APPROVE Unanimous (1) Ha: A (2) Quach: Y (3) Rice: Y (4) Irons: Y (5) McCormick: Y d ITEM #2 DISCUSSION OF BOARD OF SUPERVISORS DECEMBER 13, 2016 REFERRAL OF ESPERANZA HILLS PROJECT TO PLANNING COMMISSION TO CONSIDER FURTHER OPTIONS LOCATION THE PROJECT IS LOCATED WITHIN THE UNINCORPORATED AREA OF ORANGE COUNTY NORTH OF THE SR 91 FREEWAY OFF YORBA LINDA BOULEVARD, SOUTH AND WEST OF CHINO HILLS STATE PARK, WITHIN THE CITY OF YORBA LINDA SPHERE OF INFLUENCE, WITHIN THE 3RD SUPERVISORIAL DISTRICT. On December 13, 2016, the Board of Supervisors referred the Esperanza Hills project back to the Planning Commission with direction to consider a secondary access via Aspen Way, further study of the bridge option versus Option 1, and consider a reduced unit project. Recommended Action: 1) Receive Board of Supervisor s Minute Order dated December 13, 2016; 2) Receive information from project applicant, and staff as necessary, regarding potential modifications to the Esperanza Hills Specific Plan project responding to the Board of Supervisor action of December 13, 2016; 3) Direct staff to coordinate with applicant to submit project materials that analyze the following, pursuant to Board direction: a. A secondary access option via Aspen Way; and/or b. A reduced unit project utilizing either the Modified Option 1 (Bridge) or Option 1 access, with the option of increasing units should a secondary access be obtained; and, - PAGE 2 Page 2 of 7
4) Direct staff to prepare a Planning Commission report, pursuant to Government Code section 65857, to the Board of Supervisors stating that the Planning Commission received the Board s direction from December 13, 2016 and has directed staff to coordinate with the applicant to submit materials to allow the Planning Commission to fully consider the Board direction. Special Notes: Kevin Canning, Planner, provided a presentation and answered questions of the Planning Commission. Gary Lamb, architect on the project answered questions of the Planning Commission. Members of the public donated their speaking time to Attorney, Kevin Johnson. Mr. Johnson spoke in opposition of the project. A motion to approve the recommended actions, with the third recommended action modified to reflect the Board s direction to consider a secondary access via Aspen Way, further study of the Bridge option versus Option 1, and consideration of a reduced unit project, was made by Commissioner Irons and seconded by Commissioner Ha and was carried by a unanimous vote. A public hearing on Planning Application PA160036 to review and approve a proposed site development permit for a new single-family residential dwelling with attached garage located in the Foothill/Trabuco Specific Plan area. - PAGE 1 Page 4 of 7
Recommended Action(s): 1) Receive staff report and public testimony as appropriate; and, 2) Find that the proposed project is statutorily exempt under California Code of Regulations Title 14, Section 15182 and Government Code Section 65457 (a), which exempt residential development projects that are consistent with a specific plan for which an environmental impact report was certified after January 1, 1980. Final EIR No. 531, certified on December 10, 1991 for the Foothill Trabuco Specific Plan is such a specific plan and this residential development is consistent with it; 3) Approve Planning Application PA160036, a Site Development Permit for a new single family residential dwelling with attached garage, subject to the attached Findings and Conditions of Approval. Special Notes: Ilene Lundfelt, Planner, provided a presentation and answered questions of the Planning Commission. Bruce Goren, property owner, answered questions of the Planning Commission. APPROVE d ITEM #2 PLANNING APPLICATION PA120037 - TO CONSIDER THE PLANNING COMMISION S RECOMMENDATIONS TO THE BOARD OF SUPERVISORS, REGARDING PROPOSED GENERAL PLAN AMENDMENT LUE 16-01, ZONE CHANGE ZC 16-05, ADOPTION OF THE ESPERANZA HILLS SPECIFIC PLAN, AND CERTIFICATION OF A REVISED FINAL ENVIORNMENTAL IMPACT REPORT 616. APPLICANT YORBA LINDA ESTATES, LLC LOCATION THE PROJECT IS LOCATED WITHIN THE UNINCORPORATED AREA OF ORANGE COUNTY NORTH OF THE SR 91 FREEWAY OFF YORBA LINDA BOULEVARD, SOUTH AND WEST OF CHINO HILLS STATE PARK, WITHIN THE CITY OF YORBA LINDA SPHERE OF INFLUENCE, WITHIN THE THIRD (3RD) SUPERVISORIAL DISTRICT. A public hearing on Planning Application PA120037 to consider recommendations to the Board of Supervisors on a Revised Final EIR, General Plan Amendment, Zone Change, and adoption of a Specific Plan for a 340-unit gated community located in the Yorba Linda sphere of influence. Recommended Action: 1) Receive staff report and public testimony as appropriate; and, 2) Consider the adequacy of Revised Final EIR No. 616 (RFEIR616), prepared for the Esperanza Hills Project and revised pursuant to the Writ of Mandate issued August 24, 2016 in Protect Our Homes and Hills, et al. v. County of Orange, et al. Case No. 30-2015-00797300, and as augmented by the Additional Environmental Analysis memorandum dated February 21, 2017, and determine that RFEIR 616 is adequate, complete and appropriate environmental documentation for the Project consistent with CEQA, the State CEQA Guidelines, and the County s Local CEQA Procedures Manual; and, - PAGE 2 Page 5 of 7
3) Consider General Plan Amendment LUE 16-01 (Land Use Element), which changes the property from 5 Open Space to 1B Suburban Residential; Zone Change 16-05, which changes the property from A1 Agricultural and A1-(O) Agricultural with an Oil Production Overlay to S Specific Plan for the property in question; and the Esperanza Hills Specific Plan; and 4) Adopt Planning Commission Resolution No. 17-01 recommending that the Board of Supervisors: (1) certify RFEIR 616 and adopt the findings, facts in support of findings, statement of overriding considerations and mitigation monitoring and reporting plan for the Project; (2) adopt General Plan Amendment LUE 16-01; (3) adopt Zone Change 16-05; and, (4) adopt the Esperanza Hills Specific Plan. Special Notes: Kevin Canning, Planner, provided a presentation and answered questions of the Planning Commission. Gary Lamb, architect, Doug Wymore, applicant, Kevin Hills, county surveyor, and Shawna Schaffner, CAA Planning answered questions of the Planning Commission. Two members of the public spoke in opposition of the project and a representative from the City of Yorba Linda asked the Planning Commissioners if they had received the letter from the City of Linda. The Planning Commissioners confirmed receipt of the letter. A motion to consider the recommendations to the Board of Supervisors was made as follows: Motion #1 The first motion for item #2 was made by Commissioner McCormick and seconded by Commissioner Rice and was carried by a unanimous vote to: 1) Approve the adequacy of Revised Final EIR No. 616 (RFEIR616), prepared for the Esperanza Hills Project and revised pursuant to the Writ of Mandate issued August 24, 2016 in Protect Our Homes and Hills, et al. v. Motion #3 The third motion for item #2 was made by Commissioner McCormick and seconded by Commissioner Quach and was carried by a unanimous vote to recommend a pre annexation agreement be required at a date to be determined by County staff.
