RESOLUTION # 17-28 A Resolution of the Board of Trustees of the Changing the Method of Election for Members of the Board of Trustees from At Large to By-Trustee Areas, and Approving a Map for the Election of Trustees Commencing in November 2018 WHEREAS, the ( District ) currently uses a from-trustee area method of electing its governing board members; and WHEREAS, the current from-trustee area method of electing Board members requires candidates to reside within a specific geographic trustee area but be elected at-large by all voters of the District; and WHEREAS, on July 19, 2017, the District s Board of Trustees adopted Resolution No. 17-21 Initiating the Process to Transition from an At-Large Method of Elections to a By-Trustee Area Method of Elections; and WHEREAS, in the by-trustee area method of election, governing board candidates must reside within a specific geographic trustee area, and candidates are elected only by the voters of that trustee area; and WHEREAS, Education Code Section 72036(a) allows the governing board of a community college district to establish a by-trustee area election system, upon adoption of a Resolution, and with approval by the Board of Governors of the California Community Colleges; and WHEREAS, the District retained a qualified demographer to assist with the preparation and analysis of draft trustee area maps consistent with the requirements of the federal Constitution, the federal Voting Rights Act, and traditional redistricting principles; and WHEREAS, the District, in accordance with Elections Code Section 10010, held duly noticed public hearings on August 2, August 16, September 12, September 16, and October 3, 2017, to receive public comment on the composition of trustee areas and draft trustee area maps; and WHEREAS, the District also caused notices of the public hearings to be published in Spanish and Vietnamese, as well as in English; and WHEREAS, the District caused draft trustee area maps to be published on September 5 and September 26, 2017, along with the sequencing of elections in the trustee areas of each map; and WHEREAS, the District posted all the draft trustee area maps, 12 in total, with the election sequence in each map on the District s website in a prominent location, along with the demographic characteristics of each map; and WHEREAS, the District considered all of the public comment received; and WHEREAS, this Resolution notwithstanding, all incumbent trustees shall have a right to serve out his or her term of office; and 1 Attachment #1a

WHEREAS, trustees in current Trustee Areas 1 and 5 will stand for election in 2018 and trustees in current Trustee Areas 2, 3, and 4 will stand for election in 2020. NOW, THEREFORE, BE IT RESOLVED: 1. The above recitals are true and correct. 2. The Board of Trustees hereby adopts a by-trustee area method of election for the Board of Trustees commencing with the District s next regularly scheduled governing board member elections occurring in November 2018. 3. The Board of Trustees hereby adopts the Trustee Area Map identified as, attached hereto as Exhibit 1, and incorporated herein by reference, for use in by-trustee area elections commencing with the District s next regularly scheduled governing board member elections occurring in November 2018, and all governing board member elections thereafter, unless and until the method of election might be changed pursuant to law. 4. The sequence of elections in the trustee areas shall be as set forth during the public hearings in connection with the consideration of the Trustee Area Map attached hereto as Exhibit 1. 5. The Board shall continue to consider whether the number of members of the Board of Trustees should be increased from five to seven members, and the timing of such an increase, in accordance with Education Code Section 72036(c). 6. The Chancellor or his designee shall take all action necessary to obtain the approval of the substance of this Resolution from the Board of Governors of the California Community Colleges in accordance with Education Code Section 72036, and provide whatever information or assistance may be required by the Board of Governors. 7. The Chancellor or his designee shall take all action necessary to cause the implementation of this Resolution in time for the 2018 governing board member elections, including providing to the elections official of Orange County a description of the boundaries of the trustee areas depicted in the Trustee Area Map attached hereto as Exhibit 1, in whatever form might be convenient to the elections official, be that in electronic format, street-by-street description, or other format. 8. If required for the timely implementation of the Trustee Area Map attached hereto as Exhibit 1, as set forth in this Resolution, the Chancellor, in consultation with legal counsel, may make minor technical adjustments to the trustee area boundaries, provided that such minor technical adjustments are consistent with the intent of the Board of Trustees in adopting Exhibit 1. 2 Attachment #1a

9. If the Chancellor makes any minor technical adjustments to the trustee area boundaries reflected in the Trustee Area Map attached hereto as Exhibit 1, he shall report in detail such adjustments to the Board of Trustees at its next regular meeting. The Board hereby increases the number of trustees on the Board of Trustees from five to seven members. 4. The Board of Trustees hereby adopts the Trustee Area Map identified as, attached hereto as Exhibit 1, and incorporated herein by reference, for use in by-trustee area elections commencing with the District s next regularly scheduled governing board member elections occurring in November 2018, and all governing board member elections thereafter, unless and until the method of election might be changed pursuant to law. 5.
