CITY OF MENDOTA HEIGHTS DAKOTA COUNTY STATE OF MINNESOTA Minutes of the Regular Meeting Held Tuesday, February 3, 2015 Pursuant to due call and notice thereof, the regular meeting of the City Council, City of Mendota Heights, Minnesota was held at 7:00 p.m. at City Hall, 1101 Victoria Curve, Mendota Heights, Minnesota. CALL TO ORDER Mayor Krebsbach called the meeting to order at 7:00 p.m. Councilmembers present included Duggan, Povolny, Petschel, Norton. PLEDGE OF ALLEGIANCE Council, the audience, and staff recited the Pledge of Allegiance. AGENDA ADOPTION Mayor Krebsbach requested that item 5m) Approval of Personnel Action Report be removed from the agenda. She then presented the agenda for adoption. Councilmember Duggan moved adoption of the revised agenda. Councilmember Petschel seconded the motion. CONSENT CALENDAR Mayor Krebsbach presented the consent calendar and explained the procedure for discussion and approval. PULLED CONSENT AGENDA ITEM I) APPROVAL OF RESOLUTION 2015-12, FINAL PLANS AND SPECIFICATIONS FOR STREAMBANK STABILIZATION AT SOMERSET COUNTRY CLUB AND SPRING CREEK CIRCLE, AUTHORIZE ADVERTISEMENT FOR BIDS Councilmember Petschel asked for clarification that approving this resolution does not necessarily approve the project. City Engineer John Mazzitello confirmed that this resolution is only to authorize advertisement for bids. There would be further action from the Council at a later date to award the contract. Councilmember Petschel explained she has concerns on the funding of this project and what the City would be receiving in emergency reimbursement. Engineer Mazzitello stated that he will be working with Chief Aschenbrener and the Emergency Managers of the State and would hope to have that figure for the Council at the time that the contract is brought to the Council. Mayor Krebsbach asked what the estimate is for this project. Assistant Engineer Ruzek replied that there was erosion last year at the Somerset Country Club that did some destruction. Staff is proposing to replace the outlet control structure of the pond, and re-armor the whole streambank. The project is estimated at $163,660. There was also a streambank failure on Marie Creek. Staff is also proposing to re-armor that bank at an estimated cost of $14,952. Most of the cost would be for materials. Mendota Heights has the easement for Ivy Creek that goes through Somerset; it is not Somerset property. The state has a cap of approximately $95,000 so the City will need to supply some documentation to get the additional funds. Councilmember Petschel moved to adopt RESOLUTION 2015-12, APPROVE FINAL PLANS AND SPECIFICATIONS FOR STREAMBANK STABLIZATION AT SOMERSET COUNTRY CLUB AND SPRING CREEK CIRCLE, AND AUTHORIZE THE ADVERTISEMENT FOR BIDS. Councilmember Norton seconded the motion. J) APPROVAL OF INSTALLATION OF STREET LIGHT AT ROUND HILL ROAD AND DODD ROAD Councilmember Petschel questioned the street light at Round Hill Road and Dodd Road because of a controversial street light in this same area along Dodd Road. This request has been made by a single homeowner. Councilmember Petschel asked if any of the neighbors had been informed of the installation of this streetlight. Engineer Mazzitello replied in the negative. The properties across the street have not been notified. However, staff did inform the immediate adjoining property, which is screened with dense evergreen from the pole to the home. He suggested that this be held over to a future Council meeting so staff could make those contacts. Councilmember Petschel moved to table Installation of Street Light at Round Hill Road and Dodd Road to allow staff time to notify the residents in this area. Councilmember Duggan seconded the motion. Councilmember Petschel also noted the street sign at this intersection is a different configuration than the rest of the surrounding streets. Engineer Mazzitello replied that staff would inspect the street sign for visibility. PUBLIC COMMENTS Chief of Police Michael Aschenbrener updated the Council on the Jury Trial which took place in St. Cloud, Minnesota for the murder of Officer Scott Patrick on July 30, 2014. The Stearns County jury in the trial of Brian Fitch returned a guilty verdict on Monday, February 2, 2015. Mr. Finch was convicted of first-degree murder in Officer Patrick s death; attempted first-degree murder of three St. Paul Police Officers, second-degree assault against a St. Paul Police Officer, illegal possession of a firearm, and intentional discharge of a firearm. Chief Aschenbrener expressed his appreciation to the Stearns County Judge for handling the court proceedings in a very professional manner, to the lead prosecutor, the Ramsey County Attorney s office, and others. He commended the West St. Paul Police Department, the St. Paul Police Department, and the BCA for an outstanding investigation and piecing together all of the miniscule little parts that go into an investigation. He thanked the Stearns County Sheriff, the St. Cloud Police Department, and the Stearns County Courts for their hospitality. He also expressed his appreciation to the public who made up the jury for taking time out of their lives to sit and listen to this three-week long trial. Mr. Finch is scheduled to be sentenced on Wednesday, February 4 th. Mayor Krebsbach called for a moment of silence. February 3, 2015 Mendota Heights City Council Page 3

Mr. Matt Glewwe, 591 Highway 110; Ms. Sylvia Wentworth, 599 Highway 110; and Mr. Craig Koeckeritz, 586 Sibley Court noted that the 595 Highway 110 property has been condemned and that it has the potential of being developed as a senior living facility. The neighborhood put together a petition, submitted it to the City on January 30, and requested that the Council review the petition. They requested a chance at an upcoming City Council meeting to have an open discussion regarding this development. City Attorney Tom Lehmann noted that the procedure is that the City informed the property owner of 595 Highway 110 that they either needed to have the property razed or repaired. Currently, there is a purchase agreement on the property. Whoever purchases the property would need to go through the normal processes to develop the property. Councilmember Petschel also stated that the Council has received the petition and will be reviewing the materials. C) CHAPLAINS OATH OF OFFICE In conjunction with the West St. Paul Police Department, the Mendota Heights Police Department has a Chaplain Program. These chaplains help serve the citizens and support the police officers during critical situations and routine duties. Without the assistance of Chaplain Liaison Lynn Liberman and Assistant Chaplain Liaison Sue Plucker, the program would not be what it is today. Mayor Krebsbach issued the Oath of Office to the following: Chaplain Butch "Chap" Millet Serving since 2003 Pastor John Snider Serving since 2003 Pastor David Wick Serving since 2003 Chaplain Frances Cuenca Serving since 2006 Support Chaplain Alberto Vargas Serving since 2006 Chaplain Lynn Liberman Serving since 2007 Chaplain Sue Plucker Serving since 2012 Chaplain Joel Detlefsen Serving since 2012 Father Lenny Andrie Serving since 2013 NEW AND UNFINISHED BUSINESS A) RESOLUTION 2015-11, APPOINTMENT TO CITY COMMISSIONS The following commissioners were reappointed for three years, beginning February 2015 and expiring January 2018: William Dunn, Airport Relations Commission David Sloan, Airport Relations Commission Ira Kipp, Parks and Recreation Commission Pat Hinderscheid, Parks and Recreation Commission Doug Hennes, Planning Commission Mary Magnuson, Planning Commission New commissioners were appointed as follows: Arvid Shamara, Airport Relations Commission (2/1/2015-1/31/2018) Christine Costello, Planning Commission (2/1/2015-1/31/2016) Joe Quehl and Rachel Fuhrer Youth Representatives, Park and Recreation Commission (2/1/2015-1/31/2016) Mayor Krebsbach explained that originally there was only to be one youth representative to the Park and Recreation Commission. However, both of these students were outstanding and had very different strengths. So it was decided to appoint both of them. Councilmember Norton moved to adopt RESOLUTION 2015-11, A RESOLUTION APPOINTING ADVISORY COMMISSION MEMBERS. Councilmember Povolny seconded the motion. B) RESOLUTION 2015-08, ICE ARENA JOINT POWERS AGREEMENT City Attorney Tom Lehmann updated the Council on the proposed Joint Powers Agreement with the City of West St. Paul and Independent School District 197 (ISD197) for the refurbishing of the John V. Hoene Ice Arena. This JPA has been through much iteration with regards to potential changes. One of the items the Council asked for was clarification on the repayment to the City in the event that the ice arena were to close prematurely. Attorney Lehmann explained that they are mutually agreeable to a term of seven years. This indicates that in the event that the ice arena were to close within seven years, the City of Mendota Heights would be entitled to reimbursement of a pro-rata share of its contribution. He also noted that in Section 10.4, there is some redundancy about the expiration of 20 years. It was his recommendation that the language that reads for a period of at least 20 years is not necessary and should be stricken. If approved this evening, this agreement would be forwarded to the City of West St. Paul and to Independent School District 197 for their review and approval. Councilmember Duggan moved to authorize the Mayor to sign RESOLUTION 2015-08, JOINT POWERS AGREEMENT FOR THE RENOVATION OF THE JOHN V. HOENE ICE ARENA and execute the agreement with the proposed change as outlined. Councilmember Povolny seconded the motion. Councilmember Petschel expressed her appreciation to everyone who worked to bring about a finalization to this contract. C) MENDOTA HEIGHTS FIRE STATION SPACE NEEDS STUDY Fire Chief John Maczko explained that in December 2014 a consultant was approved to look at the space needs of the fire station. A committee has been put together and they would like to have two representatives from the Council also sit on the committee. In talking to the consultant, there could be four to six meetings. Their conclusion date is on or about May 19, 2015. Councilmember Duggan asked if the addition of the new Fire Reserve or training firefighters would be taken into consideration during this space needs study. Chief Maczko replied that the additional personnel would not necessarily impact the needs on space. Councilmember Povolny and Councilmember Norton both volunteered to serve on the committee. Councilmember Duggan moved to appoint Councilmember Povolny and Councilmember Norton to the Mendota Heights Fire Station Space Needs Study Committee. Councilmember Petschel seconded the motion.
