Section 11357(a) H&S was amended on November 8, 2016 by Proposition 64 to apply to possession of not more than 28.5 grams of marijuana, or not more than 4 grams of concentrated cannabis. Such a possession is an infraction and it only applies to persons under the age of 21. 1

PROPOSITION 47 EXECUTIVE SUMMARY COUNTYWIDE 70,265 Proposition 47 Offenders identified by fingerprints. 130,105 Proposition 47 Arrests. 40,294, or 57% of Proposition 47 Offenders, are classified as Repeat Offenders. 133,447 subsequent arrests of Repeat Offenders for any offense. 21,422, or 53% of Repeat Offenders, were arrested for a Part I Crime. LASD 29,055 Proposition 47 Offenders identified by fingerprints. 48,632 Proposition 47 arrests. 19,100, or 66% of Proposition 47 Offenders, are classified as Repeat Offenders. 41,398 subsequent arrests of Repeat Offenders for any offense. 8,007, or 42% of Repeat Offenders, were arrested for a Part I Crime. OVERALL TRENDS Of all Proposition 47 charges, arrests commonly included a narcotics offense, most frequently 11377 HS. 1 Repeat Offender was arrested 80 times. This total includes the offender s initial Proposition 47 arrest and every subsequent arrest. The subsequent arrest could have been for any offense, not specifically for a Proposition 47 related offense.
