RECOMMENDATION: Second reading and adoption Ordinance 2018-09 titled An Ordinance of the City Council of the City of Encinitas, California Amending Section 2.48.020 of the Encinitas Municipal Code Regarding Youth Commission Membership effective with the FY 2019-20 Youth Commission Term. STRATEGIC PLAN: This item relates to the operating principles of the Strategic Plan that is for City commissions to provide expert advice. It also relates to the Organizational Effectiveness and Efficiency focus area, exhibiting leadership that embraces community outreach and delivers efficient and effective services. FISCAL CONSIDERATIONS: There are no fiscal considerations associated with the staff recommendation. BACKGROUND: Ordinance 2018-09 (Attachment 1) was introduced at the regular City Council meeting held on August 15, 2018, reducing the Youth Commission membership from (11) to nine (9). The agenda report (Attachment 2) from that meeting is attached for additional information. Once adopted, Ordinance 2018-09 will be effective after 30 calendar days. ENVIRONMENTAL CONSIDERATIONS: The action being considered by the City Council is exempt from the California Environmental Quality Act (CEQA) because it is not a project under Section 15378(b)(5) of CEQA Guidelines. The action involves an organizational or administrative activity of government that will not result in the direct or indirect physical change in the environment. Attachment 1 ORDINANCE 2018-09 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ENCINITAS, CALIFORNIA AMENDING SECTIONS 2.48.020 OF THE ENCINITAS MUNICIPAL CODE REGARDING YOUTH COMMISSION MEMBERSHIP The City Council of the City of Encinitas, California does ordain as follows: SECTION ONE: That Subsection 2.48.020 A.1 of the Encinitas Municipal Code is amended to read as follows: A. The Youth Commission shall consist of up to 9 voting members, all residents of the City of Encinitas. In the event of a vacancy, the position will remain unfilled until the next annual recruitment unless the membership falls below a quorum, at which time a recruitment will occur. Youth Commission composition shall include: 1. Representatives from school grades 7 through 12. SECTION TWO: This Ordinance shall take effect and be in force no sooner than thirty (30) days after its adoption by the City Council. Additionally, the City Clerk of the City of Encinitas is hereby authorized to use summary publication procedures pursuant to Government Code Section 36933 utilizing the Coast News, a newspaper of general circulation published in the City of Encinitas. BACKGROUND: The City of Encinitas has various commissions that are advisory to the City Council as described in the Encinitas Municipal Code (EMC) Chapter 2.30 Boards, Commissions and Committees. The Chapter describes how members are appointed, term of appointment, and rules and regulations of operations. The commission membership has changed since its inception: On April 15, 1998, Ordinance 98-04, Chapter 2.48.020 was adopted establishing the Encinitas Youth Commission with eleven (11) members. On January 17, 2000, the ordinance was repealed and replaced with Ordinance 2000-16, Chapter 2.48 which established the Youth Commission at thirteen (13) members. On March 9, 2005, Ordinance 2005-02 amended Chapter 2.48.020 to decrease the Youth Commission membership from thirteen (13) members to eleven (11). On July 9, 2014, Chapter 2.48 was amended, allowing the Youth Commission to have up to twenty (20) voting members, an increase from the previous eleven (11) members, all residents of Encinitas, serving a one-year term. 2018-08-15 Item 08C 1 of 3 2018-08-22 Item 08D 4 of 6

Attachment 2 On September 20, 2017 the City Council adopted Ordinance 2017-12 amending Sections 2.48.020 of the municipal code to reduce the membership of the Youth Commission from twenty (20) members to eleven (11). On May 23, 2018, the City Council approved the Mayors recommendation to reduce the Youth Commission Membership to nine (9) voting members from eleven (11). ANALYSIS: This action implements the City Council direction given at the May 23, 2018 meeting. A larger membership makes it more difficult to obtain a quorum on a consistent basis. In 2017 the commission was surveyed about their experiences. A key finding was that there was a small group of commissioners that did most of the work and obtaining a quorum still posed a challenge. Several meetings were cancelled due to lack of quorum. A smaller size commission will be more efficient and manageable. Ordinance 2018-09 will reduce the membership to nine (9) to align Youth Commission membership with the membership of other commissions throughout the City, and provide a more positive experience for the commissioners. ENVIRONMENTAL CONSIDERATIONS: The action being considered by the City Council is exempt from the California Environmental Quality Act (CEQA) because it is not a project under Section 15378(b)(5) of CEQA Guidelines.
