0 0 FULTON COUNTY, GEORGIA CITY of EAST POINT AN ORDINANCE GRANTING PREVENTION PLUS, INCORPORATED A SPECIAL USE PERMIT TO OPERATE A SCHOOL AT 0 KNOTTS AVENUE, KNOTTS AVENUE & 0 NEWNAN STREET IN THE NEIGHBORHOOD COMMERCIAL (C-) ZONING DISTRICT CASE NO: 0U-00-0 ASSOCIATED CASE NO: 0VC-00-0 WHEREAS, Part 0, Chapter, Section 0- requires that a Special Use Permit be obtained to operate a school, private or special; and WHEREAS, Part 0, Chapter, Sections 0-0 and 0-0 of the East Point Code of Ordinances require approval of the Special Use Permit by the East Point City Council; and WHEREAS, Prevention Plus, Inc. has requested a Special Use Permit to operate a school at 0 Knotts Avenue, Knotts Avenue and 0 Newnan Street, Parcel ID numbers -0-000-0-, - 0-000-0- and -0-000-0-, in the Neighborhood Commercial (C-) zoning district and as described in Exhibit A (Deed), Exhibit B (Legal Description) and Exhibit C (Site Plan); and WHEREAS, all use permits shall expire within three () years from the date of approval by the City Council or as otherwise conditioned unless a land disturbance permit, building permit, business license or certificate of occupancy has been issued. NOW BE IT ORDAINED BY THE CITY COUNCIL OF EAST POINT, GEORGIA AS FOLLOWS: 0 Section. A Special Use Permit is granted for Prevention Plus, Inc. to operate a school at 0 Knotts Avenue, Knotts Avenue and 0 Newnan Street, Parcel ID numbers -0-000-0-, -0-000-0- and -0-000-0-, in the Neighborhood Commercial (C-) zoning district with the following conditions:. Construct a six foot ornamental metal or black vinyl clad chain link fence on the east side of 0 Newnan Street and west side of 0 Knotts Avenue along with the proposed landscaping to meet O-I-T landscape buffer standards. Owner shall file a plat application to consolidate all parcels associated with Compass Success Academy upon completion of renovations for 0 Knotts Avenue, Knotts Avenue, 0 Newnan Street. Owner shall file for a Special Use Permit under the corporate organization Compass Success Academy. Owner shall obtain a Certificate of Occupancy (CO) and business license under the corporate organization Compass Success Academy. Each tenant shall be required to obtain a Certificate of Occupancy (CO) and business license prior to opening 0 Section. A -part concurrent variance is granted for Prevention Plus, Inc to operate a school at 0 Knotts Avenue, Knotts Avenue and 0 Newnan Street, Parcel ID numbers -0-000-0-, -0-000- 0- and -0-000-0-, in the Neighborhood Commercial (C-) zoning district: Part I - Reduce the distance requirement for buildings and refuse areas from 00-feet to 0-feet located adjacent to property in the residential district and/or AG- district used for single family. Part II - Reduce the distance requirement for parking areas from 0-feet to 0-feet located adjacent to property in the residential district and/or AG- district used for single family. Section. This ORDINANCE shall be codified in a manner consistent with the laws of the State of Georgia and the City of East Point. Section. (a) It is hereby declared to be the intention of the Mayor and Council that all Sections, paragraphs, sentences, clauses and phrases of this ORDINANCE are or were, their enactment, believed by the Mayor and Council to be fully valid, enforceable and constitutional. (b) It is hereby declared to be the intention of the Mayor and council that, to the greatest extent allowed by law, each and every section, paragraph, sentence, clause or phrase of this ORDINANCE, is severable from every other section, paragraph, sentence, clause or phrase of the ORDINANCE. 0 the intention of the Mayor and Council that, to the greatest extent allowed by law, no section, paragraph, sentence, clause or phrase of this ORDINANCE is mutually dependent upon any other section, paragraph, sentence, clause or phrase of this ORDINANCE. (c) In the event that any phrase, clause, sentence, paragraph, or section of this ORDINANCE shall, for any reason whatsoever, be declared invalid, unconstitutional or otherwise unenforceable by the valid judgment or decree of any court of competent jurisdiction, it is the express intent of the Mayor and Council that such invalidity, unconstitutionally or unenforceability shall, to the greatest extent allowed by law, not render invalid, unconstitutional or otherwise unenforceable any of the remaining phrases, clauses, sentences, paragraphs or sections of the ORDINANCE and that, to the greatest extent allowed by law, all remaining phrases, clauses, sentences, paragraphs and sections of the ORDINANCE shall remain valid, constitutional, enforceable, and of full force and effect. Section. ALL ORDINANCES and parts of ORDINANCES in conflict herewith are hereby expressly repealed. Section. Penalties in effect for violations of Part of the Code of Ordinances, City of East Point, Georgia at the time of the effective date of this ORDINANCE shall be and are hereby made applicable to this ORDINANCE and shall remain in full force and effect.
