John Wolfe, Police Board Member Jim Brown, Assistant HR Director Nick DiPiazza, City Attorney Patty Frey, Fire Battalion Chief Marshall Downen, Police Officer City Manager Ed Beasley, Member Larry Clark, Citizen Member Alma Carmicle, HR Director and Board Secretary LOCAL FIRE BOARD MEETING Call to Order Mayor Elaine Scruggs called to order the Local Board meeting at 8:34a.m. Review and Approval of the August 22, 2007 Local Fire Board Meeting Minutes The minutes of the August 22, 2007 Local Fire Board meeting were reviewed. John Holland noted that a correction should be made to reflect that Mayor Scruggs was present during the Local Fire Board meeting. With that correction noted, John Holland moved to approve the August 22, 2007 minutes. Mark Manor seconded the motion. The Board voted and passed the motion unanimously. Commencement of Executive Session Mayor Scruggs recessed the Open Session meeting to convene in Executive Session to discuss and review an application for Accidental Disability Retirement and the medical evaluations for pre-existing conditions of twelve (12) Fire personnel. 1 of 5
The Board reconvened into Open Session to vote on the application for Accidental Disability Retirement and the admission of the twelve (12) Fire personnel into the Public Safety Retirement System with the pre-existing conditions noted on the medical evaluations. Review and Approve an application for Accidental Disability Retirement Dain Jeffery Dain Jeffery, a Fire Engineer, applied for Accident Disability Retirement based on his Worker s Compensation claims dated March 9, 2007 and July 9, 2003. He has been a member of the PSPRS since August 14, 1978. Accidental Disability means a physical or mental condition which the Local Board finds totally and permanently prevents an employee from performing a reasonable range of duties within the employee s job classification and was incurred in the performance of the employee s duty. (A.R.S. Section 38-842.1) In order to approve the Application for Accidental Disability Retirement, the Local Board must make a determination on the following issues in accordance with the statutes A.R.S. 38-842 and 38-844: 1. Does the claimant have a physical or mental condition which totally and permanently prevents him from performing a reasonable range of duties within his job classification Fire Engineer? John Holland moved that the claimant had a physical or mental condition which totally and permanently prevents him from performing a reasonable range of duties within his job classification Fire Engineer. Mark Manor seconded the motion. Motion passed unanimously. 2. Does the claimant s disability result from a physical or mental condition or injury that existed or occurred prior to the claimant s date of membership in the PSPRS? (August 14, 1978) John Holland moved that the claimant s disability did not result from a physical or mental condition or injury that existed or occurred prior to the claimant s date of membership in the PSPRS which was August 14, 1978. Mark Manor seconded the motion. Motion passed unanimously. 3. Was the disabling condition or injury incurred in the performance of the claimant s duty as a Fire Engineer? John Holland moved that the disabling condition or injury incurred in the performance of the claimant s duty as a Fire Engineer. Mark Manor seconded the motion. Since all of the conditions for Accidental Disability Retirement were satisfied, the application was approved. Review and Acceptance of Fire Personnel Medical Evaluations for Pre-existing Conditions Mark Manor motioned that the following individuals be accepted into the Public Safety Personnel Retirement System with the pre-existing conditions noted on the Phoenix Fire Department Health Center medical evaluations: Greg Biesen Daniel Fitzpatrick Steve Kennedy Gilbert Mancilla Nicholas Metzger Timothy Pirtle Adam Pottle Cecil Tudor Anthony Vargas John Walter III Michael Young Matthew Zongas - 2 -
John Holland seconded the motion with the notation that Gilbert Mancilla s record reflects that he is with the Glendale Fire Department and not the Gilbert Fire Department as noted on his medical evaluation report. Mark Manor seconded the motion for the notation of Gilbert Mancilla s record. Both motions were voted and passed unanimously. New Business Don F. Heatwole: Mark Manor motioned to acknowledge the fact that Don F. Heatwole, a deceased Fire employee, did not have any qualifying surviving beneficiaries and that his benefits were terminated. John Holland seconded the motion. The motion was voted and passed unanimously. December 26, 2007 Local Board meeting: The Human Resources Department was directed to work with the Fire Board members and the other Local Board members to either reschedule the December 26, 2007 Local PSPRS meeting to sometime during the month of January or to vacate it depending upon whether or not it is necessary to vote on various agenda items. Open Discussion: No other new business was discussed. Adjournment Since there was no further business for the Local Fire Board, John Holland adjourned the Local Fire Board meeting at 8:57 a.m. LOCAL POLICE BOARD MEETING Call to Order Mayor Elaine Scruggs called to order the Local Board meeting at 8:00 a.m. Review and Approval of the August 22, 2007 Local Police Board Meeting Minutes The minutes of the August 22, 2007 Local Police Board meeting were reviewed. Officer Brandon Keefer moved to approve the August 22, 2007 minutes as presented, with the correction that Lt. John Wolfe motioned instead of Marshall Downen, as indicated in the minutes. Lt. John Wolfe seconded the motion. The Board voted and passed the motion unanimously. Review and Approval of Application for Retirement from Deferred Retirement Option Plan ( D.R.O.P. ) Mark Smith The Local Police Board reviewed Mark Smith s D.R.O.P. application. Mark Smith, Police Sergeant, has 25 years of credited service. He elected to participate in the D.R.O.P. for a period of 60 months beginning on February 28, 2003. On or after this date, employee and employer contributions ceased to be made into the Public Safety Personnel Retirement System (PSPRS). He must terminate employment with the City of Glendale Police Department on or before February 28, 2008. Mark Smith has been a member of the PSPRS since December 24, 1979. - 3 -
Lt. John Wolfe moved to approve the D.R.O.P. retirement application submitted by Mark Smith, Police Sergeant. Officer Brandon Keefer seconded the motion. Motion passed unanimously. Review and Approval of Application for Retirement from Deferred Retirement Option Plan ( D.R.O.P. ) Carl Williams The Local Police Board reviewed Carl Williams D.R.O.P. retirement application. Carl Williams, Police Officer, has 20 years of credited service. He has elected to participate in the D.R.O.P. for a period of 60 months beginning on March 31, 2007. On or after this date, employee and employer contributions will cease to be made into the Public Safety Personnel Retirement System (PSPRS). He must terminate employment with the City of Glendale Police Department on or before March 31, 2012. Carl Williams has been a member of the PSPRS since February 17, 1987. Lt. John Wolfe moved to approve the D.R.O.P. retirement application submitted by Carl Williams, Police Officer. Officer Brandon Keefer seconded the motion. Motion passed unanimously. Commencement of Executive Session Lt. John Wolfe recessed the Open Session meeting to convene in Executive Session to discuss and review earned income for the continuation of Ordinary Disability Benefits and the medical evaluations for pre-existing conditions of fourteen (14) Police personnel. The Board reconvened into Open Session to vote on the continuation of Ordinary Disability Benefits and the admission of the fourteen (14) Police personnel into the Public Safety Retirement System with the pre-existing conditions noted on the medical evaluations. Review of Earned Income for the Continuation of Ordinary Disability Benefits Kristian Grube Lt. John Wolfe moved to approve the continued entitlement of Ordinary Disability Retirement benefits for Kristin Grube without an offset. Officer Brandon Keefer seconded the motion. The motion was voted upon and passed unanimously. Review and Approve Police Medical Evaluations for Pre-existing Conditions Fourteen (14) Police employee medical evaluations were reviewed. Thirteen (13) of the fourteen (14) Police Personnel met the standards of the Glendale Police Department and the Arizona Peace Officer Standards and Training Board. One of the Police employees separated from the City of Glendale prior to the meeting of the Local Board. Officer Brandon Keefer moved to accept the following Police employees into the Public Safety Retirement System with pre-existing conditions noted on the A.P.O.S.T. medical evaluation: Andrew Brandt Gino Garcia Steven Julian James Lord Daniel Reber Eric Toonstra Rachel Wallace Kevin Falk James Hajek Michael Loose Justin Ramsay Nicholas Stepp Steven Toonstra Lt.
