He submits that he would like to obtain instructions in this matter as the Railway authorities had in an earlier decision decided not to acquire the lands on which markers were placed. respondents. Accordingly, 4 (four) weeks time is granted to the Notice was sent to the respondent No. 2 on 09.03.2016. There is no return of service or return of A/D Card. Accordingly, await service report. List the matter after 4 (four) weeks.

Cont.Cas(C) No. 24 of 2015 Mr. A.K Rokhum submits that he will be filing affidavit on behalf of the respondent Nos. 8 & 9 within 2 (two) weeks. List the matter after 2 (two) weeks.

I.A No. 5 of 2016 in CRP No. 1 of 2016 Heard Mr. Ali Hussain, learned counsel appearing for the applicant. Also heard Mr. A.K. Rokhum, learned Addl. Advocate General appearing for the respondent Nos. 135 & 136. Mr. Lalchhanliana Khiangte submits that he will be filing his vakalatnama on behalf of the respondent Nos. 1 to 134 by Monday i.e. 04.04.2016. The counsels for the respondents do not have any objection to the delay in filing the revision petition. On perusing the application for condonation of delay, I find that sufficient cause has been made out for the delay. Accordingly, the delay of 44 days is condoned. Interlocutory application is accordingly disposed of.

I.A No. 6 of 2016 in CRP No. 1 of 2016 Heard Mr. Ali Hussain, learned counsel appearing for the applicant. Also heard Mr. A.K. Rokhum, learned Addl. In view of the fact that there is a challenge to the Order dated 05.12.2015 passed in L.A Case No. 42 of 2013, the proceeding Execution Case No. 17 of 2015 is stayed till final disposal of the Civil Revision Petition. Interlocutory application is accordingly disposed of.

CRP No. 1 of 2016 Heard Mr. Ali Hussain, learned counsel appearing for the petitioner who submits that the present Revision Petition, though filed under Article 227 of the Constitution read with Section 115 CPC, he presses for the instant petition only under Section under Section 115 CPC.
