and/or Astro Website Terms of Use and Notices are not adhered to. 6. Variation to the Terms & Conditions 6.1 Astro reserves the right to change, amend, delete or add to these Online and SMS Voting Terms and Conditions without prior notice at any time and the voters agree that he shall be bound by such changes. 7. Exclusion of Liability 7.1 Astro will not be responsible or liable for: 7.1.1 any problem, loss or damage of whatsoever nature suffered by any party due to any delay and/or failure in receiving and sending a SMS as a result of any network, communication or system error, interruption and/or failure experienced by the participating telecommunication service providers and/or by Astro and/or resulting from participation in the Voting howsoever arising. In the event of such error, interruption and/or failure, Astro shall not be responsible or liable for any failure by any voter to participate in the Voting at any time. 7.1.2 any problem, damage or loss of whatsoever nature suffered by the voter or their authorised representatives resulting from their participation in the Voting. 7.1.3 any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, destruction, alteration of, or unauthorized access to entries, or entries lost or delayed whether or not arising during operation or transmission as a result of technical faults, server functions, virus, bugs or any other causes. 7.1.4 any other errors, acts or omissions by the participating telecommunication service providers. 8. Disqualification 8.1 Without prejudice to any rights which Astro may have in law, Astro reserves the right at its sole discretion to disqualify any voter that it determines to be tampering with the entry Page 4
9. Suspension process or the operation of the Voting, acting in breach or potential breach of these Online and SMS Voting Terms and Conditions. 9.1 The organizer further reserves the right to cancel, terminate, modify, suspend or delay the Voting in the event of unforeseen circumstances beyond its reasonable control or for any reasons whatsoever at the sole and absolute discretion of the organizer. 10. Governing Law 10.1 These voting Terms and Conditions shall be construed, governed and interpreted in accordance with the laws of Malaysia. 11. Astro s Decision 11.1 All decisions made by the Organizer pertaining to all aspects of the Voting including without limitation the process and manner the votes are counted and vote results shall be final and no correspondence shall be entertained.
