TOWNSHIP OF FAIRFIELD ORDINANCE # 2018 12 ORDINANCE PROVIDING FOR CURB IMPROVEMENTS IN AND FOR THE TOWNSHIP OF FAIRFIELD, IN THE COUNTY OF ESSE, NEW JERSEY AND DIRECTING THE DELIVERY OF NOTICE AND SPECIAL ASSESSMENT OF THE COSTS THEREOF, AUTHORIZED IN AND BY THE TOWNSHIP OF FAIRFIELD, IN THE COUNTY OF ESSE, NEW JERSEY WHEREAS, the Governing Body of the Township of Fairfield (the Township ) desires to improve the public safety and general welfare of the residents of the Township of Fairfield by making curb improvements to various streets in the Township, and WHEREAS, the Township has previously identified several properties that required curb improvements in Ordinance #2002-12, finally adopted on August 26, 2002, which provided for financing of the same; and WHEREAS, the Township wishes to include additional properties for curb improvements, and WHEREAS, the Township will be required to provide notice of the assessment of the costs of the curbing improvements to the additional property owners who are benefitted thereby, in accordance with N.J.S.A. 40:65-2 to 40:65-5. NOW, THEREFORE, BE IT ORDAINED by the Mayor and Township Council of the Township of Fairfield, County of Esse, State of New Jersey, as follows: Section 1. The local improvements to be undertaken are the improvements to curbing within the Township. The affected properties, listed by block and lot, include but are not limited to the following: STREET BLOCK LOT Woodland Road 3802 5, 6, 7, 25, 13, 8, 9, 10, 11 Pinewood Terrace 1908 1909 6, 7, 8 3 Section 2. The total estimate cost of said improvements in the amount of $50,000 shall be paid by special assessments which shall be levied in accordance with law on property specially benefitted thereby, as nearly as may be in proportion to and not in ecess of the benefit. Cost shall be assessed to each property at a rate of
$29 per linear foot of Belgian block curbing installed. No cost will be assessed to any properties on which eisting Belgian block is to be replaced. Section 3. Pursuant to N.J.S.A. 40:65-6, notice is hereby given to the owners of the properties described in Section 1 herein, that the improvements described therein shall be undertaken as a curb improvement and the entire cost thereof shall be assessed in the following manner. An accurate account of the cost of construction of the curbing shall be kept, and such cost shall be assessed upon the property fronting on the improvements pursuant to and in accordance with N.J.S.A. 40:65-1 et seq.. The shall cause notice of the proposed curb improvements to be given to the owner or owners of real estate affected thereby prior to the making of the sidewalk improvements described in said Section 1. Such Notice shall be served in accordance with the provisions of N.J.S.A. 40:65-2 to 40:65-5, and the proof of service shall be filed with the officer of the Township in charge of the records of ta liens of the Township within ten days after service thereof. Section 4. The owner of any land upon which any assessment for the local improvement shall have been made may pay such assessment in the number of equal yearly installments not to eceed 10 years, with legal interest on the unpaid balance of the assessment. The first of the installments shall be due and payable two months after the confirmation of the assessment, and each subsequent annual installment and interest shall be payable in each successive year thereafter at such time as the governing body shall by resolution determine, provided that any owner of land so assessed shall have the privilege of paying the whole of any assessment or of any balance of installments with accrued interest thereon at any time. Whenever any such installment shall remain unpaid for thirty (30) days from and after the time it shall become due and payable, the whole assessment or balance thereof shall become and be immediately due and payable and shall draw interest at the rate imposed upon the arrearage of taes in the Township and shall be collected in the same manner as provided by law for other past-due assessments. Such assessment shall remain a lien upon the land described herein until the assessment with all installments and accrued interest thereon shall be paid and satisfied. Notwithstanding anything herein to the contrary, the Township shall have the right to waive default as may be permitted by law. Section 3. `To the etent that any of the properties listed in Section 1 have previously been provided notice in accordance with Section 2 above, additional notice will not be required. Section 4. All ordinances and parts of ordinances inconsistent herewith are hereby repealed. Section 5. If any section, paragraph, subdivision, clause of provision of this ordinance shall be adjudged invalid, such adjudication shall apply only to that section, paragraph, subdivision, clause or provision so adjudged, and the remainder of this ordinance shall be deemed to be valid and effective.
Section 6. This ordinance shall take effect immediately after final passage, approval and publication as required by law. ATTEST: Mayor DENISE D.
