Police Jury Room October 6, 2003 Abbeville, Louisiana Minutes of a regular meeting of the Vermilion Parish Police Jury held on October 6, 2003 with Mr. Edval Simon, Jr. presiding. The meeting was called to order by Mr. Simon, who asked that the meeting begin with the Pledge of Allegiance, followed by a moment of silent prayer. The following members were present: Mr. Purvis Abshire Mr. Terry Bessard Mr. Ernal "E. J." Prejean, Jr. Mr. Edval Simon, Jr. Absent: Mr. Ritter Trahan Upon motion of Mr. Ernal "E. J." Broussard, duly seconded by Mr. Louis Joe Hardy, and unanimously carried, the reading of the minutes of the October 6, 2003 meeting were dispensed with and were accepted. President Edval Simon, Jr. invited those requesting time on the agenda to present their business at this time. Ms. Larita Simoneaux, Director of the Vermilion Parish Domestic Abuse Intervention Program requested the Police Jury to adopt a proclamation to declare October, 2003 as Domestic Violence Awareness Month. Ms. Simoneaux thanked the Jury for their continued cooperation and support of the program and introduced Mr. James Falgout, who is a product of the program. He commented on the benefits of the program and how it has helped him. Upon motion of Mr. Hubert Faulk, duly seconded by Mr. Purvis Abshire, and unanimously carried, the Police Jury authorized the President to proclaim October, 2003 as Domestic Violence Awareness Month in Vermilion Parish. The Agenda was amended to allow Mr. Mike Couvillion to address the Jury. Mr. Couvillion requested the Police Jury s support in his runoff election for Vermilion Parish Sheriff. He expressed his desire to work with the Police Jury and all governmental entities when elected.

President Edval Simon, Jr. read the following announcements: (1) Received an invitation from the Louisiana State Museum to attend the opening celebration of ONE NATION UNDER GOD: The Church, The State, and The Louisiana Purchase, an exhibit focusing on how the Purchase transformed the practice and politics of religion in the Louisiana Territory, to be held on Thursday, October 9, 2003 in New Orleans in the Cabildo. Exhibit includes the Pere Megret Painting from the courthouse which is on loan to the Museum. (2) Lorman Education Services will host a seminar entitled Leaves of Absence In Louisiana to be held on October 21, 2003, in Lafayette. (3) Postlethwaite & Netterville will sponsor a governmental accounting update seminar to be held on October 22, 2003 in New Orleans. (4) Received an invitation from the Vermilion Association For Family And Community Education, Inc. to attend their 63 rd Annual Achievement Day to be held on Wednesday, October 22, 2003 at the American Legion Home in Kaplan. Parish Engineer, Mr. Gene Sellers, Sr., presented a report showing the breakdown of materials received during the Household Hazardous Waste Day collection. Upon motion of Mr. Hubert Faulk, duly seconded by Mr. Louis Joe Hardy, and unanimously carried, upon the recommendation of the Parish Engineer, the Police Jury approved the roadway and drainage improvement construction plans for the Meaux Ranch Subdivision and to direct the developer to proceed with the actual construction. Upon motion of Mr. Carroll Duhon, duly seconded by Mr. T. J. Prejean, Jr., and unanimously carried, the Police Jury approved Partial Payment Estimate No. 2 in the amount of $501,473.12 to H & S Construction Co., Inc., relative to the 2003 Road Improvements Phase I construction project. Upon motion of Mr. Carroll Duhon, duly seconded by Mr. Minos Broussard, and unanimously carried, the Police Jury approved Partial Payment Estimate No. 1 in the amount of $84,213.41 to H & S Construction Co., Inc., relative to the 2003 Road Improvements Phase II construction project. Upon motion of Mr. Carroll Duhon, duly seconded by Mr. Minos Broussard, and unanimously carried, relative to the 2003 Road Improvements Phase II construction project, the Police Jury approved a Contract Change Order No. 1 which adjusts contract quantities to as-built quantities. Change Order reflects a decrease in the contract amount of $1,369.80.

Upon motion of Mr. Carroll Duhon, duly seconded by Mr. Minos Broussard, and unanimously carried, the Police Jury adopted a resolution accepting the project as complete, with a punch list, and authorized the President to execute an Act of Acceptance from H & S Construction Co., Inc. pertaining to the completion of the contract for the 2003 Road Improvements Phase II River Road, Eagle Pass, N. Airport Road. Upon motion of Mr. Hubert Faulk, duly seconded by Mr. Carroll Duhon, and unanimously carried, the Police Jury approved the issuance of Permit No. 1260-D to Mission Resources Corporation to install and maintain a board road located off of La Hwy 700 and to drill and maintain the Primeaux Well No. 1 in the North Leroy field, located in Election District No. 2. Upon motion of Mr. Luther "Buster" Hardee, duly seconded by Mr. T. J. Prejean, Jr., and unanimously carried, the Police Jury approved the issuance of a letter of no objection to Kaplan Telephone Co., Inc. to bury a telephone cable along and across Dogwood Road located in Election District No. 14. Upon motion of Mr. T. J. Prejean, Jr., duly seconded by Mr. Luther "Buster" Hardee, and unanimously carried, the Police Jury approved the issuance of a letter of no objection to Kaplan Telephone Co., Inc. to bury a telephone cable along and across Ralph Road located in Election District No. 13. Upon motion of Mr. Hubert Faulk, duly seconded by Mr. T. J. Prejean, Jr., and unanimously carried, the Police Jury amended Item No. 15 of the Public Road Committee Recommendations to add the following state highway driveway permit installations: E) Katie Van Duzee La. Hwy 89 F) Ardie Sarver La. Hwy 92 Upon motion of Mr. Hubert Faulk, duly seconded by Mr. Purvis Abshire, and unanimously carried, the Public Road Committee Recommendations were further amended to accept the naming of a private road as Bunker (Pvt) Lane, going south from La. Hwy 92, approximately ¼ mile east of Dubose Road, and authorized Sellers & Associates, Inc. to plot the road on the parish road system map and that the 911 Communications District Office be advised of the road addition. Upon motion of Mr. Luther "Buster" Hardee, duly seconded by Mr. Minos Broussard, and unanimously carried, the Public Road Committee Recommendations were approved as amended, and the appropriate officials of the Jury were authorized to carry out the recommendations; PUBLIC ROAD COMMITTEE OCTOBER 1, 2003 ABBEVILLE, LOUISIANA

AS A RESULT OF A PUBLIC ROAD COMMITTEE MEETING HELD ON OCTOBER 1, 2003, THE FOLLOWING ITEMS ARE RESPECTFULLY SUBMITTED FOR THE JURY S CONSIDERATION: 1. It is recommended that TAC Americas be authorized to proceed with a feasibility assessment of the parish buildings to see if they would qualify for energy savings rehabilitation. There is no cost or commitment required to have this assessment done. 2. It is recommended that the Police Jury approve the issuance of telephone permits to Kaplan Telephone Co., Inc. to install cable on Highway 82/Ralph Road in District 13 and on Tan/Vernis Road in District 2. 3. It is recommended that the Police Jury ratify the hiring of Ms. Karen Lemaire as a part time mosquito control spray driver. 4. It is recommended that the Parish Water Districts be informed not to install, or allow to be installed, backflow preventers within the public road right-of-ways. 5. It is recommended that Phillip Pillaro be hired as a CDL truck driver to replace Ednor Hargrave who is terminating his employment. Mr. Pillaro is to be assigned to the Area 4 Road Maintenance Barn. 6. It is recommended that Sellers and Associates, Inc. be authorized to do a drainage study in the area of Lopez and Dud Roads. Cost to be paid from Sub 5 of 2 road maintenance funds. 7. It is recommended that the Police Jury agree to pay those invoices incurred by the Economic Development Board with the understanding that reimbursement would be paid from the Development Board s grant obtained from the La. Economic Development Department. 8. It is recommended that a pauper funeral allocation be approved for Ms. Shirley Feverjean and made payable to Vincent Funeral Home in Kaplan. 9. It is recommended that the Sheriff s Department be advised that the use of the solid waste burner unit for burning any drug seizures will require that a deputy be on the site until the materials are completely burned. 10. It is recommended that the following invoices from The Sellers Group be approved to be paid: A) Invoice No. 2463 - $170.00 Repairs of Storm Damaged Roof At The Vermilion Parish Courthouse

B) Invoice No. 2465 - $290.00 Interior Restoration of Storm Damage At The Vermilion Parish Courthouse C) Invoice No. 2464 - $320.00 Interior Restoration Of Storm Damage At The A. A. Comeaux Recreation Center 11. It is recommended that the following invoices be approved to be paid relative to the Maurice Branch Library Project with costs paid from the Library Construction Fund: (A) G. P. Pierret Construction, L.L.C. Application No. 5 Amount Due = $12,600.00 (B) The Sellers Group Invoice No. 2474 Amount Due = $288.40 12. It is recommended that the following invoices be approved to be paid. Invoices for testing services provided at the Solid Waste Plant to meet the Subtitle D monitoring requirements: (A) Pace Analytical Invoice No. 20018635 Amount Due = $120.00 (B) Icon Environmental Services Invoice No. 9051-023 Amount Due = $1,558.00 13. It is recommended that Invoice No. 83414 from Broussard, Poche, Lewis & Breaux, L.L.P. in the amount of $675.00 be approved to be paid. Invoice represents consulting services provided to prepare budget vs. actual to date comparison information and attendance at Finance Committee Meeting in July. 14. It is recommended that the Police Jury enter into an intergovernmental agreement with the Coulee Des Jons Drainage District to repair a bridge on a branch of the Sledge Canal in the area of the Rixby Marceaux, Jr. farm. Police Jury to provide labor and equipment to do the project.

15. It is recommended that the following state highway driveway permit installations be approved: A) Danny D. Richard La. Hwy. 333 B) Asa Broussard La. Hwy. 331 C) Peter Trahan La. Hwy 343 D) Joe Mouton La. Hwy 700 (subject to paperwork being provided) 16. It is recommended that the Police Jury formally accept Crepe Myrtle Drive in Country Gardens Subdivision, Phase 1, into the Parish Road Maintenance System. Located in Election District No. 2. 17. It is recommended that the Police Jury accept Coyote Trail into the Parish Road Maintenance System. Located in Election District No. 1. Respectfully submitted, Luther "Buster" Hardee, Chairman Upon motion of Mr. Purvis Abshire, duly seconded by Mr. Carroll Duhon, and unanimously carried, the Police Jury authorized the President to proclaim the week of October 14 20, 2003 as NATIONAL FAMILY COMMUNITY EDUCATION WEEK, in Vermilion Parish, as requested by the Vermilion Association for Family & Community Education. Upon motion of Mr. Minos Broussard, duly seconded by Mr. T. J. Prejean, Jr., and unanimously carried, the Police Jury authorized the President to proclaim the week of October 19 25, 2003 as CHARACTER COUNTS! WEEK in Vermilion Parish, as requested by the Vermilion Association for Family & Community Education. Upon motion of Mr. Purvis Abshire, duly seconded by Mr. Ernal "E. J." Broussard, and unanimously carried, the Police Jury adopted a resolution providing for the annual certification of compliance with the Off-System Bridge Replacement Program for the period of October, 2002 through September, 2003. Upon motion of Mr. Minos Broussard, duly seconded by Mr. Louis Joe Hardy, and unanimously carried, the Police Jury approved action to request the congressional delegation and the parish legislators to support the efforts of the Southern Shrimp Alliance in their attempts to prohibit the continued importation of foreign shrimp.

Upon motion of Mr. T. J. Prejean, Jr., duly seconded by Mr. Ernal "E. J." Broussard, and unanimously carried, the Police Jury approved payment of Invoice No. 2202619 in the amount of $840.05 to Coastal Environments, Inc. relative to the development of an environmental assessment of the effects of the proposed Deepwater Access Channel to the Port of Iberia Project. Upon motion of Mr. Carroll Duhon, duly seconded by Mr. Hubert Faulk, and unanimously carried, the Police Jury ratified the issuance of a special event permit to the North Vermilion Youth Athletic Association which is sponsoring the North Vermilion Football Alumni Homecoming Dance on October 10, 2003, to be held at the Woodman of the World Building in Maurice, Louisiana, at which time alcoholic beverages will be sold. Upon motion of Mr. Kenneth DeHart, duly seconded by Mr. Pervis "Pee Wee" Meaux, and unanimously carried, the Police Jury authorized President Edval Simon, Jr. to sign Amendment No. 2 of the DNR Cooperative Agreement No. 2503-02-09, Parish Coastal Wetlands Restoration Program. Upon motion of Mr. Purvis Abshire, duly seconded by Mr. Pervis "Pee Wee" Meaux, and unanimously carried, the Police Jury ratified payment to Bourque Metal Roofing in the amount of $2,442.89 for repair of damage to the Mosquito Control Building, from Hurricane Lili. Secretary-Treasurer, Mr. Michael J. Bertrand, advised the Police Jury of the Commodity Distribution Schedule for October. Mr. Bertrand advised the Jurors that the parish has been awarded $320,184.64 from the State Homeland Security Grant Program. Funds to be used to acquire support equipment in accordance with the assessment needs previously submitted to the Louisiana Office Of Emergency Preparedness and Homeland Security. Upon motion of Mr. Mark Poche, duly seconded by Mr. Ernal "E. J." Broussard, and unanimously carried, the Police Jury, at the request of legal counsel, Paul Moresi, III, went into executive session at 7:25 p.m. to discuss prospective litigation regarding a subrogation claim/demand for payment by Progressive Insurance Co. relative to an incident which occurred on 5/3/2003. Upon motion of Mr. Minos Broussard, duly seconded by Mr. Luther "Buster" Hardee, and unanimously carried, the Police Jury returned to regular session at 7:42 p.m. In other legal business, Mr. Moresi advised the Jurors that trial dates are being applied for, relative to the Hartec suit and the Med Express suit. Relative to the road damage to Jasmine Road and Pioneer Roads, if the demand payment is not received this week, he will file formal lawsuit documents.

Upon motion of Mr. Minos Broussard, duly seconded by Mr. Purvis Abshire, and unanimously carried, the Police Jury deferred action on the damage claim by the City of Abbeville to the Public Works Committee Meeting. Upon motion of Mr. Luther "Buster" Hardee, duly seconded by Mr. T. J. Prejean, Jr., and unanimously carried, the Police Jury approved the issuance of permit to install an irrigation line on Dallas Guidry Road to Steven Plaisance, subject to the paperwork being completed. Upon motion of Mr. Louis Joe Hardy, duly seconded by Mr. T. J. Prejean, Jr., and unanimously carried, that there being no further business to be presented, the meeting was duly adjourned.
