West Virginia University Constitution of the Mountaineer Maniacs Preamble We, the student-fans of West Virginia University Athletics, desiring to assemble in pride for all Mountaineer Athletics do hereby establish this Constitution of the Mountaineer Maniacs. Ratification The ratification of this document occurred by a unanimous vote by the current Executive Board of the Mountaineer Maniacs on the day of the month of in the year 2014 and a ⅔ majority vote by the Student Government Association on the day of the month of in the year 2014. Article I. The Mountaineer Maniacs Section 1. Name A. Official Name The organization shall be known as the Mountaineer Maniacs. B. Nickname The organization may be referred to as the Maniacs. C. Twitter Name The organization s twitter handle shall be @WVUMANIACS. D. Instagram Name The organization s username on Instagram shall be known as: MOUTAINEER_MANIACS. Section 2. Purpose The purpose of the Mountaineer Maniacs is to promote and support the general welfare of the University, to assist West Virginia University with promoting positive sportsmanship and a safe atmosphere, and to assist and promote athletic events for the West Virginia University Athletic Department. Section 3. Vision A vast majority of the West Virginia University student body are active and regularlyparticipating members of the Mountaineer Maniacs. The membership of the Mountaineer Maniacs is a diverse group of students, in terms undergraduate or graduate student, and college major. The Mountaineer Maniacs lead the student fans to become the loudest, most energetic, unique, positive, and sportsmanlike. The student-fans of West Virginia University are revered across the Big 12 Conference and the nation for being the best student fan section at any sporting event. Section 4. Logo The logo of the Mountaineer Maniacs shall appear as:

This logo may be altered with approval of the Director in order to better accommodate illustration on banners, pictures, flyers, co-sponsorships, clothing, advertising materials, newspapers, social media, websites, publications, and books. This may happen as long as the logo keeps its general shape, form and likeness. Section 5.The Mountaineer Maniac s Creed As a Mountaineer Maniacs member, I will represent West Virginia University with dignity, pride, integrity, and honor. I will respect the athletes and fans at University sporting events and maintain a spirited level sportsmanship. I will strive to lead by example, exemplifying the characteristics of a true Mountaineer, With all my heart, I will always cheer, Let s Go Mountaineers Article II. Organizational Powers Section 1. Power. The West Virginia University Student Government Association endorses and grants to the Mountaineer Maniacs the powers as enumerated in this Constitution. Section 2. Subordination. This Constitution shall be subordinate to the United States Constitution, the Constitution of the State of West Virginia, all federal, state, and local laws, all policies and regulations of the West Virginia University Administration, of the West Virginia University Institutional Board of Governors, Student Organization Services, and Student Government Association. Additionally, the Mountaineer Maniacs will be a committee under West Virginia University Student Affairs in a cooperative effort by the West Virginia University Athletic Department and the WVU Alumni Association Section 3. Subordinate Proceedings. All policies of the Mountaineer Maniacs must be subordinate to this Constitution. Any committees or internal organization s constitutions, bylaws, policies and proceeding i.e., alumni chapter must be subordinate to this Constitution. Article III. Franchise and Citizenship Section 1. Social Justice Membership and participation are free from discrimination based on race, religion, color, sex, age, national origin or ancestry, marital status, parental status, sexual orientation, disability

status, or veteran status. All violations of Social Justice must be submitted to the Attorney General of the Student Government Association. Section 2. Membership: A. Basic Membership. Basic membership in the Mountaineer Maniacs shall be defined as all West Virginia University students who meet the following standards: 2. Member has paid Basic Membership fee in full as set by the Executive Director of the Mountaineer Maniacs. B. Ultimate Membership. Ultimate Membership in the Mountaineer Maniacs shall be defined as persons who meet the following standards. 2. Member has paid Ultimate Membership fee in full as set by the Executive Director of the Mountaineer Maniacs. C. Executive Board Membership. A Member of the Executive Board in the Mountaineer Maniacs shall be defined as person who meet the following standards. 2. Member has a minimum of a 2.0 GPA. 3. Member has been appointed by the Executive Director to a board position described in the Constitution and Bylaws of the Mountaineer Maniacs. 4. Member has formally spoken and agreed to the Mountaineer Maniacs Creed as shown in Article I. Section 3. in this Constitution. 5. Member has signed by-hand or digitally signed and agreed to the the Code of Conduct of the Mountaineer Maniacs. Section 2. Governance. The Mountaineer Maniacs shall be composed of the Basic, Ultimate and Executive Board Members. Article IV. Operations Section 1. Quorum. The Executive Board may not vote on any changes to the Constitution or bylaws without at least 75% of the Executive Board present. Section 2. Bylaws. A. The Mountaineer Maniacs shall be bound by a set of Bylaws which will dictate protocol, procedure, and duties for each component of the Mountaineer Maniacs. The Bylaws shall be

subordinate to the Constitution of the Mountaineer Maniacs. Bylaws can be altered by a majority vote of the Executive Board, where quorum is established. Section 3. Code of Conduct. The Mountaineer Maniac s Code of Conduct shall hold members of the Maniacs accountable for their behavior. The Code of Conduct can be altered by a majority of the Executive Board. Quorum must be established. The Code of Conduct must be signed the entire Executive Board upon their inauguration. Article V. Participation Section 1. Qualification and Requirements to Seek and Hold Any Appointed Positions The Alumni Advisory Committee will work with the Student Body President of the West Virginia University Student Government Association to appoint an Executive Director. The nomination shall follow the approval of the West Virginia University Student Government Association Board of Governors as their procedures describe. Section 2. Inauguration. The inauguration of the appointed positions shall occur at the final regular meeting of the academic school year. This meeting shall be known as the Welcome Meeting. At this meeting, each Executive Board Member shall be given welcome packets, officer binders, and all other necessary officer materials. Section 3. Transitions. The transition period officially begins during the inauguration. However, during the summer months prior to the start of the fall semester following a new executive board s inauguration, the outgoing board members are responsible for training, guiding, and assisting the new board members. All outgoing board members are responsible for transferring materials to incoming board members. Section 4. Limitation. The Executive Director may not hold the office of Executive Director for more than two years. A member may not concurrently hold more than two Executive Board positions. Article VI. Vacancy, Succession, Impeachment and Removal Section 1. Vacancy and Succession Once a position on the Executive Board has become vacant, it is the responsibility of the Executive Director to fill the position. If the position of the Executive Director becomes vacant on good terms (medical, family reasons, etc.) the Director is responsible for selecting an Assistant Director to succeed him or her. Section 2. Impeachment and Removal A. Impeachment

Impeachment may occur to the Director or any appointed official for maladministration, corruption, violation of the code of conduct, or dereliction or neglect of duty. The total membership shall have the power of impeachment, which shall require a ⅔ affirmative vote by the Mountaineer Maniacs Executive Board with quorum present. Lastly, Impeachment may occur by a ⅔ affirmative vote by the Student Government Association Board of Governors and all other proper impeachment proceeding outlined in their governing documents. B. Removal and Replacement If the position of Executive Director becomes vacant on poor terms (impeachment, ethics violations, resignation, neglect of duty, or criminal reasons) the Student Government Association Student Body President is responsible for selecting a successor that is already a current member of the Maniacs Executive Board, with a majority approval from the Student Government Association Board of Governor s. Within 48 hours of being removed from office, the outgoing Director must surrender all bank account access, password, keys, officer documents, etc. to the Student Body President. The Attorney General of the Student Government Association ensures this process occurs in fairness and provides oversight on the process. Article VII. Amendments Section 1. Amendments. A proposed amendment to the Constitution must be submitted to the Executive Board at least 7 days prior to a vote being held. Once the submission is made, the Director must make the entire Executive Board aware of the proposal immediately. Proposed Amendments will pass with a ⅔ approval by the Executive Board Membership preceding a ⅔ affirmative vote by the West Virginia University Student Government Association Board of Governors. Article IX. Effectiveness Section 1. Effectiveness. Upon ratification as described at the beginning of this document, this constitution shall become effective on the day of the month of in the year 2014. The current Executive Board shall continue to serve until their term expires.
