The Town Board of the Town of Pavilion held the regular monthly meeting on February 13, 2019 at the Town Hall, One Woodrow Drive, Pavilion, New York at 7:00PM present were: Present were: Supervisor Robert LaPoint Councilperson John Rudgers Councilperson Donald Oberlin Councilperson Mark Heineman absent Councilperson James Thater Others: Others: Town Clerk Cindy Starr, Tim & Erica Welch, Bill Kegler & George Jinks. Supervisor LaPoint opened the meeting at 7:00PM. followed by the pledge to the flag. Councilperson Rudgers offered a motion, seconded by Councilperson Oberlin Resolution No 29, 2019: 2019 Town Clerk Health Insurance RESOLVED: To pay Town Clerk Lucinda Starr health insurance in the amount of $199.50 per month to be paid directly by clerk. WHEREAS, The Town of Pavilion Town Board supports the County s resolution to trpeal the SAFE act. Now therefore be it RESOLVED, The Town Board of the Town of Pavilion opposes any new legislation requiring long fun/hunting/sporting gun registry or Firearm Owner Identification Card (FOID card) and/or requiring gun owners to purchase insurance of each legally owned gun. Approved by unanimous roll call vote (4-0). Supervisor LaPoint offered a motion, seconded by Councilperson Rudgers Resolution No. 35, 2019: OF THE TOWN OF PAVILION, GENESEE COUNTY, NEW YORK AS TO SEQRA DETERMINATION. BE IT RESOLVED by the Town Board of the Town of Pavilion, Genesee County, as follows: Section 1. It is hereby determined that the Board adopting this resolution has heretofore declared itself to be the lead agency under the State Environmental Quality Review Act ( SEQRA ) and the regulations promulgated thereunder for purposes of determining the environmental impact of 3

the project described in Section 3 hereof, and completed all requisite requirements in connection therewith. Section 2. It is hereby determined that the project described in Section 3 hereof is a Type I Action which, based upon the Full Environmental Assessment Form attached hereto and made a part hereof, it has been determined as such will not have any significant adverse effects upon the environment. Section 3. The project which is the subject of this resolution is described as follows: the construction of a new water storage tank on a town-owned parcel of land to be acquired on York Road in the Town of Pavilion, together with approximately 6,300 linear feet of 12 inch water main, valves, hydrants, land or rights-in-land and other original furnishings, equipment, machinery, apparatus, appurtenances and incidental improvements and expenses in connection therewith at a maximum estimated cost of $1,808,000 for the Consolidated Water District. Section 4. This resolution shall take effect immediately. The question of the adoption of the foregoing resolution was duly put to a vote on roll call, which resulted as follows: Approved by unanimous roll call vote (4-0). Voting was as follows: Supervisor LaPoint offered a motion, seconded by Councilperson Oberlin Resolution No 36, 2019: Set Public Hearing March 13, 2019@7:00PM for Consolidated Water District. NOTICE IS HEREBY GIVEN that the Town Board of the Town of Pavilion, Genesee County, New York, will meet in the Town Hall, in Pavilion, New York, in said Town, on March 13 at 7:00 o'clock 4

P.M., Prevailing Time, for the purpose of conducting a public hearing upon a certain map, plan and report, including an estimate of cost, in relation to the proposed increase and improvement of the facilities of the Consolidated Water District in said Town (the Consolidated Water District ), consisting of the construction of a new water storage tank on a Town-owned parcel of land to be acquired on York Road in the Town of Pavilion, together with approximately 6,300 linear feet of 12 inch water main, valves, hydrants, land or rights-in-land and other original furnishings, equipment, machinery, apparatus, appurtenances and incidental improvements and expenses in connection therewith at a maximum estimated cost of $1,808,000. The capital project described above has been determined to be a Type I Action pursuant to the regulations promulgated under the State Environmental Quality Review Act ( SEQRA ) the implementation of which it has been determined will not result in any significant environmental adverse effects. The map, plan and report and SEQRA compliance documents, including a full Environmental Assessment Form are available in the office of the Town Clerk, where they may be inspected during regular office hours. At said public hearing said Town Board will hear all persons interested in the subject matter thereof. Approved by unanimous roll call vote (4-0).
