NOTES OF COUNCIL MEETING July 3, 2018 Dangerous Building 449 S. Olive Hearing Notifications PUBLIC HEARING Dangerous Building - 449 South Olive Mayor Dennis Watz called a hearing to order at City Hall, 210 West Washington, at 7:00 p.m. regarding property located at 449 South Olive (all of Lot 8 of Block 7 of Dunnigan s Addition in Crawford County). Attending the hearing were Alderman Ward Two T.J. Carey, Alderman Ward Two Jason Alexander, Alderman Ward One Mark Dalton, and Alderman Ward Three Paul McCulloch. Alderman Ward One Tony Wessler and Alderman Ward Three Bobby Maupin were unable to attend. Also attending were City Attorney Justin Head, City Administrator J.T. Hardy, City Clerk Jan Koch, Code Administrator Dan King, City Engineer Robert Schaffer, Certified Court Recorder Patsy Mayberry, and citizen Bob Hathman. After receiving an oath from Recorder Mayberry, Code Administrator Dan King reported he externally inspected the property located at 449 South Olive and property owners were notified to vacate, vacate & repair, or vacate & demolish said building. The property owner failed to do the aforementioned. Property owner Audrey Manues was not present. The other property owner, Loretta Eisenhauer is now deceased. 449 South Olive Written Notifications Code Administrator Dan King outlined a time line of events regarding 449 South Olive: 1. On March 7th, 2018, a fire occurred at the structure causing extensive damage. 2. Upon request, the City Attorney conducted a title search of the property to determine the owners or any other interested parties on March 9, 2018. 3. The Certificate of Title was received on April 24, 2018, which determined the owners of the property to be Audrey Manues and Loretta Eisenhauer (deceased). 4. Notice to vacate and repair or demolish the structure within thirty days was sent to the City Attorney on April 25, 2018, in order that the owner could be personally served. 5. The owner was served notice of the 30 days to vacate and repair or demolish the structure on May 2, 2018. 6. No response was received from the owner within the stated 30 day time frame. 7. Notice of the hearing and the date of the hearing before the City Council was sent to the City Attorney on June 13, 2018, in order that the owner could be personally served. 8. The owner was served the notice of the July 3, 2018, hearing on June 14, 2018. 9. As of June 27, 2018, the owner of 449 S. Olive has had no correspondence with the Code Administration department and there has been no work done to the structure at that address. 10. Photographs of the property were obtained for the hearing on June 27, 2018.

Code Report Board Declaration Hearing Adjourned Attendance Pledge Agenda Minutes Code Administrator Report Code Administrator Dan King reported that 449 South Olive meets the definition of a Dangerous Building per City Code 510.020 in that the building is detrimental to the health, safety or welfare of the residents of the city and has been so damaged by fire as to become dangerous to life, safety or the general health and welfare of the occupants or the people of the city. Dangerous Building 449 South Olive - Board Action Mayor Watz asked for Board input on 449 South Olive pursuant to City Code 510. Alderman McCulloch made a motion to declare the property at 449 South Olive a dangerous building based on the findings & evidence presented. Alderman Alexander seconded the motion and it carried unanimously. After this hearing, the property owner(s) have thirty days in which to respond. Hearing Adjourned Being no further input, the hearing was declared adjourned at approximately 7:10 p.m. CALL TO ORDER Roll Call Mayor Dennis Watz called the council meeting to order in the Council Room at City Hall, 210 West Washington, Sullivan, Missouri at approximately 7:10 p.m. Roll call was taken and attending the meeting were Alderman Ward Two Jason Alexander, Alderman Ward Three Paul McCulloch, Alderman Ward Two T.J. Carey, and Alderman Ward One Mark Dalton. Alderman Ward One Tony Wessler and Alderman Ward Three Bobby Maupin were unable to attend. Also attending was City Administrator J.T. Hardy, City Attorney Justin Head, City Clerk Jan Koch and City Engineer Robert Schaffer. PLEDGE OF ALLEGIANCE At this time, the Pledge of Allegiance was recited by everyone present. The Pledge was followed by a moment of silence. AGENDA APPROVAL Alderman McCulloch made a motion to approve the agenda as presented. Alderman Alexander seconded the motion and it carried unanimously. MINUTES APPROVED Notes from the council meeting held June 19, 2018 were presented. Alderman Carey made a motion to approve the minutes as submitted. Alderman McCulloch seconded the motion and it carried unanimously. Notes from the closed council meeting held June 19, 2018 were presented. Alderman Carey noted one correction then made a motion to approve the minutes as corrected. Alderman McCulloch seconded the motion and it carried unanimously. Page - 2

Block Party Street Closure 7/27/18 Oak Grove & City Transportation Tax Project Cumberland Way Sidewalk Bids REQUESTS & PETITIONS Temporary Street Closure - July 27, 2018 Gaskill Grounds, LLC submitted a request to temporarily close a portion of Clark Street from 6:00 p.m. until 8:00 p.m. on Friday, July 27, 2018 for a block party. The portion of Clark Street would be from Euclid Avenue to North Clark. No section of Euclid will actually be closed. Fricks Market entrances will not be affected. Sullivan Fire District, Police Department and EMS have been contacted and stated no objections. Gaskill is working to collaborate with Fidelity Communications for their support and permission as well. The purpose of the block party is to bring more citizens to the downtown area. There will be live music, food, and an assortment of craft and retail vendors lining the street for customers to shop. Alderman McCulloch made a motion to approve the temporary street closure as outlined. Alderman Carey seconded the motion and it carried unanimously. CITY ADMINISTRATOR Transportation Fund - Oak Grove Village The City of Sullivan is seeking a 50/50 cost share agreement for the signalization of the 226 overpass near Flying J. The application deadline is August 3, 2018 with potential award after the committee s September 27, 2018 meeting. The total cost for the project is estimated to be $912,726.41 with $456,363.21 coming from the shared transportation fund with Oak Grove. The Village of Oak Grove is also requesting $822,966 in Surface Transportation Improvement Program funds to rebuild the South Outer Road from Highway 185 South to just east of Emma Lane where MoDOT maintenance begins. The roadway is beginning to fail from increased truck traffic. Oak Grove is asking to use $317,636 from the shared transportation fund. Oak Grove indicated they felt this would be a project that benefits both communities in that they feel that some of the increased truck traffic is due to products and materials being hauled to Menards, trucks hauling sludge from the wastewater treatment plant. At the Village of Oak Grove s meeting held June 11, 2018, a motion was made to agree to use shared transportation funds for the signalization of Exit 226 if the City of Sullivan agrees to using the shared funds for the rebuilding of Springfield Road. Some discussion ensued. It was the general consensus of the Board to draft a Memorandum of Understanding between City & Oak Grove regarding the use of the shared Transportation Fund which will involve waiving the three-year restriction stipulation pursuant to the settlement agreement passed on February 17, 2009 per Ordinance No. 3317. The MOU will be presented at the July 17, 2018 council meeting contingent upon Oak Grove Village s execution of same. Bids - Cumberland Way Sidewalk Project Bids were advertised and opened on June 28, 2018 for the Cumberland Way Sidewalk Project which would remove asphalt curb, construct new concrete curb & gutter, and construct a new sixfoot sidewalk on the east side of Cumberland Way from Springfield Road to Walmart Drive. The bids are briefly summarized as follows: Bidder/Address Total Bid 1) Macx General Contracting, LLC Sullivan, MO $194,146.51 Page - 3

2) Total Building Solutions, LLC Bourbon, MO $128,425.00 3) KJU, Inc dba/kj Unnerstall Construction Co. Washington, MO $112,560.50 4) Donald Maggi, Incorporated Rolla, MO $78,188.16 Staff recommended accepting the lowest qualifying bid from Donald Maggi, Incorporated in the amount of $78,188.16. Alderman Dalton made a motion to approve staff s recommendation with Alderman Alexander seconding it. The motion carried unanimously. (See Ordinance No. 3800 later on in the meeting.) Nova Chip 2018 Project Closed Session July 2018 Finances Library Bldg & School Contract Tabled Cumberland Sidewalk Nova Chip Project Nova chip paving started Tuesday, July 3, 2018. Streets being paved are: Stratford, Cherry, Warren, Elizabeth, Sarah, Ozark, Grace, Jones, South Church from East Vine to the railroad crossing, Main Street from North Clark to South Church. Grinding and preparatory work has begun and paving has been planned for Thursday, Friday, and possibly Monday (July 5-9). City staff asked that residents not park any cars, trucks, trailers, boats or any other vehicles and/or any basketball goals on the City Streets from July 3rd July 10th until the streets are completed. It was noted that should it rain any time during the planned time period, operations could be delayed accordingly. CITY ATTORNEY Closed Session City Attorney Justin Head reported there was one matter concerning real estate and one matter concerning personnel for closed session. FINANCE COMMITTEE July 2018 Alderman Dalton was appointed to review the monthly bills for July 2018 with Alderman Carey named as the alternate. ORDINANCES Sale of Library Building - 104 West Vine Bill No. 3799 sponsored by Alderman Paul McCulloch, was not introduced nor read. Alderman McCulloch stated that he felt that a full board should be present to vote on this real estate contract with the Sullivan C-2 School District. He then made a motion to table Bill No. 3799 which was seconded by Alderman Alexander. The motion carried unanimously. Passage of this bill would approve the sale of the city property currently housing the library for the full appraised price of $186,000. Cumberland Way Sidewalk - Maggi Contract Bill No. 3800 sponsored by Alderman Tony Wessler, being an ordinance approving a contract Page - 4

agreement with Donald Maggi, Incorporated which agreement deals with the Cumberland Way Sidewalk Project in the City of Sullivan, in the amount of Seventy Eight Thousand One Hundred Eighty Eight Dollars and Sixteen Cents ($78,188.16), and authorizing the Mayor to execute, was introduced and read two times. The question was asked, Shall Bill No. 3800 become Ordinance No. 3800? The aldermen were polled and voted as follows: Alderman Tony Wessler, (absent); Alderman Jason Alexander, aye; Alderman T.J. Carey, aye; Alderman Paul McCulloch, aye; Alderman Mark Dalton, aye; and Alderman Bobby Maupin, (absent). Passage of this ordinance approved a contract with Maggi to construct new concrete curb & gutter and 6' sidewalk on the east side of Cumberland Way from Springfield Road to Walmart Drive. Community Upkeep 2018 Fireworks ALDERMEN INPUT Maintenance Alderman Carey reported that some business areas need to address grass growth. He indicated he would check into it and follow up. Alderman McCulloch reported that a gentleman has been picking up trash along Highway D and other areas and acknowledged his efforts which are greatly appreciated. MAYOR INPUT Fireworks Display Administrator Hardy reminded everyone about the Independence Day fireworks display being held on July 4, 2018. Sponsors for this event are First State Community Bank, Havin Material, Meramec Tire, and the City of Sullivan. The concession stand will be open and the local business Sweet Treats will be there. Mayor Watz stated that he would like to see this event coordinated between the Chamber of Commerce and the VFW. Pacific FCML Mtg CITY CLERK FCML Meeting The next Franklin County Municipal League meeting has been scheduled for Wednesday, July 18, 2018 in Pacific, Missouri. Closed Session CLOSED SESSION The time was approximately 8:00 p.m. and Alderman Alexander made a motion to adjourn into closed session to discuss one matter concerning real estate and one matter concerning personnel. Alderman Dalton seconded the motion and it carried with a roll call vote as follows: Alderman Bobby Maupin, (absent); Alderman Mark Dalton, aye; Alderman Jason Alexander, aye; Alderman Tony Wessler, (absent); Alderman Paul McCulloch, aye; and Alderman T.J. Carey, aye. Closed Results CLOSED RESULTS As a result of the closed meeting held July 3, 2018 one matter concerning real estate with no final results to report at this time. One matter concerning personnel was discussed with the Board taking the following action: Page - 5

Marcus Johnston Transfer to Street Dept Return to Open Street Department Replacement Due to the resignation of Street Department employee Robert Stein, applications were taken and reviewed. Street Commissioner Larry Cuneio recommended Marcus Johnston to fill the full-time semi-skilled laborer position. The pay is Grade 9(1) $14.80 per hour. This is a pay grade difference from his current pay of Grade 10(1) $16.28 per hour. The start date will be determined at a later time. A motion was made and duly seconded to approve the Street Commissioner s recommendation. The motion carried with a roll call vote as follows: Alderman Mark Dalton, aye; Alderman Bobby Maupin, (absent); Alderman Tony Wessler, (absent); Alderman Paul McCulloch, nay; Alderman Jason Alexander, aye; and Alderman T.J. Carey, aye. RETURN TO OPEN The Board reconvened into open session at approximately 8:45 p.m. Adjourn ADJOURN Being no further business at this time, Alderman Alexander made a motion to adjourn. Alderman McCulloch seconded the motion and it carried unanimously with a roll call vote as follows: Alderman Bobby Maupin, (absent); Alderman Mark Dalton, aye; Alderman Jason Alexander, aye; Alderman Tony Wessler, (absent); Alderman Paul McCulloch, aye; and Alderman T.J.
