AGENCY CASE NO: 17-15715 JAMES MARSHALL MACARTHUR RACE/SEX: W/M DOB: SSN: Defendant, AFFIDAVIT FOR ARREST BEFORE ME, Jennifer J. Johnson, a Judge of the above captioned court, personally appeared Law Enforcement Senior Inspector Carrie Barcia, who being first duly sworn, deposes and says: WHERAS, On August 30, 2017 at approximately 9:00 PM, co-defendant Klinton Cooper instructed the defendant and co-defendant Ronald Hendricks Jr. to bring Inmate (victim) to his office. Co-defendant Hendricks woke the victim up, handcuffed him behind his back and removed him from the dormitory. The defendant and codefendant Hendricks escorted the victim to the Lieutenant's Office, he defendant and the co-defendants closed the door and told the victim that he was being punished for being disrespectful earlier in the day. The defendant struck the victim in the face and then yanked him up by the handcuffs, causing the victim to fall to the ground. The victim closed his eyes, and was then kicked and punched multiple times in the face and head. The victim did not see which officers participated. The victim The victim was instructed to hide his face from the other inmates when he returned to the dormitory to avoid a protective investigation. Co-defendant Hendricks and the defendant escorted the victim back the dormitory. Within a few minutes, other inmates in the dormitory alerted the housing officer that the victim The housing officer exited the Officer's Station and briefly spoke to the victim. The housing officer returned to the Officer's Station and contacted co-defendant Cooper about the dormitory being in chaos and the victim

Co-defendant Cooper instructed the defendant and codefendant Hendricks to return to the dorm to handle the situation and to bring the victim back to his office. The defendant and co-defendant Hendricks returned to the dormitory, and conducted a false investigation into what happened to the victim. Multiple inmate witnesses indicated that both the defendant and Co-defendant Hendrick's hands looked as though they had been involved in a fight. The defendant and co-defendant Hendricks removed the victim from the dormitory and brought him back to the Lieutenants Office. The victim was instructed to write a statement indicating that he had been beaten by inmates in the dormitory bathroom. The defendant took photographs of the victim blew on the camera lens to intentionally distort the photographs. The defendant The victim was transported to Cross City Correctional Institution (Main Unit) and placed into Disciplinary Confinement for reported use of K-2 (synthetic marijuana). After the victim was taken to the Main Unit, the defendant asked a subordinate correctional officer to write a "kite" (a common term in corrections used to describe a handwritten note, generally passed from inmate to inmate) indicating that the victim needed protection from the Latin King gang. The officer wrote the "kite" and gave it to the defendant. Co-defendant Cooper wrote Incident Report #1708-060 indicating that he received an anonymous "kite" that expressed that the victim needed protection from the Latin King gang. Co-defendant Cooper wrote that the defendant brought the victim to the lieutenant's office to discuss the "kite". Co-defendant Cooper wrote in his report that the victim denied that he needed protection, but was subsequently battered by several unknown inmates after the officers allowed the victim to return to the dormitory. The statement written by the victim, the distorted photographs, and the "kite" were attached as evidence to Incident Report #1708-060. The co-defendant Hendricks was placed under oath and provided sworn testimony to the Office of the Inspector General that another officer found the "kite" in the dormitory and told him about it. The defendant called co-defendant Cooper and told him about the "kite" which was the reason the inmate was originally taken out of the dormitory.
