ORDINANCE NO. /,37*/ AN ORDINANCE OF THE VILLAGE OF SHOREWOOD, WILL COUNTY, ILLINOIS PROPOSING THE ESTABLISHMENT OF A SPECIAL SERVICE AREA AND CALLING FOR A PUBLIC HEARING WITH REGARD THERETO (Lake Forrest) WHEREAS, it is in the best interest of the Village of Shorewood to conduct a public hearing with regard to a proposed Special Service Area (the "Special Service Area") on the property described in Exhibit "A" attached hereto (the "SSA Property"); and WHEREAS, the SSA Property is commonly known as the Lake Forrest Subdivision and is generally bordered on the North by the Kipling Estates Subdivision, on the South by Mound Road, on the East by River Road and on the West by the Kipling Estates Subdivision. NOW THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND VILLAGE BOARD OF THE VILLAGE OF SHOREWOOD, WELL COUNTY, ILLINOIS AS FOLLOWS: SECTION 1. INCORPORATION OF RECITALS The recitals set forth above and all Exhibits to this Ordinance are incorporated herein as if fully set forth in this Section 1. SECTION 2. PUBLIC HEARING A public hearing shall be conducted regarding the creation of the Special Service Area and the levy of taxes therein by the President and Board of Trustees of the Village of Shorewood on the 26th day of September, 2006 at 7 o'clock p.m. The public hearing shall be conducted at the Shorewood Municipal Building, 903 West Jefferson Street, Shorewood, Illinois. SECTION 3. PUBLIC HEARING NOTICE Notice of the Public Hearing shall be given by publication in a newspaper in general
circulation in the Village, at least fifteen (15) days prior to the Public Hearing. Notice of the Public Hearing shall also be given by depositing same in the United States mail addressed to the person or persons in whose name the general taxes were paid for the last proceeding year on each property situated within the SSA Property. SECTION 4. RATE OF TAXES Special Service Area Taxes levied in the SSA Property shall be in addition to all other taxes and shall be levied upon the equalized assessed value of the property in an amount not to exceed an annual rate of six one-hundredths percent (.06%, or 60 per $100.00) of equalized assessed valuation. SECTION 5. NATURE OF THE TAX The Special Service Area Tax will be utilized to fund "special services" as defined by the Illinois Special Service Area Tax Law 35 ILCS 200/27-5 et seq. including by way of example and not as a limitation the maintenance, repair and replacement of stormwater retention areas, subdivision entrance features and monuments and other public improvements within the SSA Property. SECTION 6. REPEALER All ordinances or parts of ordinances in conflict with any of the provisions of this Ordinance shall be, and the same are hereby repealed. SECTION 7. SEVERABILITY This Ordinance, and every provision hereof, shall be considered severable. In the event that any court of competent jurisdiction may find and declare any word, phrase, clause, sentence, paragraph, provision or section or part of a phrase, clause, sentence, paragraph, provision or
section of this Ordinance is void or unconstitutional, the remaining words, phrases, clauses, sentences, paragraphs and provisions and parts of phrases, clauses, sentences, paragraphs, provisions and sections not ruled void or unconstitutional shall continue in full force and effect. SECTION 8. EFFECTIVE DATE This Ordinance shall be in full force and effect from and after its passage and approval.
