RECOMMENDATION: To pass second reading and adopt Ordinance No. 586, as presented. POLICY ISSUE/BACKGROUND DISCUSSION: On July 1, 2014, by a 5-1 vote, the City Council passed first reading of Ordinance No. 586 to amend the development standards for lodging facilities in the Tourist Business Zone (TB). The following table compares current regulations with the proposed new regulations. Current Option 1 Code Rooms/Acre 24 NA % Impervious 50% 85% Base Height 35' 35' Max. Height (1) 45' 45' Max. Agreement Not Not Required Required Ordinance No. 586 eliminates restrictions regarding rooms per acre; increases allowed impervious surface requirements from 50% to 85%; and eliminates restrictions that limit hotels/lodging facilities to 3 stories. The public hearing of Ordinance No. 586 was opened on June 3, 2014 and continued to July 1, 2014. Council passed first reading of Ordinance No. 586 (Option 1) by a vote of 5-1. Staff has revised Ordinance No. 586 to improve clarity and readability. ALTERNATIVES: 1. Pass second reading and adopt Ordinance No. 586, as presented. 2. Do not pass second reading. RECOMMENDED MOTIONS: I MOVE TO PASS SECOND READING AND ADOPT ORDINANCE 586, AS PRESENTED, TO AMEND REGULATIONS FOR LODGING FACILITIES IN THE TOURIST BUSINESS ZONE. Attachment 1: Ordinance No. 586 1

ATTACHMENT 1 ORDINANCE NO. 586 AN ORDINANCE OF THE CITY OF WOODINVILLE, WASHINGTON, TO AMEND WMC 21.08.050 REGULATIONS CONCERNING HOTEL/MOTEL FACILITIES IN THE TOURIST BUSINESS ZONE AND WMC 21.38.065 REGARDING HOTEL/MOTEL REGULATIONS IN THE TOURIST DISTRICT OVERLAY ZONE; PROVIDING FOR SEVERABILITY; ESTABLISHING AN EFFECTIVE DATE AND FOR SUMMARY PUBLICATION BY TITLE ONLY. WHEREAS, WMC 21.08.050 and 21.38.065 allows for lodging facilities, with certain restrictions, in the Tourist Business Zone and in the Tourist District Overlay Zone; and WHEREAS, after receipt of recommendation from the Woodinville Planning Commission following review and public hearing; and consideration of this matter by the City Council after public hearing and discussion; the City Council believes regulations regarding hotels/motels in the Tourist Business Zone and Tourist District Overlay Zone are necessary to help achieve the intent and vision of the City's long term objectives for an attractive and successful Tourist District; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF WOODINVILLE, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. Findings. The City Council hereby adopts as findings the recitals expressed above. Section 2. Amendment of WMC 21.08.050. WMC 21.08.050, General Services Land Uses, Temporary Lodging; is hereby amended as follows (new text is shown by underline; deletions of text are shown by strikethrough); all other provisions shall remain unchanged and in full force and effect. 21 08.050 General Services Land Uses A. Section 3. Amendment of Section 21.38.065(2)(f). Section 21.38.065(2)(f) of the Woodinville Municipal Code is hereby amended to read as follows (new text is shown by underline; deletions of text are shown by strikethrough); all other provisions shall remain unchanged and in full force and effect. 21.38.065(2)(f) "(f) Lodging facilities, including bed and breakfast guest houses, lodges, and inns, youth hostels, and campgrounds, except hotels/motels located in the Tourist Business Zone, provided: (i) The number of rooms is limited to 24 per acre; 2

. ~~ ATTACHMENT 1 i (ii) Impervious surface shall be limited to 50 percent of the site; (iii) The height is limited to 35 feet, not exceeding three stories; and (iv) The style of the structure shall: (A) Fit one of the following styles: country inn, bed and breakfast, Victorian, woodland lodge, or other style defined in the Tourist District Master Plan and approved by the Planning Commission Design Review Subcommittee; (B) Be compatible with existing development; and (C) Meet the criteria as listed in the Tourist District Master Plan;" Section 4. Copy to the Department of Commerce. Pursuant to RCW 36. 70A.1 06 (3), the City Clerk is directed to send a copy of the amendments to the State Department of Commerce for its files within ten (1 0) days after adoption of this Ordinance. Section 5. Severability. Should any section, paragraph, sentence, clause, or phrase of this ordinance be held invalid or unconstitutional by a court of competent jurisdiction, such invalidity or unconstitutionality shall not affect the validity or constitutionality of any other section, sentence, clause, or phrase of this ordinance.. Section 6. Effective Date and Summary Publication. This ordinance shall become effective five days after passage and publication. The City Clerk is directed to publish a summary of this ordinance at the earliest possible publication date by publication of the ordinance title.
