DOLTON SCHOOL DISTRICT 149 KITCHEN EQUIPMENT The Board of Education for Dolton School District 149 is accepting sealed written bids for kitchen equipment. Bids will be accepted until 2:00pm on June8, 2017. The bid will be awarded at the June 22, 2017 Board Meeting. Preparation of Bid The bidder shall prepare his/her bid on the enclosed form. Unless otherwise stated, the form must be completed in its entirety (no blank spaces). The Board reserves the right to award in part or the total bid to one responsive bidder. Bids shall not be modified. No oral, telephonic, faxed, or telegraphic bid or revision to a bid will be considered. The term bidder as used in these documents refers to a corporation, company, or firm and in no way refers to an individual unless that individual is the sole proprietor of said company. The word he/she when used in these instructions means the bidder and not the person who may sign on behalf of the bidder. Bids shall be based on the premise that District 149 will not be responsible for financing, holding title to, or licensing equipment. Qualification statements and references may be required at the discretion of District 149. Bidders shall guarantee all pricing reflected in their response to this bid. Competency of Bidder No bid will be accepted from, or contract awarded to, any person, firm, or corporation that is in arrears or is in default to the board upon any debt or contract, or that is a defaulter, as surety or otherwise, upon any obligation to said Board, or has failed to perform faithfully any previous contract with the Board. General Conditions Indemnity The Contractor shall indemnify, keep safe and save harmless the Board, its agents, officials and employees, against all injuries, deaths, losses, damages, claims, patent infringements or copyright infringement claims, suits, liabilities, judgments, costs and expenses, which may in any way result from, whether or not it shall be alleged or determined that the act was caused through negligence or omission of the Contractor or his/her employees, and the Contractor shall, at his/her own expense, appear, defend and pay all charges of attorneys and all costs and other expenses arising from or incurred in connection with, and, if any judgment shall be rendered against the Board in any such action, the Contractor shall, at his own expense, satisfy and discharge the same. The Contractor expressly understands and agrees that any insurance protection required should in no way limit the responsibility to indemnify keep safe and save harmless and defend the Board as herein provided. Prevailing Wage Contractor will comply with the Prevailing Wage Act (820 ILCS 130) which provides that no less than the prevailing rate of wages, as found by the Department of Labor, shall be paid to all laborers, workmen, and mechanics performing work on this contract. Affirmative Action Contractors and subcontractors must familiarize themselves with applicable federal law, namely, Executive Orders 11246 and 11375, which require affirmative action for eliminating discrimination based upon race, color, religion, sex, and national origin; Rehabilitation act of 1973 which requires affirmative action in the employment of mentally and physically handicapped individuals; and requirements for veterans; employment. These obligations of contractors should not be confused with non discrimination in employment requirements for all employees under the title VII of the civil rights Act of 1964 (as amended) and Equal Pay Act of 1963 (as amended), or with sex discrimination requirements for all recipients of federal financial assistance under IX of the Education Amendments of 1972. 2
