BOARD OF FIRE COMMISSIONERS Montgomery Township Fire District No. 2 PO Box 264 Blawenburg, New Jersey 08504 MINUTES OF JANUARY 7, 2016 CALL TO ORDER The scheduled meeting of the Board was called to order by Chairman Laughlin at 7:04 pm, following proof of publication under the Open Public Meetings Law (Annual Meeting Notice published in the official newspaper of the district and provided to two other newspapers, filed with the municipal clerk, posted at the Montgomery Township Municipal Building and Board offices and web site). ROLL CALL Present: Commissioners L. Laughlin, J. Plimpton, D. VanDoren, S. Weingart, P. Martin. Absent: None. Also present: Chief Kabis, Ass t. Chief Bolen, LOSAP representative G. Keller, L. Franchino and Attorney Griswold. Chairman Laughlin welcomed Commissioner Martin. He outlined the duties and responsibilities of board members and urged them to let fairness, reason and sound judgment guide their decisions, focusing on the provision of the best possible fire protection services to the district and the interests of district taxpayers. He reminded board members that open and frank discussions of issues were welcomed and he encouraged questions from any of them at any time. APPROVAL OF MINUTES The Board reviewed and discussed the minutes of the September 10 th and December 12th, 2015 meetings. A motion was made to accept the minutes of the September, 10, 2015 meeting as presented. Motion by Plimpton. 2 nd by Laughlin. Motion passed without objection. A motion was made to accept the minutes of the December 10, 2015 meeting as presented. Motion made by Martin. 2 nd by Plimpton. Motion passed without objection. TREASURER S REPORT BILLS A copy of the Treasurer s Report was made available to each commissioner with a list and description of the bills to be paid. The Chief Financial Officer certified that there were sufficient encumbered funds from the prior year and current unencumbered funds to pay the bills and designated the account to which each would be charged. He also requested the transfer of $52,250.00 from the HVCB money market account to the HVCB operating (checking) account for the purpose of paying the bills. A motion was passed to accept the Treasurer s Report, to approve payment of the bills, and to transfer money to the HVCB checking account for the purpose of paying the bills. Motion by Plimpton. 2 nd by Laughlin. Motion passed without objection.

RESOLUTION 2016-01 - Payment of Bills and Transfer of Funds. Approval of payment of the bills as presented, in the total amount of $63,013.32 ($28,488.22 from 2015 encumbered funds and $34,525.10 from the 2016 temporary budget), and authorization to transfer $52,250.00 from the HVCB money market account to the HVCB operating (checking) account for the purpose of paying the bills. OLD BUSINESS Investments tabled until next meeting Harassment Policies tabled until next meeting Security tabled until next meeting. LOSAP - The 2015 certified list of volunteer members and LOSAP recipients was presented to the Board. Of 41 members eligible to participate in the program, 32 qualified for contributions for 2015 (16 of whom earned the maximum). A motion was made to accept the 2015 LOSAP list as certified by the fire company, with knowledge that adjustments may occur as a result of members review. Motion by Martin. 2 nd by Plimpton. Motion passed without objection. RESOLUTION 2016-02 - Approving the LOSAP Final Annual Certification List. Pursuant to NJSA 40A:14-192, the certified list of volunteer members of Montgomery Township Volunteer Fire Company No. 2, identifying those active volunteer members who have qualified for credit under the LOSAP award program for 2015, is hereby approved and its posting for review by members for at least 30 days is hereby authorized.. Annual Election - The closing date for the receipt of candidates petitions for the two 3-year seats on the board is 5 p.m. on January 15, 2016. Petitions are available from and shall be submitted to the Clerk of the Board, Stephen Weingart. Petitions can also be secured by calling 609-466-3967. The Board will name poll tellers, set their compensation, and appoint Commissioners to open and close the February 20, 2016 polls at the February meeting. CHIEF S REPORT The fire company responded to 23 calls during December, 2015, including two oven fires, one water leak, two CO emergencies and one unauthorized controlled burn. The total of calls for 2015 was 352. The fire lane at one Montgomery Ridge Apartment building failed the second inspection. It may have to be relocated. To date, no C/O has been issued for this building. Line Officers for 2016 are J. Kabis (Chief), G. Gurzo (Deputy Chief); J. Bolen (Assistant Chief); D. VanDoren (Captain); R. Buhl (1st Lieutenant); A. Verducci (2 nd Lieutenant); S. Santangelo (3 rd Lieutenant); J. O Brien and T. Martin (Crew Leaders); L. Long (Fire Police Captain); and S. Weingart, Jr.(Fire Police Sergeant). All meet or exceed state educational and tenure qualifications for these appointments.

Apparatus: Brush 46 Mass air flow sensor replaced on warranty; the truck is back in service. Batteries were replaced; pump issue being addressed; check engine light on again. Engine 107 2 batteries were replaced. Tower 46 Waterway leak. Car 46 Headlamp repaired by manufacturer. Rescue 46 Needed road service to repair flat tire caused by bad valve stem. Activities/Training: - Firefighter physicals January 9th - Extrication drill January 10th - Bloodborne Pathogen, Harassment, Right to Privacy classes January 20 th A motion was made to approve one purchase. Motion by Laughlin. 2 nd by Martin. Motion passed without objection. RESOLUTION 2016-03 Purchase of Office Supplies. Authorization to purchase miscellaneous office supplies from WB Mason pursuant to NJ State Purchasing Contract #88839 at a cost of $17.32, chargeable to the Office appropriation in the 2016 temporary budget. PUBLIC HEARING ON 2016 BUDGET The Chairman opened the public hearing on the budget. A motion was made proposing the 2016 Budget be read by title. Motion by Laughlin. 2 nd by Martin. Motion passed without objection. RESOLUTION 2016-04 Authorizing 2016 Fire District Budget be Read by Title. Pursuant to NJSA 40A:14-78.2, the 2015 budget shall be read by title, as for at least one week prior to the date of this public hearing a complete copy of the approved budget was posted in the Montgomery Township Municipal Offices and was made available to each person requesting a copy during the week prior to and during the public hearing. The hearing was advertised as required by statute. After taxpayers of the district and all persons having an interest therein were given an opportunity to speak, and there being no comment, A motion was to close the public hearing and proposing the 2016 budget for adoption, in the same form and amounts as the approved budget. Motion by Laughlin. 2 nd by Plimpton. Motion passed without objection. RESOLUTION 2016-05 Adoption of the 2016 Fire District Budget (Resolution Attached) NEW BUSINESS Future Equipment/Apparatus Planning Cmsr. Martin inquired into the existence of an analysis of future equipment/apparatus needs and proposed acquisition dates. It was agreed the existing plan should be updated and that a future work session should be devoted to this topic.

The following Resolutions were proposed for calendar year 2016: Motion by Plimpton. 2 nd by Martin. Motion passed without objection. RESOLUTION 2016-06- Official Newspaper of Fire District. The Courier News of Bridgewater, New Jersey, shall be the official newspaper of the District for public notices and other public communication. When notification to a second newspaper is necessary or desirable it shall be the Princeton Packet. RESOLUTION 2016-07 Fire District Attorney. Barbara S. Griswold, Esq., of Hopewell, New Jersey, is retained as Board Attorney at an annual contract fee of $15,925.00, plus expenses. This contract(s) is awarded as a professional service contract under the provisions of NJSA 40A:11-5(1)(a) and is on file and available for public inspection at the fire district offices. RESOLUTION 2016-08 Fire District Bookkeeper. Lynn Franchino, of Neshanic Station, New Jersey, is retained as Board Bookkeeper at an annual contract fee of $7,500, plus expenses. This contract is on file and available for public inspection at the fire district offices. RESOLUTION 2016-09- Fire District Auditor. Solitario & Tierney, CPA s, of Spotswood, New Jersey, is retained as Auditor for the fiscal and LOSAP years ended December 31, 2015, and for financial review services, at a cost not to exceed $11,000.00. This contract is awarded as a professional service contract under the provisions of NJSA 40A:11-5(1)(a) and is on file and available for public inspection at the fire district offices. RESOLUTION 2016-10- Fire District Temporary Budget. In accord with NJSA 40A:14-78.17, a temporary budget in the amount of $ 84,221.20 is hereby adopted to provide for appropriations during the period between January 1, 2016 and passage of the 2016 budget. RESOLUTION 2016-11 Cash Management Plan.. The board hereby adopts a Cash Management Plan in accord with the NJ Local Fiscal Affairs Law (NJSA 40A:5-14) and NJ Local Finance Board guidelines designating PNC Bank, Hopewell Valley Community Bank and First State Bank as official depositories of the fire district, and authorizing additions to or deletions from these designations as long as the institutions are GUDPA participating and authorized by law as a public depository. Disbursements from account(s) shall be by official check signed by two commissioners. Investments as authorized by NJSA 40A:5-15.1 are permissible by Resolution of the Board. A report summarizing all investments made or redeemed shall be included in a monthly report from the Treasurer. The plan shall be subject to the annual financial audit of the fire district. RESOLUTION 2016-12- Fire District Insurance Broker of Record. Nottingham Insurance Agency of Hamilton Square, New Jersey, is hereby named as broker of record to provide insurance services to the fire district relative to issues presented in the course of fire district business. This broker of record has a good relationship with the fire district insurance providers and has proven to be knowledgeable, helpful and efficient in handling matters brought to it by the board. This contract is awarded as an Extraordinary Unspecified Service pursuant to NJSA 40A:40A:11-5(1)(a)(ii), 40A:11-5(1)(m), and the New Jersey Pay to Play Regulations. The contract(s) are on file and available for public inspection at the fire district offices. RESOLUTION 2016-13- Annual Meeting Dates. Regular meetings of the Board of Fire Commissioners shall take place on the following dates in 2016 and in January, 2017: 1/7, 2/4, 3/3, 4/7, 5/5, 6/2, 7/7, 8/4, 9/1, 10/6, 11/3, 12/1, 12/15/2016, and 1/5/2017, and

Special meetings of the Board of Fire Commissioners, which shall be work sessions at which no formal action will be taken, shall take place as needed on the following dates in 2016 and in January, 2017: 1/21, 2/18, 3/17, 4/21, 5/19, 6/16, 7/21, 8/18, 9/15, 10/20, 11/17/2015, and 1/19/2017. All meetings will be held at 7:00 pm at the Montgomery Township Volunteer Fire Company No. 2 firehouse, at 529 Route 518, in Montgomery Township (Blawenburg), New Jersey. Notice of meetings shall be posted at the board offices and web site, the Montgomery Township Municipal Building and advertised as required by law. Resolutions 2016-06 through 2016-13: SCBA PRESENTATION Ayes: Laughlin, Plimpton, Weingart. VanDoren, Martin. Nays: None. Absent: None. Representatives from Scott and MSA demonstrated their breathing apparatus to board members and answered questions. Thereafter, the chief, on behalf of the fire company s SCBA committee presented its recommendation to the board. The matter will be more fully addressed by the board at its work session to be held later in the month. ADJOURNMENT There being no further business to come before the Board, the meeting adjourned at 10:46 p.m. The next regularly scheduled meeting will be held on February 4, 2016. RESOLUTION 2016-05 2016 ADOPTED BUDGET RESOLUTION Montgomery Township #2 FISCAL YEAR: January 1, 2016 to December 31, 2016 WHEREAS, the Annual Budget for the Montgomery Township Fire District No.2 (the Fire District ) for the fiscal year beginning January 1, 2016 and ending December 31, 2016, has been presented for adoption before the Board of Commissioners of the Fire District at its open public meeting of January 7, 2016; and WHEREAS, the Annual Budget as presented for adoption reflects each item of revenue and appropriation in the same amount and title as set forth in the introduced and approved budget, including all amendments thereto, if any, which have been approved by the Director of the Division of Local Government Services; and WHEREAS, the adopted budget is in compliance with the Property Tax Levy Cap Law (N.J.S.A. 40A:4-45.44 et. seq.); and WHEREAS, the Annual Budget as presented for adoption reflects Total Revenues of $ 913,080.00, which includes amount to be raised by taxation of $ 883,390.00, and Total Appropriations of $ 913,080.00; and WHEREAS, an election shall be held annually on the third Saturday of February in each established fire district to determine the amount to be raised by taxation for the ensuing year; NOW, THEREFORE BE IT RESOLVED, by the Board of Commissioners of the Fire District at an open public meeting held on January 7, 2016 that the Annual Budget of the Fire District for the fiscal year beginning January 1, 2016 and ending December 31, 2016, is hereby adopted and shall constitute appropriations for the purposes stated and authorization of Total Revenues of $ 913,080.00, which includes amount to be raised by taxation of $ 883.390.00, and Total Appropriations of $ 913,080.00; and BE IT FURTHER RESOLVED, that the Annual Budget as presented for adoption reflects each item of revenue and appropriation in the same amount and title as set forth in the introduced and approved budget, including all amendments thereto, if any, which have been approved by the Director of the Division of Local Government Services; and BE IT FURTHER RESOLVED, that an annual election shall be held on the third Saturday of February to determine the amount to be raised by taxation for the ensuing year.
