1. Background Term of Reference Constitutional Review Process & Electoral Reform in Liberia The Constitutional Review Process, which began in August 2012, has made significant progress. To date, the Constitutional Review Committee (CRC) has 1) held a national Constitutional Conference (NCC) in Gbarnga City, Bong County where it presented its findings to the Legislature and the Liberian public after consultations in all 15 Counties of the country and 2) presented its report to the President of Liberia. Consequently, the President forwarded in the form of a letter, a commentary on the NCC findings to the Legislature. While commenting on each of the 25 proposals voted for at the NCC, the President also took time to remind the Legislature of its constitutional role as well as the timelines leading up to the anticipated referendum. The President also pointed out that it is the institution of the legislature that is tasked with the responsibility of converting the Committee s report to a set of proposed constitutional amendments to be effected into the body of the current 1986 Constitution, which would then pave way for citizens participation in a referendum on the proposed amendments. Through its support to the Constitutional Reform and Electoral Cycle Support Projects, the UNDP is committed to supporting the Legislature and the National Elections Commission (NEC) to ensure that all necessary requirements are met prior to a referendum. Given the significant relationships developed over the years between UNDP, NEC and the Legislature through the Election Basket Project (EBP) and the Constitutional Reform Project (CRP), it is envisioned that the CRP and Electoral Reform support can build on that established relationship and interface to facilitate relationships and networks with the legislature and NEC. In consideration of the above, the ongoing electoral reform and constitutional review processes, with the support of UNDP requires the service of an individual contractor to work with the secretariat, the Legislature and the NEC to organize and implement public hearings on proposed amendments, organize and implement meetings with stakeholders on referendum, assist the legislature in organizing and publishing the proposed amendments accompanied by statements in an official gazette, liaise between the NEC and the Legislature, work with the NEC on ongoing electoral reform, assist the NEC in preparation and implementation of civic education on proposed constitutional amendments. 2. Functions / Key Results Expected 2.1. The UNDP seeks to recruit a consultant to work with the Legislature & NEC to support the constitutional review and electoral reform processes and development in relation to: Legal analysis, in particular regarding supporting the constitutional review and electoral reform processes; Legislative public hearings, stakeholder consultations, political parties and CSOs engagement and finalization of proposed amendments, in particular through support for the NEC and the Joint Legislative Committee on constitutional review and relevant members of secretariat and staff of committee; 2

Deliverables/Outputs : More specifically, the following are the deliverables which are linked to the payments as per the table below; Deliverables Estimated Duration to Complete Target Due Dates Review & Approvals Assist the Legislature, specifically the Senate in organizing and conducting public hearings with various stakeholders on the proposed constitutional amendments. Assist the NEC in conducting more information sessions on adopted amendments to the election law & work with the NEC to conduct one gender mainstreaming workshop with political parties & CSO. Assist the Legislature in seeking expert opinion and completing the proposed constitutional amendments with explanatory statements. Assist CSOs and CBOs to strategize, organize and deliver information sessions and increase dialogue on proposed constitutional amendments. Work with NEC to develop civc education started for draft amendments for distribution to IPCC, CSOs Media and various sector of Liberian society. Payment terms 1 Month 20% upon completion of specified deliverables and submission of report 1 Month 20% upon completion of specified deliverables and submission of report 1 Months 20% upon completion of specified deliverables and submission of report 1.5 Month 20% upon completion of specified deliverables and submission of report 1.5 Month 20% upon completion of specified deliverables Building broad consensus among political actors and promoting confidence in the NEC to conduct peaceful elections in 2017 and the future; and Encouraging conflict prevention/community dialogues and support to creating a peaceful environment for the 2017 elections, including NEC/stakeholder outreach and partnership building. 2.2. The consultant will work with the NEC Board and staff, Members of the legislature, their personal staff and the staff of the Legislature. In particular, staff will need to be supported to provide legal analysis and briefings to Members in relation to the review process and related issues. The consultant will also be tasked with designing and implementing activities to build committee members understanding of the roles and responsibilities throughout the legislative engagement process. 2.3. The consultant will work with the NEC Board of Commissioners, the Executive Director, the legal department and other staffs, the Legislature, political parties, CSOs and other stakeholders in ensuring that the copies of the Elections Law and proposed constitutional amendments are disseminated to stakeholders. The consultant will be tasked with designing and implementing information sessions, organizing conferences/workshops, developing policies, regulations and organizational structures for the Inter-Party Consultative Committee (IPCC), supporting dialogues with active involvement of community leaders and youth organization, and supporting the connection between political parties, CSOs, media, community leaders and youth groups. 3

2.4. The consultant will work closely to support the Joint Legislative Committee to more effectively discharge their duties. The consultant will support the relevant committees to develop an outreach strategy (mapping of key actors to engage, calendar and methodology to conduct public hearings on the proposed amendments, to enable a more inclusive process of debate and review of the constitutional review being undertaken. 2.5 In delivering the consultancy, the consultant will: Work in very close partnership with the Chair and members of the Board of Commissioners of the NEC, the Executive Director, the legal department and other relevant staff; Work closely with the Legislature, in particular members of relevant committees, their staff and staff of the secretariat; Work closely with political parties, CSOs, media and other stakeholders; and Work closely with the UNDP Liberia Country Office. 4. Institutional Arrangements The Consultant will be under the overall and direct supervision of the Deputy Country Director for Programme and liaise closely with the Team Leader Governance and the UNDP Elections Project CTA. 5. Duration of the Work The consultancy is expected to last for 6 months (Monday to Friday) from the date of signing the contract. 6. Duty Station: Monrovia, Liberia 7. Requirements for experience and qualification Qualifications The consultant is expected to have the following qualifications: A minimum of Master s degree in law, political science, international relations or a relevant social science; Extensive knowledge and work experience of electoral administration and management with specific experience in legal assistance. Experience in assisting the Constitutional Review and Election Law Reform processes. Experience in Drafting regulations and guidelines for election process in the African region. Experience in advisory role, especially knowledge of Liberian Legislative and electoral legal framework is advantage. At least 7 years of relevant professional work experience, in particular in the area of electoral support or law reform. Understanding of political economy, conflict analysis and relevant strategies for implementing crisis sensitive responses to political governance issues; Demonstrable experience in undertaking similar consultancies for international development organizations, preferably UNDP; Fluent English-Speaker Competencies Corporate Competencies: Demonstrates integrity by modeling the UN s values and ethical standards Promotes the vision, mission, and strategic goals of UNDP Displays cultural, gender, religion, race, nationality and age sensitivity and adaptability Functional Competencies: Communication and interpersonal skills required for collaboration with election administration as well as various electoral stakeholders.
