Minutes - January 4, 2012 Second Session GODERICH, ONTARIO

SECOND SESSION HURON COUNTY COUNCIL Goderich, Ontario January 4 th, 2012. met in the Council Chambers on Wednesday January 4 th, 2012. Warden Bernie MacLellan called the meeting to order at 9:02 a.m. Chief Administrative Officer Larry C. Adams called the roll and all members of Council were present. Councillor Dowson arrived at 9:08 a.m. Warden MacLellan welcomed all present to the Second Session. Warden MacLellan reviewed the Warden s report for the month of December, 2011. Minutes of the previous session: MOTION: 11-12 Moved by: Councillor G. Robertson and Seconded by: Councillor J. Ginn: The minutes of the previous session being; the Twelfth Session of November 30 th, 2011 and the Inaugural Session of December 7 th, 2011; be adopted as circulated. Declaration of Pecuniary Conflict of Interest: There were no declarations of pecuniary conflict of interest stated by any member of Council with regard to items on the Agenda. Petitions and Deputations: There were no petitions and/or deputations for this session. Councillor s Issues: There was a great deal of discussion surrounding the Appeal process further to Justice Gorman s decision on November 18 th, 2011 as it refers to Huron County Council composition.

Page 2 of 9 MOTION: 12-12 Moved by: Councillor P. Gowing and Seconded by: Councillor A. Versteeg: The Council of the County of Huron accepts the decision of the Courts that the correct size of is sixteen (16) members; AND FURTHER The Council of the County of Huron opposes the appeal of the judicial decision of November 18 th, 2011. MOTION: 13 12 Moved by: Councillor J. Ginn and Seconded by: Councillor J. Grace: Warden MacLellan; be authorized to vacate the Chair thus enabling him to comment on the afore-mentioned Resolution; AND FURTHER Councillor Vincent; be appointed to Chair this portion of the Second Session. Warden MacLellan reviewed with the members of Council some background information made available to him recently, regarding the decision of Justice Gorman on November 18 th, 2011 regarding composition. Many members of County Council had comments regarding the decision of Justice Gorman and the Appeal that has been launched by two member municipalities. MOTION: 14-12 Moved by: Councillor J. Grace and Seconded by: Councillor T. Hessel: The Council of the County of Huron; agree to pay the legal costs of the Respondents to the appeal; as Huron County By-law No. 28-1999 is valid; AND FURTHER The Council of the County of Huron should be paying for the legal costs of defending its own By-law. Warden MacLellan re-assumed the position of Chair for the Second Session.

Page 3 of 9 Councillor Grace reported on the Maple Tree Community Housing Project that things are well underway and the project should be completed in July 2012. Councillor Grace wanted to publicly thank former County Councillor Bill Siemon for his dedication and support for this project. Councillor Grace also thanked for all their work bringing this project forward. Councillor Gowing, a member of the Maitland Valley Conservation Authority Watershed Partnership s Terrestrial Team and Forest Management Plan Committee reported on discussions at a recent meeting. There is concern with the amount of tree cover and health of the trees in Huron County. Councillor Gowing requested that the County of Huron Forest Conservation By-law be reviewed. MOTION: 14 12 Moved by: Councillor P. Gowing and Seconded by: Councillor D. Shewfelt: The County of Huron Forest Conservation By-law; be reviewed by Huron County Council. MOTION: 14-12 Moved by: Councillor P. Klopp and Seconded by: Councillor B. Dowson The Motion; to review the current County of Huron Forest Conservation Bylaw; be deferred; until a report is presented by Forest Conservation Officer David Pullen. Councillor Steffler voiced his displeasure with the recent decision by the Ministry of Municipal Affairs and Housing to not include the loss of woodlots in the Ontario Disaster Relief Assistance Program (ODRAP). CAO Adams reported that delegation requests to meet with the Minister of Municipal Affairs and Housing at the ROMA/OGRA Conference in Toronto in February are underway. The County will be seeking three delegations; being the ODRAP funding for woodlots being denied, the loss of rural residences and the Provincial Policy Statement as it refers to rural Ontario. Warden MacLellan reported that George Cuff, who is performing the Organizational Review, will be commencing his duties with a presentation on Monday January 30 th, 2012.

Ginn: An invitation is to be extended to the County s member municipalities Councils and senior staff to attend the presentation by George Cuff on Monday January 30 th, 2012 at the Central Huron Arena Complex Auditorium. Correspondence: There was no correspondence. Reports of Committees: Board of Health Members of Council were given an opportunity to review the minutes of the regular Board of Health meeting of December 8 th, 2011. Councillor G. Robertson, Chair of the Board of Health was available to speak to the minutes and the reports. MOTION: 16-12 Moved by: Councillor G. Robertson and Seconded by: Councillor J. Grace: The Board of Health Report of December 8 th, 2011; be received and will appear in the printed minutes as Report No. 2. Committee of the Whole Day 1 Members of Council were given an opportunity to review the minutes of the Committee of the Whole - Day 1 December 14 th, 2011 meeting. Councillor J. Grace, Chair of the Committee of the Whole - Day 1 was available to speak to the minutes and the reports. MOTION: 17-12 Moved by: Councillor J. Grace and Seconded by: Councillor A. Versteeg: The Committee of the Whole Day 1 December 14 th, 2011 minutes and reports be adopted as presented and will appear in the printed minutes as Report No. 3.

Hessel, Chair of the Library Board was available to speak to the minutes and the reports. MOTION: 18-12 Moved by: Councillor T. Hessel and Seconded by: Councillor J. Grace: The Library Board Report of December 16 th, 2011; be received and will appear in the printed minutes as Report No. 4. Committee of the Whole Day 2 Members of Council were given an opportunity to review the minutes of the Committee of the Whole - Day 2, December 16 th, 2011 meeting. Councillor A. Versteeg, Chair of the Committee of the Whole Day 2 was available to speak to the minutes and the reports. There was a great deal of discussion regarding the scheduled Strategic Planning meeting to be held on Friday January 6 th, 2012 to discuss County of Huron Council composition. AMENDING MOTION: 19-12 Moved by: Councillor D. Shewfelt and Seconded by: Councillor P. Klopp: The Strategic Planning meeting scheduled for January 6 th, 2012 at 9:00 a.m.; to discuss the composition of ; be rescheduled to a later date. MOTION: 20-12 Moved by: Councillor A. Gowing: The Committee of the Whole Day 2 minutes and reports of December 16 th, 2011; be adopted as presented and will appear in the printed minutes as Report No. 5.

Public Question Period: Heather Boa of Bullet News Huron inquired as to who will represent the County in the appeal process. CAO Adams advised this information will be forthcoming and it will be made available to the press. Closed to the Public Session MOTION: 22-12 Moved by: Councillor T. Gowing: County Council do now go into a Closed to the Public Session at 11:23 a.m. under Section 239 of the Municipal Act, 2001 as amended to discuss an item which relates to: the security of the property of the municipality or local board AND FURTHER The following staff members remain in attendance: CAO Larry C.
