Froderman and Barbara Y. Froderman the option to build condominiums on lots numbered 32, 33, 34, 35 and 37 as herein described. RECITALS WHEREAS, lot owners Norman B. Froderman and Barbara Y. Froderman are desirous of having the option of building condominiums on lots numbered 32, 33, 34, 35 and 37; and WHEREAS, lots numbered 32, 33, 34, 35 and 37 are currently subject to the Protective Covenants, Lakewood Subdivision Plat 18, Riley Township - Vigo County, Indiana (hereinafter referred to as "Covenants", which are on file and of record in the Office of the Recorder of Vigo County, Indiana, as Instrument No. 2007015944; and WHEREAS, the purpose of this Amendment is to clarify that the proposed condominium use on lots 32, 33, 34, 35 and 37 is either not prohibited by the covenants or in the alternative hereby amends the covenants to allow such proposed condominium use by Norman B. Froderman and Barbara Y. Froderman thereby preventing any disputes or questions which may arise concerning the restrictions found in said covenants as they may be construed or interpreted to apply for the possible construction of condominiums on lots numbered 32, 33, 34, 35 and 37; and

WHEREAS, the covenants make provision for the modification of said covenants by written agreement of a majority of the current record owners of the lots subject to the covenants. NOW, THEREFORE, we the undersigned being all of the owners of the Lakewood Subdivision described in Instrument No. 2007055944 on file and of record with the Office of the Recorder of Vigo County, Indiana (hereinafter referred to as "owners" now hereby agree that Norman B. Froderman and Barbara Y. Froderman's possible proposed construction of condominiums on lots numbered 32, 33,34, 35 and 37 is not prohibited, or in the alternative, hereby amend the covenants to specifically allow for the construction of condominiums on said lots 32, 33, 34, 35 and 37 as well as single family dwellings. This Agreement is binding on the heirs, successors, and assigns of the parties hereto.
