A RESOLUTION SETTING PUBLIC HEARINGS RELATING TO AN AREA REZONING, THE GENERAL LOCATION OF WHICH IS SOUTH OF HILLSBOROUGH AVENUE, EAST OF INTERSTATE 275, NORTH OF DR. MARTIN LUTHER KING JR. BOULEVARD, AND WEST OF 1 5 STREET, ~ IN THE CITY OF TAMPA, FLORIDA; FROM ZONING DISTRICT CLASSIFICATIONS FOR RESIDENTIAL SINGLE-FAMILY (RS-50 AND RS- 60), RESIDENTIAL MLTLTI-FAMILY @M-12 AND RM-24), RESIDENTIAL OFFICE (RO), COMMERCIAL GENERAL (CG), AND COMMERCIAL INTENSIVE (CI), TO SEMINOLE HEIGHTS-SPECIFIC ZONING CLASSIFICATIONS, SH-RS, SH-RM, SH-RO, SH-CG, AND SH-CI; PROVIDING FOR NOTICE; PROVIDING AN EFFECTIVE DATE. WHEREAS, a motion was duly made and adopted by the City Council of the City of Tampa, Florida, calling for a public hearing for consideration of an area rezoning with respect to property hereinafter referred to; and WHEREAS, Florida Statutes Section 166.041(3)(~)2 sets forth specific public hearing and publication requirements for proposed area rezonings which involve ten (10) contiguous acres or more; and WHEREAS, the City of Tampa proposes such an area rezoning in this case which is in excess of ten (10) contiguous acres and therefore it is necessary to set public hearings and provide for notice of the same; and WHEREAS, a public hearing for consideration of such proposed area rezoning is necessary and proper. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF TAMPA, FLORIDA: Section 1. That public hearings shall be held by the City Council of the City of Tampa on December 13,2012, at 5:01 p.m. and January 10,2013, at 9:30 a.m., in Council Chambers, Third Floor, City Hall, 315 East Kennedy Boulevard, in the City of Tampa, Florida, at which public hearings all parties in interest and citizens may appear and be heard as to any and all matters pertinent to a proposed Area Rezoning pertaining to certain property the general location of which is per the attached boundary map: (Map attached hereto and made a part hereof as Exhibit A)

Section 2. In lieu of publication, that the Planning Division is hereby directed to notify each property owner whose land is proposed for rezoning pursuant to the rezoning ordinance, by mail at least thirty (30) days in advance in accordance with procedures established by state law Florida Statutes 166.041(3)(~)(2)(~) and City of Tampa Code of Ordinances, Chapter 27 Zoning, Section 27-394(c). The notice shall clearly explain the proposed ordinance and shall notify the person of the time, place and locations of the public hearings on the proposed ordinance. Section 3. WHEREAS, pursuant to the authority contained in Ordinance No. 2007-199, passed and ordained by the City Council of the City of Tampa on October 4, 2007, City Council is authorized to appoint certain members to the Variance Review Board; and, WHEREAS, the City Council of the City of Tampa, by motion and vote on November 1, 2012, has appointed Susan Long as an alternate member of the Variance Review Board to fill the unexpired term of Nicholas Bradford, ending February 28, 2016. BE IT RESOLVED BY THE ClTY COUNCIL OF THE ClTY OF TAMPA, FLORIDA: NOW, THEREFORE, Section 1: That the City Council of the City of Tampa approves, ratifies and confirms the appointment of Susan Long as an alternate member of the Variance Review Board to fill the unexpired term of Nicholas Bradford, ending February 28, 2016 Section 2: That the proper officers of the City of Tampa are hereby authorized to do all things necessary and proper in order to carry out and make effective the provisions of this resolution. Section 3: That this resolution shall take effect immediately upon its adoption, nunc pro tunc to November 1,2012.
