August 5, 2014 The regular bi-monthly meeting of the Lafayette Township Committee was held on Tuesday, August 5, 2014 at 7:30 P.M. in the Municipal Building, 33 Morris Farm Road, Lafayette, NJ Members Present: Members Absent Also Present: Mayor D Angeli, Committeemen Corcoran, Henderson, Hughes and Bruning None Clerk Fedish, Attorney Kurnos, Road Foreman Macko Mayor D Angeli opened the meeting stating that it was being held in compliance with Public Law 1975, Chapter 231, Sections 4 & 13. Minutes - Motion by Corcoran, seconded by Hughes, to accept and place on file the minutes of July 1, 2014. Motion carried by roll call vote: Corcoran-yes, Henderson-yes, Hughes-yes, Bruning-yes, Presentation - Mayor D Angeli presented Mr. John Crane with a desk clock for his many years of volunteer service to the Township for keeping the roads clear of litter. Reports Tax Collector - For July 2014 Lieu of Tax $490.77 Tax Map Fee $150.00 Prior Year Taxes $4,316.90 Current Year Taxes $563,312.32 Prepaid Taxes 2015 $10,692.34 Interest $1,518.94 Total $580,400.27 Motion by Hughes, seconded by Corcoran, to accept the Tax Collector s report as submitted. DeFeo Tax Refund Resolution - Motion by Hughes, seconded by Henderson, to adopt the following Resolution: RESOLUTION OF THE LAFAYETTE TOWNSHIP COMMITTEE TO AUTHORIZE THE TAX COLLECTOR TO ISSUE A REFUND TO GEORGE DE FEO IN THE AMOUNT OF $418.56 AND TO CANCEL 2014 TAXES IN THE AMOUNT OF $5,341.66 DUE TO THE APPROVAL OF A TAX EXEMPTION FOR BLOCK 5.01, LOT 20 WHEREAS, the Veterans Administration assigned a 100% Disabled Veteran rating to George De Feo who resides 25 Snover Rd., known as Block 5.01, Lot 20; and WHEREAS, an application for 100% Exempt Disabled Veteran status was made to the Tax Assessor on June 11, 2014, and the Tax Assessor approved the determination, which makes Mr. De Feo exempt from paying property taxes as of that date; and WHEREAS, the property taxes were billed in the amount of $9,558.25 for the year 2014, and based on his exemption date of June 11, 2014, the total taxes due for the property from the period of January 1, 2014 to June 10, 2014 are $4,216.59. Mr. De Feo previously paid 1 st and 2 nd quarter taxes in the amount of $4,635.15, resulting in an overpayment in the amount of $418.56, and the balance of the 2014 taxes should, also, be cancelled due to this exemption. NOW, THEREFORE, BE IT RESOLVED by the Township Committee of the Township of Lafayette, County of Sussex, State of New Jersey, that Daryn Cashin, the Tax Collector, be authorized to refund George De Feo in the amount of $418.56, and to cancel the balance of the 2014 taxes in the amount of $5,341.66. BE IT FURTHER RESOLVED that a certified copy of this resolution be forwarded to the Tax Collector, the Chief Financial Officer, and Township Auditor for their records. 8.5.14 TC Mins. Page 1 of 5

Committee Reports Recreation Commission - Bruning reported Wilfred Jiroux has resigned from the Recreation Commission effective immediately. Motion by Bruning, seconded by Hughes, to appointment Howard Drake to the Recreation Commission to an unexpired term expiring December 2015. Bruning reported 20+ children are enrolled in the summer program. Buildings & Grounds - Motion to approve Chelbus Cleaning Co. to clean the windows of the Municipal Building at a cost of $425.00 as quoted. Motion carried by roll call vote: Corcoranyes, Henderson-yes, Hughes-yes, Bruning-yes, Affordable Housing - Hughes reported a comment letter was sent August 1, 2014 to COAH regarding the revised numbers. Welcome Signs - Hughes reported the approximate cost per sign would be $1,985.00, without installation. A subcommittee will meet soon to discuss the signs. Fire Department - Henderson reported the Fire Department responded to 20 calls in July. Board of Health - Corcoran reviewed the July 28, 2014 meeting. He stated this year s rabies clinic will be held on Saturday, November 8, 2014 at the fire house. EMS - Corcoran reported the EMS responded to 29 calls in July. Land Use Board - Corcoran reviewed the July 24, 2014 meeting. Streets and Roads - D Angeli reviewed the Road Foreman s report. Motion by Bruning, seconded by Hughes, to introduce the following Ordinance and set the public hearing date of September 2, 2014: AN ORDINANCE OF THE TOWNSHIP OF LAFAYETTE, SUSSEX COUNTY, NEW JERSEY, PROVIDING FOR ROAD REPAIRS TO PELLETOWN ROAD AND APPROPRIATING $87,000.00 FROM THE CAPITAL IMPROVEMENT FUND BE IT ORDAINED by the Township Committee of the Township of Lafayette, County of Sussex, New Jersey, as follows: Section 1. The funding for road repairs to Pelletown Road is hereby authorized; and the cost is not to exceed $87,000.00 which sum is hereby appropriated for such purposes. 8.5.14 TC Mins. Page 2 of 5

Section 2. The total amount of $87,000.00 is hereby appropriated from the Capital Improvement Fund. Section 3. This Ordinance shall take effect upon publication of notice of final adoption as provided by law. Motion by Hughes, seconded by Henderson, to authorize the Township Engineer to proceed with discretionary aid and grant applications for Monroe and Old Beaver Run Roads at a cost not to exceed $550.00. Motion carried by roll call vote: Corcoran-yes, Henderson-yes, Hughes-yes, Bruning-yes, Old Business Road Repairs Spending Ordinance - Mayor D Angeli opened the public hearing for the following Ordinance: AN ORDINANCE OF THE TOWNSHIP OF LAFAYETTE, SUSSEX COUNTY, NEW JERSEY, PROVIDING FOR THE PURCHASE OF CATCH BASINS AND ROAD MATERIALS FOR ROAD REPAIRS AND APPROPRIATING $20,000.00 FROM THE CAPITAL IMPROVEMENT FUND With there being no comments from the public, Mayor D Angeli closed the public hearing. Motion by Bruning, seconded by Hughes, to adopt the Road Repairs Spending Ordinance. Dispatch Services - Hughes reported a meeting was held on July 31, 2014; and John Strowe, EMS Captain, will test radio frequencies. A request for a proposal from Newton dispatch is needed by the next meeting on September 2, 2014. New Business Fire Truck - Chief John Elzinga explained the fire truck needs body work; and the repair would last approximately ten (10) years. It was suggested by the Township Committee that the Fire Department pay for the repair; and the amount would be included in next year s budget for repayment to the fire department. Audience Fire Chief John Elzinga asked that the Road Department mow the Lawler property so the property can be used as a landing zone. The Township Committee agreed. Ms. Jackie Espinoza, JCP&L representative, said JCP&L would staff the county dispatch center if requested. Committeeman Bruning asked for a list of street lights and their locations that the Township pays for. Kevin O Leary, Land Use Board Chairman, said the Land Use Board is reviewing the height ordinance; and it should be completed at their next meeting on August 28, 2014. 8.5.14 TC Mins. Page 4 of 5

Executive Session - Motion by Henderson, seconded by Bruning, to adopt the following resolution: A RESOLUTION OF THE TOWNSHIP COMMITTEE OF THE TOWNSHIP OF LAFAYETTE, COUNTY OF SUSSEX, STATE OF NEW JERSEY, AUTHORIZING CONFERENCE OF THE TOWNSHIP COMMITTEE WITH THE PUBLIC EXCLUDED WHEREAS, it is deemed appropriate that the Township Committee discuss the matter(s) hereinafter mentioned without the presence of the public in accordance with the provisions of R.S. 10:4-12b, being Section b of the Open Public Meetings Act. NOW, THEREFORE, BE IT RESOLVED by the Township Committee of the Township of Lafayette, in the County of Sussex, State of New Jersey as follows: A matter relating to property acquisition shall be discussed by the Township Committee without the presence of the public. It is anticipated that this matter can be disclosed to the public upon resolution of the matter. D Angeli. Exec.
