Section 2 Department of Administrative Services Information Technology Inventory This section directs DAS to complete an inventory of IT devices and identify possible upgrades, changes, or other efficiencies. It directs DAS to complete a report to the General Assembly by January 1, 2013 recommending legislative action necessary. Section 3 Department of Administrative Services Information Technology Coordination and Management This section requires information technology consolidation. It requires DAS to submit an implementation schedule by July of 2012 with full implementation by December 31, 2013 (as required SF 2088). This section also directs DAS to explore procuring information technology by leasing. Division II Medication Therapy Management
Section 4 Medication Therapy Management This section establishes the Medication Therapy Program (MTM) for state employees (other than the regents). It defines medication therapy management as a systematic process performed by a licensed pharmacist, designed to optimize therapeutic outcomes through improved medication use and reduced risk of adverse drug events. A pilot program was implemented in FY 2011 and DAS entered into a contract with a private vendor. This section requires DAS to enter into another contract via an RFP for MTM services for employees that meet the eligibility criteria. The contractor is required to provide annual reports to the General Assembly concerning cost savings, estimated cost avoidance, and return on investment. Any shortfall between the calculated cost avoidance and the program s cost will be refunded to the State by the contractor. This section does permit DAS to form an advisory committee to provide advice and oversight regarding the process. Section 5 Effective Upon Enactment This section Division II effective upon enactment Division III State Physical Resources Section 6 State Employee Work Environment Analysis & Report This section requires DAS to analyze State employee work stations and office standards by September 30, 2012. The objective is to make recommendations for improving employee density, proper allocation of individual and group work space, and improving worker health and safety. This section requires DAS to submit a report to the Capitol Planning Commission and the Legislative Fiscal Committees by October 30, 2012. Division IV Audits Section 7 Audits of Governmental Subdivisions and Related Organizations Consultative Services This section is related to fees for the filing of certain audits or examinations conducted by the auditor of state. It amends Iowa Code 11.6(10) to eliminate the authority of the auditor to establish and collect a filing fee relative to certain audits conducted on certain mental health centers, substance abuse programs, and community action agencies. In addition, the bill eliminates the authority of the auditor to establish and collect a filing fee concerning an audit of a governmental subdivision relative to tests related to compliance with the investment policy of that governmental subdivision. This section was a bill (HF 2362) that passed the House unanimously. Sections 8 through 13 Commodity Audits These sections amend the code so that the state Auditor can no longer charge the following commodity groups for their audit: (this started in 2010) Iowa Sheep and Wool Promotion Board (billed $5,400) Iowa Egg Council (billed $8,400) Turkey Marketing Council (billed $7,700) Corn Promotion Fund (billed $10,700) This section strikes this requirement, so farmers check-off dollars could no longer be used to pay for state audits. This section was a bill (HF 481) that passed out of the House Agriculture Committee unanimously. Division V Homeland Security and Emergency Management Sections 14 through 64 Homeland Security and Emergency Management
Currently the Department of Public Defense is composed of the military division and the homeland security and emergency management division. These sections transfer the homeland security and emergency management division into their own agency separate from the Department of Defense. These sections retain within DPD the responsibility over the office of the adjutant general and the military forces of the state of Iowa. These sections provide that the governor appoint the director of the new Department of Homeland Security and Emergency Management. Current duties of the division are transferred into the new department. Additionally, the new department will include the Iowa emergency response commission for routine administrative support from DPD. These sections include transition provisions relative to the establishment of the new department and transfer all employees into the new department. Division VI Iowa Jobs Board Sections 65 through 80 Iowa Jobs Board These sections change statutory references from the Iowa Jobs Board to the Iowa Finance Authority, and repeal the board. Division VII Electronic Communications Section 81 & 82 State Department and Agency Limitations on Mail These sections state that unless required by legal action/federal law agencies shall not provide information or notices by mail (advertisements for tax credits or other programs). It directs agencies to use their website or communicate through email. They also protect the email address collected for this purpose. Division VIII State Records Sections 83 through 91 State Records Commission These sections make conforming changes and eliminate the State Records Commission and place those duties with the Department of Cultural Affairs. Section 92 Charges for Record Storage This section allows the Department of Cultural Affairs to charge agencies for the storage and retention of records. Sections 93 through 95 State Records Commission These sections make more conforming changes related to the elimination of the State Records Commission. Section 96 Records Retention and Storage Costs Billing Internal Service Fund This section describes in more detail how the Department of Cultural Affairs can charge and account for the storage of agency records. Sections 97 through 104 State Records Commission These sections make more conforming changes related to the elimination of the State Records Commission. Section 105 Administrative Rules Transition Provisions This section makes it clear that any rules in effect from the State Records Commission are still valid until the Department of Cultural Affairs takes affirmative action to change them.
Division IX Department of Transportation Provisions Section 106 Online Driver s License Renewals This section is a proposal is from the Governor s Road Use Tax Fund Efficiencies Report. It would allow eligible, safe drivers and non-operator ID card holders who are 18 to 65 years of age to renew their driver s license or non-operator identification (ID) card online every other renewal. (The typical term of DLs and IDs is five years; ID cards issued to persons age 70 and older do not expire). Code section 321.196(4) is amended to provide that when a driver s license is renewed electronically, the licensee would not be required to pass a vision test or file a vision report, pursuant to rules adopted by the department. Section 107 Repeal This section repeals the code section that sets the annual fee for an electric vehicle. The repeal of Iowa Code section 321.116 would place all-electric vehicles on the same footing in terms of registration fees as other passenger vehicles and place them on a weight/value registration (Code section 321.109). Code section 321.116 currently provides a $25 registration fee for electric automobiles, which declines to $15 for older electric vehicles. Section 108 Emergency Rules This section would authorize emergency rule-making to implement Section 106. Section 109 Effective Upon Enactment This section makes Sections 106 and 107 effective upon enactment. Section 110 Applicability This section makes Section 107 apply to registration years beginning on or after January 1, 2013. Division X State Debt Coordinator Section 111 Department of Revenue and Office of the State Debt Coordinator Report This section directs that the Department of Revenue Director shall develop and recommend legislative proposals necessary for the continued efficiency of the functions of the office of the state debt coordinator established in 421C.1 and file the report with the Department of Management, the governor, and the General Assembly by January 14, 2013. Division XI Pollution Prevention and Waste Management Assistance Sections 112 through 130 Solid Waste Management Code These sections are Department of Natural Resources clean up language including the elimination of a number of Solid Waste Management Code provisions that are dormant, out-of-date, superseded by subsequent Code provisions, and that have been cited by recent state audit reports for non-performance. This action is designed to rescind statutory provisions that lack a specified funding stream. The rescissions and revisions that are proposed reflect and clarify how the Department of Natural Resources is implementing and administering the specific provisions. The changes do not substantially change existing policy, programs, or procedures. Section 131 Ongoing Program Review Division XII Ongoing Program Review
This section requires the State Government Efficiency Review Committee review on a regular basis the programs and projects administered by the state. The review includes considering where modifications are needed and where programs are no longer applicable. Division XIII Boards and Commissions Eliminations Sections 132 through 135 E911 Communications Council These sections change some of the roles of the E911 Communications Council. Instead of consulting with the council, the E911 Program Manager will consult with the State Interoperable Communications System Board. Additionally, instead of making recommendations to the E911 Program Manager, the council will make those recommendations to the State Interoperable Communications System Board. Sections 136 through 138 Farm to School Council These sections eliminate the farm to school council and references thereto. Section 139 Multiple Amendments Harmonization and Prevalence This section makes some technical changes dealing with Division V and XIII. Division XIV Obsolete Provisions Section 140 Farmworks Matching Funds This section repeals the Farmworks Matching Funds under 15.112. Section 141 Repeals This sections repeals: Chapter 15C World Trade Center Chapter 15D Midwest Nuclear Compact
