Defendant shall be sentenced to one (1) year imprisonment, at the Department of Corrections, Mangilao, with all but seventy (75) days suspended, with credit for time served; II. Defendant is sentenced to Two (2) years supervised probation with Adult Probation Services Division; III. In addition to the standard conditions imposed by the Probation Services Division/Parole Service Division of the Department Corrections, the Court imposes the following conditions: a. Defendant shall not threaten, physically strike, or injure victim(s). b. Defendant shall report to the Probation Office once a month in person, or as ordered by the Probation Office. c. Defendant shall not possess or consume any alcoholic beverages; d. Defendant shall not enter any establishment whose primary license is for the sale of alcoholic beverages. e. Defendant shall not possess or consume any illegal controlled substances; f. Defendant shall submit to random alcohol testing under the supervision of the Parole Office/Probation Office. g. Defendant shall submit to random drug testing under the supervision of the Parole Office/Probation Office. h. Defendant shall stay away from all firearms, and is not to possess, carry, transfer, or use any firearms i. Defendant shall no apply for, possess, or own a firearms identification card; j. Defendant shall permit parole/probation officers and law enforcement officers to search his/her person, residence, and vehicles for firearms, alcohol, and illegal controlled substances at any time such a search is requested. Failure to allow such a search will be considered a violation of parole/probation; k. Defendant shall surrender his/her passport, if any, to the Probation Services Division; l. Defendant shall not leave Guam without the approval of the Court or the Parole/Probation Office, with prior notice given to the Office the Attorney General, Prosecution Division; m. Defendant shall comply with any court orders entered against the Defendant, including orders of family court or any other local or federal court of competent jurisdiction; n. Defendant shall obey all local and federal laws. o. Defendant shall comply with any other conditions imposed by the Court or the Parole Board/Probation Office

p. Defendant shall pay court costs of eighty ($80) dollars q. The determination of restitution is deferred upon motion of the government For CM0040-16 1) Defendant is sentenced to one (1) year incarceration, all suspended, credit for time served; 2) Defendant is placed on probation for a period of two (2) years, under the following recommendations: a. No contact and stay away from [Name Omitted}-may be modified at CSFC; b. No harassment/assault threat the victim and any/all household family members; c. Assessment at Client Services, and comply w/any and all recommended treatment courses; d. Pay a $200 fine-convertible, plus court costs; e. No alcohol, illegal drugs and firearms-applicable search and testing provisions; f. Obey all laws and do not leave Guam without the Courts permission; 3) The People will agree not to revoke Defendant s probation in CF0498-12 and CM0300-13 4. Any remaining charges will be dismissed. For CF0498-12 A. Defendant is sentenced to three (3) years imprisonment at the Department of Corrections in Mangilao for each charge, all suspended with credit for time served. Sentences to run concurrent with each other; B. As to the charge of Violation of Court Order (as a Misdemeanor) in CM300-13, the Defendant is sentence to one (1) year imprisonment at the Department of Corrections in Mangilao, all suspended with credit for time served to run concurrent to sentencing imposed in CF498-12; C. Defendant shall pay a Two Hundred Dollar ($200.00) fine, plus court costs. All or part of the fine imposed may be worked off through community service at the current minimum wage per hour; D. Unless waived by the victim, [Name Omitted], Defendant shall be liable to pay restitution to I an amount to be determined by the Court at a restitution hearing. Defendant shall pay restitution in installment to be arranged by the Adult Probation Office, and shall pay it in full prior to the termination of his probation. Failure to pay restitution within the period

of probation is a violation of probation, but nevertheless, shall survive the term of probation; E. Defendant shall be placed on a supervised probation for a period of three (3) years with the following terms and conditions of probation: 1. Defendant shall report to the Adult Probation Office once a month in person, or as ordered by the Adult Probation Office; 2. Defendant shall report to the Clients Services and Family Counseling Division of the Court, and to Guam Behavioral Health and Welfare Center (GBHWC) for intake and assessment. Defendant shall follow all treatment recommendations including psychological evaluation, psychiatric evaluation, drug and alcohol evaluation, individual counseling, group counseling and/or family counseling; 3. Defendant shall not miss more than one unexcused absence from each course of counseling and/or treatment. A second unexcused absence shall be considered as a violation of probation, and will result in the recommendation to revoke probation and implementation of the suspended sentences. 4. Defendant shall attend parenting classes; 5. Defendant shall have no contact with, and stay away from, [Name Omitted] until after Defendant completes assessments with Client Services and Family Counseling Division of the Court and GBHWC; 6. Defendant shall not harass, threaten, physically strike, or injure [name omitted] or any family or household member, whether or not named in the court order; 7. Defendant shall perform three hundred (300) hours of community service, not convertible, except that every hour of counseling and treatment attended shall serve as three (3) hours of credit toward community service; 8. Defendant shall not possess or consume any alcoholic beverages and/or illegal controlled substances; 9. Defendant shall not associate with any felon known to him as felons; 10. Defendant shall stay away from all firearms, and is not to possess, carry, transfer, or use any firearm, including AirSoft weapons/pistols/rifles; 11. Defendant shall turn in passport, and/or other travel documents to the Adult Probation Office, if any; 12. Defendant shall not leave Guam without the approval of the Court or Adult Probation Office, with prior notice being given to the Office of the Attorney General, Prosecution Division; 13. Defendant shall comply with any other conditions imposed by the Court or Adult Probation Office; 14. Defendant shall comply with any Court orders entered against the Defendant, including orders of any other local or federal court of competent jurisdiction; and 15. Defendant shall obey all local and federal laws
