TEXAS DEPARTMENT OF PUBLIC SAFETY 5805 N LAMAR BLVD BOX 4087 AUSTIN, TEXAS 78773-0001 512/424-2000 www.dps.texas.gov PUBLISHED: March 12, 2019 Determinations under Article 62.003, of Criminal Procedure Offenses under the laws of Colorado Chapter 62 of the of Criminal Procedure (Texas Sex Offender Registration Program) requires a person with a reportable conviction or adjudication to register with the local law enforcement authority of the municipality or county where the person resides. Reportable conviction or adjudication includes a conviction or adjudication of delinquent conduct under the laws of another state for an offense containing elements that are substantially similar to the elements of a Texas offense that requires registration. For purposes of Chapter 62 of the of Criminal Procedure, the Texas Department of Public Safety ( Department ) is responsible for determining whether an offense under the laws of another state contains elements that are substantially similar to the elements of an offense under the laws of this state. Elements refers to the following matters contained in the relevant statutes: the forbidden conduct, the required culpability, any required result, and the negation of any exception to the offense. The Department has reviewed the elements of the following Colorado offenses and has determined that they contain elements that are substantially similar to the elements of a Texas offense that requires registration. Consequently, a conviction or adjudication of delinquent conduct for any one of the following Colorado offenses qualifies as a reportable conviction or adjudication. If a determination involves the Texas offenses of Burglary or Aggravated kidnapping, contact the Sex Offender Registration Bureau to discuss whether the offense was committed with the intent to violate or abuse the victim sexually. If a determination involves the Texas offense of Obscenity, contact the Sex Offender Registration Bureau to discuss whether the offense was punished under subsection (h) of Texas Penal section 43.23. If a determination involves the Texas offenses of Unlawful restraint, Kidnapping, or Aggravated kidnapping, contact the Sex Offender Registration Bureau to discuss whether an affirmative finding that the victim or intended victim was younger than 17 years of age exists. This is not an exhaustive list of Colorado offenses that require registration. If an offense is not on this list and you believe the offense may require registration, please contact the Sex Offender Registration Bureau for a determination. 1 of 8
