Indictment No. I~- 7~ ~ Case No. 18-1788 FIRST COUNT BIAS INTIMIDATION this Court, did commit the crime of Bias Intimidation, by attempting to commit the crime of Murder, and/or by committing the crime of Robbery, and/or by conamitting the crime of Possession Of A Weapon For An Unlawful Purpose, with a purpose to intimidate J.W., because of J.W. s race or color, and/or knowing that the conduct constituting the offense would cause an individual or group of individuals to be intimidated because of race or color, contrary to the provisions of N.J.S.A. 2C16- la(1) and/or N.J.S.A. 2C16-ia(2), and against the peace of this State, the Government, and dignity of the same.
SECOND COUNT ATTEMPTED MURDER this Court, did attempt to commit the crime of Murder, by purposely attempting to cause the death of J.W., contrary to the provisions of N.J.S.A. 2C5-I and N.J.S.A. 2CII-3, and against the peace of this State, the Government, and dignity of the same. THIRD COUNT ARMED ROBBERY I this Court, did commit the crime of Armed Robbery, by, while in the course of committing a Theft, infz±ct±ng bod±ly injury or using force upon J.W., and/or committed or threatened to commit any crime of the first or second degree, and that in the course of committing said crime the defendant attempted to kill J.W. and/or purposely inflicted or attempted to inflict serious bodily injury on J.W., and/or was armed with or threatened the immediate use of a deadly weapon, to wit a motor vehicle,
contrary to the provisions of N.J.S.A. 2C15-I, and against the peace of this State, the Government, and dignity of the same. FOURTH COUNT POSSESSION OF A WEAPON FOR AN UNLAWFUL PURPOSE THIRD DEGREE CRIME! FIFTH COUNT THEFT OF MOVABLE PROPERTY THIRD DEGREE CRIME HUBBARD, on or about May I, 2018, in or about the Township of ~ this Court, did commit the crime of Theft, by unlawfully taking, or exercising unlawful control over, movable property of another, to wit a motor vehicle, belonging to J.W., with the
purpose to deprive the owner thereof, contrary to the provisions of N.J.S.A. 2C20-3a, and against the peace of this State, the Government, and dignity of the same. SIXTH COUNT ELUDING SECOND DEGREE CRIME Freehold, and/or the Township of Colts Neck and/or the Township of Marlboro, County of Monmouth, and within the jurisdiction of this Court, did commit the crime of Eluding, by operating a motor vehicle on a street or highway in the State of New Jersey, and knowingly fleeing or attempting to elude W.M. and/or P.C. and/or C.L., law enforcement officers, after having received a signal from the law enforcement officers to bring the vehicle to a full stop, thereby creating a risk of death or injury to himself or another, contrary to the provisions of N.J.S.A. 2C29-2b, and against the peace of this State, the Government, and dignity of the same.
