The movant is the holder of a promissory note secured by a deed of trust secured by the Ellsworth Sewell s real property located at 3103 Good Hope Avenue, Unit S-202, Temple Hills, MD 20748. A co[y of the note, deed of trust and assignment are attached hereto. 2. The movant, Nationstar Mortgage LLC d/b/a Mr. Cooper, received notice of the condemnation of the Lynnhill Condominium, but has no record of receiving notice of the bankruptcy filing of the condominium association or any of the pleadings in this matter. The reason may be that none of the pleadings reference the borrower s loan number or reference the borrower s name on the face of the pleading so even if Nationstar was sent pleadings or notices in this matter, they most likely were not able to be associated with the borrower s loan. 3. Mr. Sewell s loan is currently in default and is due for May 1, 2017, with a total payoff of over $65,000.00. Page 1

As Mr. Sewell has already received one distribution, he has already been unjustly enriched to the detriment of Nationstar and any further distributions will further unjustly enrich Mr. Sewell to the detriment of Nationstar. Without payment in this matter, Nationstar will lose its lien on the real property and will have received nothing in return. 6. As Mr. Sewell s loan remains in default and Nationstar will lose its lien, Nationstar submits that it would be equitable to allow its late claim and it would be inequitable to allow further distributions to Mr. Sewell while there remains a lien on his property in favor of Nationstar. Wherefore, Nationstar Mortgage LLC d/b/a Mr. Cooper respectfully requests the Court for entry of an order, pursuant to Section 501 of the Bankruptcy Code to Allow the Late Filing of its Secured Proof of Claim and for any other relief justice requires.
